RESX-)LUT I ONT OF THE COUNCIL CSF THE C I TY OF AT ASCADERO
TO LEVY AND COLLECT ASSESSMENTS FOR CERTAIN
IMPROVEMENTS AND (MAINTENANCE PURSUANT TO THE
PROVTSIONS OF THE IMPROVEMENT ACT OF 1911
(STREETS AND HIGHWAYS COPE SECTION 5820-5356)
MAINTENANCE DISTRICT 86-4 : CAYUCOS AVENUE
WHEREAS, Maintenance District 86-4 : Cayucos Avenue
was established by Council on July 23, 1986 under the
provisions of the Streets and Highways Code of the State
of California ; and
WHEREAS, the construction costs for fiaintenance
District 86-4 : Cayucos Avenue _xceedewd the Dost estimate;
and
WHEREAS , a Public Hearing was held on the 28th day
of JulY . 1937 at 7: 30 p.m. in the Council Chambers of the
City Council to hear objection: to the additional charges
for the improvements done in fllaintenance District 86-4 :
Cayucos Avenue .: and
WHEREAS , theCouncil has heard testimony and
evidence and is desirous of proceeding with the placing of
the additional construction charges on the property tax
roll ; and
NOWT THEREFORE;: IT IS HEREBY RESOLVED by the Council
of the Cit✓ of Atascadero as follows :
Section 1 . The above recitals are true and
correct .
Section 2 . The adoption of this resolution
const-Lutes a levy of the assessment for the fiscal year
commencing on the 1st day of July , 1937 , and ending on the
30th da, of June, 1989.
Section 3 . The assessment jet forth in Exhibit
''A'' , attached, is hereby confirmed and adopted by this
Council .
Section 4 . The ;�iorks of .improvement described in
vhe Resolution of Tretention have been _,erformed pursu.Znt
to law, and the County auditor ,zhall enter on Uka COUnt v
Assessment Roll , the amount c ; ane ,assessment , and said
assessment shall then be collected Lat the same -time and in
the same ,manner as the County taxes ,are collected. After
collection by said County, the ner_ amount of Lh-e
as'sessm.en.t shall be said to the City Treasurer of the
City .
Section 5 . The City Treasurer shall place ail
monies collected by the Tax Collector r,ursuant to the
provisions of the resolution and law into a special fund
previously established known as "City of Atascadero
Maintenance District 86--4 : l.ayuco'` Avenue" .:aid transfer
shall he made and accomplished as soon as said atonies have
been made available to the City Treasurer ,
Section 6 . The City Clerk is hereby ordered and
directed fill ? certified Copy the as 'a' itl

with the County Auditor , together with a certified copy of
this Res�Autiotl upon its adoption .
Section 7 . The City Clerk is hereby furter ordered
and directed to file a certified c-opy of the assessment
rola, with the County Tax Collector, together with a
certified copy of Erle Resolution upon its- a.-option .

shall be filed in the office of the Public Works Director ,
with a duplicate copy on file in the office of the City
Clerk and open to the public for inspection .
Section 12 . Any parcels or lot's of land known as
public property , as The sante is defined in Section 22653
of Division 15 Part: 2 of the Streets and Highways Code
which are included within the boundaries of the District ,
shall be omitted and exempt from any assessment made under
these proceedings .
