WELCOME TO THE ATASCADERO CITY COUNCIL MEETING
The City Council meets in regular session on the second and fourth Tuesday of each month at 6:00 p.m. unless there is a
Community Redevelopment Agency meeting commencing at 6:00 p.m. in which event the Council meeting will commence
immediately following the conclusion of the Community Redevelopment Agency meeting. Council meetings will be held at
the City Hall Council Chambers, 6907 EI Camino Real, Atascadero. Matters are considered by the Council in the order of
the printed Agenda. Regular Council meetings are televised live, audio recorded and videotaped for future playback.
Charter Communication customers may view the meetings on Charter Cable Channel 20 or via the City's website at
www.atascadero.org. Meetings are also broadcast on radio station KPRL AM 1230. Contact the City Clerk for more
information (470-3400).
Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file
in the office of the City Clerk and are available for public inspection during City Hall business hours at the Front Counter of
City Hall, 6907 EI Camino Real, Atascadero, and on our website, www.atascadero.org. An agenda packet is also
available for public review at the Atascadero Library, 6850 Morro Road. Contracts, Resolutions and Ordinances will be
allocated a number once they are approved by the City Council. The minutes of this meeting will reflect these numbers.

City Attorney Pierik announced that the City Council directed staff to place on future City
Council agendas a listing under Closed Session for the Save Atascadero lawsuit in the
event that there is any need for the City Attorney to update the City Council.

Grenda Ernst recognized Council Member Sturtevant for his generous efforts for the
Library.
Eileen O'Grady gave an update to the City Council on the progress of the new Library,
using a PowerPoint presentation.
2. Recognition of State of California Special Training Award Recipients
Fire Chief Kurt Stone recognized Michael Stornetta as receiving a commendation from
the California Fire Marshall's Office certifying him as a Certified Fire Engineer.
3. Commendation to Atascadero Citizen Dave Guerena for Heroism
during the Bordeaux Apartment Complex Fire
Fire Chief Kurt Stone and Fire Captain Bill White recognized Dave Guerena for his
actions saving his neighbor during a structure fire.
4. Recognitions to Individuals for Their Support of 4th of July Event, 2012
Mayor Bob Kelley and Council Member Kelley recognized volunteers who helped make
the 4th of July event a success.

■ Fiscal Impact: $4,331,426.08.
■ Recommendation: Council approve certified City accounts payable,
payroll and payroll vendor checks for July 2012. [Administrative Services]
3. Purchase of Two Police Patrol Vehicles
■ Fiscal Impact: $55,598.90 of budgeted Vehicle Replacement Funds.
■ Recommendation: Council authorize the purchase of two (2) police patrol
vehicles from Wondries Fleet Group in Alhambra, California at a total cost
of $55,598.90. [Police]
4. Salt and Nutrient Management Plan
■ Fiscal Impact: Atascadero's proportional share for this Regional Salt and
Nutrient Management Plan is $50,226. Atascadero is currently funded for
this Plan in the 2011-2013 City Budget at $70,000. Staff does not believe
additional funding beyond this level will be required.
■ Recommendation: Council authorize the City Manager to execute a
reimbursement agreement with the City of Paso Robles up to a maximum
of $70,000 for the development of a Regional Salt and Nutrient
Management Plan. [Public Works]
MOTION: By Council Member Fonzi and seconded by Council Member
Sturtevant to approve the Consent Calendar.

The following citizens spoke during Community Forum: Mike Casey, David Bentz,
Marilyn Kirkland, Mike Anderson, Deborah Paskin, Mitch Paskin, Melissa Peters, Karyn
Sturtevant, and Jim Shannon.
Mayor Kelley closed the COMMUNITY FORUM period.
B. PUBLIC HEARINGS: None.
C. MANAGEMENT REPORTS:
1. Approval of Service Agreement with the Friends of the Charles Paddock
Zoo, Inc. for Support Services
■ Fiscal Impact: Staff conservatively estimates that the proposed
relationship with the Friends of the Charles Paddock Zoo will result in
more than $250,000 dollars in fundraising support over the life of the
agreement.
■ Recommendation: City Council authorize the City Manager to execute the
service agreement with the Friends of the Charles Paddock Zoo.

Community Services Director Brady Cherry gave the staff report and answered
questions from the Council.

Litigation Filed Against the City on the Wal-Mart Project

against the City on the Wal-Mart project, and provide direction to Staff, if

PUBLIC COMMENT:
The following citizens spoke on this item: Jim Shannon, Edward Beek, Mike Anderson,
Gary Kirkland, Bob Wilkins, George Schroff, Anthony Falcone, Tino Santos, Steve
Issacson, Karyn Sturtevant, and Sara Merson.
Mayor Kelley closed the Public Comment period.
MOTION: By Mayor Pro Tem O'Malley and seconded by Council Member
Fonzi to direct staff to prepare a letter for the Tribune
Viewpoint as follows:
We are very disappointed by the lawsuit filed by Save Atascadero, formerly "Oppose
Wal-Mart," challenging the City's approval of the Wal-Mart/Annex project because it
prevents the people of Atascadero from moving forward.
Over the last seven years we've dedicated thousands of hours of staff time to hold 14
public meetings/hearings on this project. We've been dedicated to providing extensive
information and opportunity for comment through the Internet and at City Hall including
the Draft Environmental Impact Report (EIR), partial recirculation of the Draft EIR
(PDEIR) and several informational meetings. We remain dedicated to openness and
transparency on this and all municipal issues.
In 2008, a professional economics consultant surveyed local residents regarding their
shopping preferences and habits as part of the development of our community's
economic strategy. Only 13% were satisfied with shopping in the city and over 75%
were dissatisfied. Residents said they spent more than $79-million outside the city each
year, siphoning away at least $790,000 in retail sales tax revenue annually, funds that
could be used to enhance the quality of life for our residents. The project is expected to
bring 507 local jobs. The "Shield Initiative" put before voters by the Oppose Wal-Mart
group was soundly defeated and showed 68% of voter support for the Wal-Mart project,
a clear validation of support. Beyond the economic drain, thousands of trips by local
shoppers to Paso Robles, San Luis Obispo and Santa Maria create a serious impact on
the environment.
The members of the City Council have been involved with this project since its
inception. Some were already Council members at the time. Others were seated on the
Planning Commission when the first Wal-Mart proposals were presented. Public input
has modified the original proposal to a project that the overwhelming majority think is
good for Atascadero.

We understand and respect that the City Council is responsible for discerning the
public's wishes on any municipal project. We also understand and respect that we are
required to fulfill, to the letter, the legal requirements associated with such projects. We
have taken these obligations seriously and have accomplished both of these tasks and
we think the people who are suing Atascadero know it.
We are determined to see the Wal-Mart/Annex project through; clearly the project has
the support of an overwhelming majority of the people of Atascadero.
Let's work together to move ahead for the betterment of Atascadero.

3. Draft Response to Grand Jury Report Regarding Medical Marijuana
■ Fiscal Impact: None.
■ Recommendation: Council approve the Draft Response to the Grand Jury
Report entitled "Out of Sight, Out of Mind: Medical Marijuana in San Luis
Obispo County" and authorize the City Manager to execute the Draft
Response. [City Attorney]
City Attorney Brian Pierik gave the staff report and answered questions from the
Council.
PUBLIC COMMENT: None
MOTION: By Council Member Sturtevant and seconded by Council
Member Fonzi to approve the Draft Response to the Grand
Jury Report entitled "Out of Sight, Out of Mind: Medical
Marijuana in San Luis Obispo County" and authorize the City
Manager to execute the Draft Response.
Motion passed 5:0 by a roll-call vote.
4. Stormwater, FEMA Floodplain, and Wastewater Regulation Update
■ Fiscal Impact: None; update only.
■ Recommendation: Council receive and file report. [Public Works]
Deputy Public Works Director David Athey gave the staff report and answered
questions from the Council.

COUNCIL ANNOUNCEMENTS AND REPORTS:
1. Council Member Jerry Clay — July 4th Event
Council Member Clay requests the City Council:
a. Review the recent July 4th event; and,
b. Approve City sponsorship for the July 4th 2013 event.
MOTION: By Council Member Clay and seconded by Council Member
Fonzi to approve City sponsorship for the July 4th 2013 event.
Motion passed 5:0 by a roll-call vote.
2. Council Member Roberta Fonzi — GHG Plan
Council Member Fonzi recommends, on behalf of the Design Review
Committee, that the City Council assign the review of the Green House
Gases Plan to the Planning Commission and that the meeting be televised.
MOTION: By Council Member Fonzi and seconded by Council Member
Sturtevant to assign he review of the Green House Gases Plan
to the Planning Commission, and have the meeting televised.
Motion passed 5:0 by a roll-call vote.
3. Mayor Bob Kelley— Council Promotions Committee
Mayor Kelley requests Council consensus to replace Tom O'Malley with
Roberta Fonzi on the Council's Promotions Committee.
Mayor Pro Tem O'Malley stated that he did not think a committee was needed at this
point.
MOTION: By Council Member Clay and seconded by Mayor Pro Tem
O'Malley to replace Tom O'Malley with Roberta Fonzi on the
Council's Promotions Committee.
Motion passed 5:0 by a roll-call vote.
D. COMMITTEE REPORTS:

1. City / Schools Committee — The future of the Junior High was discussed.
More discussions will be taking place on their plans.
2. Integrated Waste Management Authority (IWMA) — They will be meeting
tomorrow. The main topics are the plastic bags ordinance and recycling.

1. Air Pollution Control District — They are holding a stakeholder meeting on
September 13th, and will be reviewing what their work plan will be for the next
5 years.
2. City of Atascadero Design Review Committee — The Climate Action Plan was
reviewed at the last meeting.
Council Member Sturtevant
1. City / Schools Committee — Junior High is not moving out of the downtown.
2. League of California Cities — Council Liaison — attended the Annual
Conference in San Diego last week.
E. INDIVIDUAL DETERMINATION AND / OR ACTION:
City Clerk Torgerson announced that there will be a Candidate Forum, hosted by the
Chamber of Commerce, on Wednesday, October 3rd at 6:00 p.m. in the City Council
Chambers.

6. Proclamation declaring October 7-13, 2012, as Fire Prevention Week
This proclamation was received by Fire Department staff.
7. Presentation of Bocce Ball Court Completion by the North County Adaptive
Sports and Recreation Program
Board Members of North County Adaptive Sports gave a presentation to the City
Council on the Bocce Ball Court construction.
8. Presentation by Tina Metzger of the Conference of California Historical
Societies
Ms. Metzger gave the City Council a summary of the Conference of California Historical
Societies Symposium taking place in Atascadero in October.
9. Update on Lake Park Bandstand construction by the Atascadero Kiwanis Club
Kiwanian Lon Allan explained how the new Bandstand will be constructed.

A. CONSENT CALENDAR:
1. Lift Station #6 Rehabilitation Project Award - City Bid No. 2012-008
■ Fiscal Impact: Award of the contract will result in the expenditure of
$325,442 in budgeted Wastewater funds and the allocation of $25,000 in
Wastewater Reserve funds toward the Project contingency.
■ Recommendations: Council:
1. Award the Lift Station #6 Base Bid in the amount of $313,442.00 and
Bid Alternate C in the Amount of $12,000, to Arthurs Contracting Inc.;
and,
2. Authorize the City Manager to execute a contract with Arthurs
Contracting Inc., in the amount of $325,442.00, for construction of the
Lift Station #6 Rehabilitation Project; and,
3. Authorize the Director of Administrative Services to allocate an
additional $25,000 of Wastewater Capital Reserve Funds to the
project; and,
4. Authorize the Director of Public Works to file a Notice of Completion
with the County Recorder upon satisfactory completion of the project.

1. California Fair Political Practices Commission (FPPC) Form 806 -
Consideration of Adoption
■ Fiscal Impact: Fiscal impact will be a result of the Staff time involved in
updating the Form 806 as needed.
■ Recommendation: Council adopt the FPPC Form 806 and direct the City
Clerk to post the completed form on the City's website. [City Clerk]

1. Integrated Waste Management Authority (IWMA) — The plastic bag ordinance
continues to be discussed.
Council Member Fonzi
1. SLO Local Agency Formation Commission (LAFCo) — alternate — The City of
Pismo Beach filed an annexation request with LAFCo and they were required
to sign an Indemnification Agreement in case there would be a lawsuit. The
Commission denied the annexation, and the developer is now suing LAFCo.
The City of Pismo Beach has declined to pay the legal fees because it was
LAFCo that denied the request. This leaves LAFCo on the hook for the legal
fees. Ms. Fonzi was told that if Pismo Beach does not pay the legal fees, that
LAFCo will expect the other cities participating in LAFCo to share the costs.

RECOMMENDATIONS:
Council:
1. Introduce for first reading by title only Draft Ordinance A, amending Title 2,
Chapter 2 of the AMC relating to the Personnel System; and,
2. Introduce for first reading by title only Draft Ordinance B, amending Title 2,
Chapters 7 & 14 of the AMC relating to Election Issues.
DISCUSSION:
Title 2 Chapter 2 - PERSONNEL SYSTEM
The City Council, on June 12, 2012, adopted revisions to the Personnel System Rules.
The Atascadero Municipal Code (AMC) listed the original adoption of a personnel
system in 1980, and included the text of the system in the AMC. With the adoption of
the revised Personnel System Rules, staff is recommending amending the AMC to refer
to the new Personnel System Rules by reference, and eliminate the text of the Rules
from the AMC. This revision makes the AMC consistent with the Rules recently
approved by the City Council. The Personnel System Rules is the document that
governs all aspects of the City's personnel function. All items being removed from the
AMC remain in the Personnel System Rules.
Staff is recommending the following amendments (additions are underlined, deletions

(a) Personnel s sy tem rules or pokeies shall be adopted by resolution of the
Council. Reasonable advanced written notice shall be given to each recognized employee
organization affected by any ordinance, rule, resolution, or regulation, or amendment
thereof, proposed to be adopted by the Council (optional if not within the scope of
representation). Upon request,the Personnel Officer shall provide the opportunity to meet
with any employee organization so requesting regarding amendments affecting wages,
hours, and other terms and conditions of employment, as specified in the City's
employer/employee relations resolution and as specified as being a matter within the
scope of representation.
(b) As provided in Section 3500 et seq. of the Government Code, in cases of
emergency, when the City Council determines that amendment(s) to personnel system

meet at the earliest practicable time following adoption by the City Council, unless

Title 2, Chapter 7, Section 1(a) — CITY TREASURER
This section of the AMC designates that the office of the City Treasurer is confirmed as
provided in the California State Code. It neglects to mention that it is an elected
position. The City Clerk is recommending that the following underlined text be added to
the AMC, Title 2, Chapter 7, Section 1(a):
2-7.01 Creation and functions.
(a) The office of the City Treasurer is confirmed as provided in Section 36501
and 36502 of the Government Code of the State. The office shall be elected. The City
Treasurer shall perform such duties as are prescribed by Sections 41001 through 41007 of
the Government Code of the State. The City Treasurer shall perform such other duties
consistent with this Code as may be required of him by the Council.
(b) The principal functions of the City Treasurer shall be to receive and safely
keep all public funds coming into his hands as treasurer, and to comply with all laws
governing the deposit and securing of public funds and the handling of trust funds in his
possession. (Ord. 49 § 2-5.201, 1982)
Title 2, Chapter 14 - ELECTIONS
The registered voters of the City of Atascadero, at the election of November 2, 2010,
voted to have an elected Mayor as of the 2012 election. The voters also designated
that the elected Mayor term will be for two years. Also, the other elected officials' terms,
the City Treasurer and the City Clerk, are not listed in the AMC. This information needs
to be included in the AMC.
The City Clerk is recommending that the following underlined text be added to the AMC,

Pursuant to the authority granted by the State, the City shall hold its general

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ATASCADERO, CALIFORNIA, AMENDING TITLE 2,
CHAPTERS 7 & 14 OF THE ATASCADERO MUNICIPAL CODE (AMC)
RELATING TO ELECTION ISSUES
The City Council hereby finds and declares as follows:
WHEREAS, the City Council of the City of Atascadero has previously adopted AMC
Chapters 2-7 &2-14 concerning the City Treasurer and Elections; and,
WHEREAS,the AMC neglects to mention in Title 2, Chapter 7 that the City Treasurer is
elected; and,
WHEREAS, the electors of the City of Atascadero, at the election of November 2, 2010,
voted to have an elected Mayor as of the 2012 election.; and,
WHEREAS, the electors also designated that the elected Mayor term will be for two
years; and,
WHEREAS, the City Council desires to update the Atascadero Municipal Code
regarding all elected officials.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ATASCADERO
HEREBY ORDAINS AS FOLLOWS:
SECTION 1: Title 2, Chapter 7 of the Atascadero Municipal Code is hereby amended as
follows:
2-7.01 Creation and functions.
(a) The office of the City Treasurer is confirmed as provided in Section 36501
and 36502 of the Government Code of the State. The office shall be elected. The City
Treasurer shall perform such duties as are prescribed by Sections 41001 through 41007 of
the Government Code of the State. The City Treasurer shall perform such other duties
consistent with this Code as may be required of him by the Council.
(b) The principal functions of the City Treasurer shall be to receive and safely
keep all public funds coming into his hands as treasurer, and to comply with all laws
governing the deposit and securing of public funds and the handling of trust funds in his
