Victoria Randall, Deputy City Clerk City of Atascadero City of Atascadero WELCOME TO THE ATASCADERO CITY COUNCIL MEETING The City Council meets in regular session on the second and fourth Tuesday of each month at 6:00 p.m. unless there is a Community Redevelopment Agency meeting commencing at 6:00 p.m. in which event the Council meeting will commence immediately following the conclusion of the Community Redevelopment Agency meeting. Council meetings will be held at the City Hall Council Chambers, 6907 EI Camino Real, Atascadero. Matters are considered by the Council in the order of the printed Agenda. Regular Council meetings are televised live, audio recorded and videotaped for future playback. Charter Communication customers may view the meetings on Charter Cable Channel 20 or via the City's website at www.atascadero.org. Meetings are also broadcast on radio station KPRL AM 1230. Mr. Wayne Cooper stated that Mr. Clickard was unable to be present tonight. Mr. Cooper and Ms. Pittinger made a brief presentation and answered questions of the Council. Ms. Pittinger referred to the Lighthouse packet (Exhibit A) which was handed out to Council Members. A. CONSENT CALENDAR: 1. City Council Draft Action Minutes — November 13, 2012 ■ Recommendation: Council approve the City Council Draft Action Minutes of November 13, 2012. [City Clerk] 2. Interchange Planning and Design Services for the Del Rio Freeway Interchange Project Contract Award (Contract for Professional Services) ■ Fiscal Impact: Up to $562,400 in budgeted Circulation Impact Fees funds. ■ Recommendation: Council authorize the City Manager to execute a contract with Wallace Group to provide initial engineering and environmental services for processing Caltrans required planning and preliminary design approval of the Del Rio Road Freeway Interchange for an amount not to exceed $562,400 [Public Works] MOTION: By Council Member Fonzi and seconded by Council Member Sturtevant to approve the Consent Calendar. (Contract No. 2012-017) UPDATES FROM THE CITY MANAGER: City Manager Wade McKinney gave an update on questions that arose from Mitch Paskin in regards to a safety study on Los Altos Road. City Manager Wade McKinney gave an update on projects and issues within the City. Mayor Kelley closed the COMMUNITY FORUM period. B. PUBLIC HEARINGS: 1. North County Connection — In-Lieu Affordable Housing Fund Allocation ■ Ex Parte Communications: ■ Fiscal Impact: At the March 2012 meeting, the Council decided to reserve at least $100,000 in the in-lieu housing fund in order to continue to administer the existing low and moderate income affordable housing loan program. ■ Recommendation: Council authorize a loan of $100,000 from the In-Lieu Affordable Housing Fund to North County Connection for one low-income affordable housing unit on the property at 8600 Atascadero Avenue. [Community Development] Ex Parte Communications: Mayor Kelley said he has known Sue Warren and over the last 3-4 years, he has been involved in putting some type of deal together. Mayor Pro Tem O'Malley — stated he has known Sue Warren for many years and has witnessed her do a good job. She has the Council's support. Council Member Clay — stated he has known Sue Warren in the past, but hasn't been involved with the project. Council Member Fonzi — stated she has known Sue Warren in the past, but hasn't been involved with the project. Council Member Sturtevant — stated he attended an open house; other than that, no ex parte. Community Development Director Warren Frace gave the staff report and answered questions from the Council. MOTION: By Mayor Pro Tem O'Malley and seconded by Mayor Kelley to authorize a loan of $100,000 from the In-Lieu Affordable Housing Fund to North County Connection for one low-income affordable housing unit on the property at 8600 Atascadero Avenue. Motion passed 5:0 by a roll-call vote. 2. 2013 Community Development Block Grants Draft Recommendations ■ Ex Parte Communications: ■ Fiscal Impact: Available funds, including the anticipated 2013 allocation and prior year reallocations, are estimated at $154,987.93. ■ Recommendation: Council develop and adopt draft funding recommendations for the 2013 Community Development Block Grant (CDBG) funds. Council Member Fonzi stated that she would like to acknowledge City Planner Callie Taylor as she has worked hard on the Climate Action Plan and made sure that Atascadero was represented properly. D. COMMITTEE REPORTS: Council Member Fonzi 1. Air Pollution Control District — discussed the dust that is blowing from the Oceano Dunes up to the Nipomo Mesa. This issue has not been resolved. 2. Design Review Committee — discussed the Eagle Ranch project. E. DISCUSSION: The General Municipal Election was held on November 6, 2012. California Elections Code §10262 states that the City Council shall meet to declare the results of the election upon certification of results by the County Election Department. The California Elections Code §10262 & 10264 also states that the Council shall adopt a resolution reciting the fact of the election, including a statement of the results. Total voter registration for the City of Atascadero was 16,813, which is 360 more than the total voter registration for the year 2010. Atascadero voters were asked to vote for two Council Members, and a Mayor. The final official results are attached to this report. FISCAL IMPACT: None. ITEM NUMBER: A- 2 DATE: 12/11/12 Attachment 2 DRAFT RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATASCADERO, CALIFORNIA RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 6, 2012, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Atascadero, California, on Tuesday,November 6, 2012, as required by law; and, WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and, WHEREAS, pursuant to Resolution No. 2012-043 adopted June 13, 2012, the County Election Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ATASCADERO, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots cast in the precincts except vote by mail voter ballots and provisional ballots was 5086. That the whole number of vote by mail voter ballots cast in the City was 8422, malting a total of 13,508 ballots cast in the City. SECTION 2. That the names of persons voted for at the election for Mayor are as follows: Tom O'Malley That the names of the persons voted for at the election for Member of the City Council are as follows: Bob Kelley, Ann Ketcherside, and Roberta Fonzi SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates and for and against the measures were as listed in Exhibit"A" attached. The City Council does declare and determine that: Tom O'Malley was elected as Mayor for the full term of two years; Roberta Fonzi was elected as Member of the City Council for the full term of four years; and Bob Kelley was elected as Member of the City Council for the full term of four years. SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person; (5) The total number of votes given to each person. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. Atascadero City Council Staff Report — City Manager's Office City Council 2013 Meeting Schedule RECOMMENDATION: Council approve the City Council meeting schedule for 2013. DISCUSSION: The City Council, pursuant to Chapter 2, Section 1 .01 of the Atascadero Municipal Code, meets the second and fourth Tuesday of each month. On occasion, the Council will hold special study sessions and/or joint meetings with one or both of the Commissions on a fifth Tuesday. Generally, in the summer months, the Council meets once a month and avoids conflicts with major holidays. Staff has prepared the attached schedule for the year 2013 to help in the coordination of these meetings with personal schedules. Nominate candidates and vote to fill the City Council vacancy; OR 2. Determine a process to fill the City Council vacancy and direct the City Clerk to implement the process; OR 3. Direct the City Clerk to place a Resolution on the next agenda, calling for a Special Election to fill the City Council vacancy. DISCUSSION: As of the City Council meeting of December 11 , 2012, the City of Atascadero will now have its first elected Mayor. Since the Mayor is a current Council Member who was mid-term, there is now a vacancy on the City Council with a remaining two-year term. The City Council must appoint a replacement, or call for a Special Election, within 60 days of the position becoming vacant. There are a variety of options available to the Council for the appointment to fill this vacancy. For example, • Council may nominate candidates and vote for a replacement at the Council meeting of December 11, 2012. • Council could create a process for identifying interested persons and direct the City Clerk to implement the process. ITEM NUMBER: Reorg DATE: 12/11/12 If the City Council cannot agree on a replacement, or if they prefer to have the voters choose a replacement, then the Council must call for a Special Election within 60 days to fill the vacancy. The Special Election must be held on the next regularly established California election date not less than 114 days from the call of the Special Election. The following is the list of established California election dates: • The second Tuesday of April in even years • The first Tuesday after the first Monday in March in odd years • The first Tuesday after the first Monday in June of each year • The first Tuesday after the first Monday in November of each year • The first Tuesday in February of each year divisible by four For example, if the Council does not appoint, they would have to call for the Special Election by February 11th. The Special Election must be no less than 114 days after the calling of the Special Election, which would be May or June. The only regularly established election dates listed above that qualifies for a Special Election to fill a Council Member vacancy at this time is the options underlined above; the first Tuesday after the first Monday in June or November of each year. As a result, the Council will be a four member Council from December through June or November, depending on the timing of the calling for the Special Election. Also, the County Clerk's office has informed Atascadero that since this will occur in 2013, an odd year, they will be unable to conduct a stand-alone Special Election which will require the City to conduct the stand-alone election. This will require the hiring of an election consulting firm, additional temporary employees for document processing and the counting of ballots, precinct workers, rental of election equipment, etc. The cost for a stand-alone Special Election would be well over $100,000.00. In the future, if a County election coincides with our needs for a Special Election, the cost will depend on what other agencies are consolidating with the County. The price for a consolidated Special Election could range between $35,000.00 - $85,000.00. FISCAL IMPACT: The fiscal impact will depend on the decision of the City Council. ATTACHMENTS: None.
