City Clerk / Assistant to the City Manager Attachment: Exhibit A – Handouts from Mike Brennler ITEM NUMBER: OB B - 1 DATE: 08/16/12 Oversight Board for Successor Agency to the Community Redevelopment Agency of Atascadero Staff Report – Administrative Services Approval of Recognized Obligation Payment Schedules RECOMMENDATION: Oversight Board adopt Draft Resolution approving Recognized Obligation Payment Schedule (ROPS) for the period of January 1, 2013 through June 30, 2013 and authorizing the City Manager to amend the ROPS. DISCUSSION: On December 29, 2011, the California Supreme Court delivered its decision in the California Redevelopment Association v. Matosantos case. The decision upheld AB1x 26, the Dissolution Act, and found AB1x 27, the Alternative Redevelopment Program Act, unconstitutional. AB1x 26 dissolved the Redevelopment Agency as of February 1, 2012, the new dissolution date established by the Supreme Court. AB 1484 was signed by the Governor on June 27, 2012 and further changed the process for dissolvin g redevelopment agencies. On August 1, 2012 the Department of Finance (DOF) released the form for the Recognized Obligation Payment Schedule (ROPS) for the period of January 1, 2013 through June 30, 2013. This form was later modified by DOF on August 10, 2012. In accordance with AB 1484, the form must be approved by the oversight committee and be submitted to the DOF by September 4, 2012. While the format is different, similar to ROPS submitted for previous periods, this schedule lists obligations of the former Redevelopment Agency. This schedule also details actual amounts paid with Redevelopment Property Tax Trust Funds (RPTTF) for January 1, 2012 through June 30, 2102. The form has been prepared with the best information/direction available at the time of preparation; however the process continues to evolve. ITEM NUMBER: OB B - 1 DATE: 08/16/12 The draft ROPS before you, does include items that DOF had not approved on previously submitted ROPS. DOF’s July 12, 2012 letter states that “Requests to reconsider denied or disputed ROPS items will be addressed in our January through June 2013 review.” Although the City as Successor Agency submitted a letter to DOF on May 10, 2012 disputing the items that were not approved, the dispute resolution process called for in AB1484 has not been completed and therefore these items are again included on the draf t ROPS for January through June 2013. This will allow the DOF and City as Successor Agency to follow the process for dispute resolution outlined in AB 1484 and the DOF’s July 12, 2012 letter. Once the Oversight Board reviews and approves the Draft ROPS, it will then be submitted to the DOF for review and approval. The DOF will have 45 days to review the ROPS and to object to items that do not meet the definition of an Enforceable Obligation. FISCAL IMPACT: None for this action. The purpose of approving the Draft Recognized Obligation Schedules is to ensure that the City acting as Successor Agency will be able to make certain payments for obligations of the former RDA. The Oversight Board hereby approves the proposed Recognized Obligation Payment Schedule for January 1, 2013 – June 30, 2013, attached hereto as Exhibit A (“ROPS”). Section 3. The City Manager is hereby directed to submit the approved ROPS to DOF, the County Administrative Officer, and the County Auditor, and to take any other actions that may be required in order to obtain DOF approval of the ROPS, including, without limitation, making amendments to the ROPS required by the DOF. Attachment A Name of Successor Agency:City of Atascadero as Successor Agency to the Community Redevelopment Agency of Atascadero County:San Luis Obispo Item # - The Department of Finance determined that the March 2012 & September 2012 debt service payments were reported incorrectly on the previous ROPS. Once the RDA received its December 2011 distribution of tax increment, the RDA, in accordance with bond covenants, transferred enough of the increment cover these debt service payments to the Special Fund. The ROPS reported these debt service payment coming out of "other" funds (the Special Fund) rather than RPTTF. Since the December tax increment was taken away in July 2012, this was determined to be incorrect. The Successor Agency was not allowed to deduct this payment from December tax distribution, when determining the amount to be returned to the County. The Successor Agency met with DOF representatives on July 11, 2012. In accordance with DOF's July 12 letter stating that denied or disputed items be addressed in their January 2013-June 2013 review, this item has been included on this ROPS. - The source of these funds is rent that the Successor Agency receives for the Creekside Building. The Creekside Building is part of Colony Square and per CCRs, the building owner must pay its proportionate share of common area maintenance costs. The amounts due for the period are estimated. Actual payments will depend on billings from Colony Square for maintenance of the common area. - The source of these funds is rent that the Successor Agency receives for the Creekside Building. The Successor Agency continues to lease the building to the City for $31,133 per month. In order to receive the lease funds, the Successor Agency must maintain the exterior and shell of the building in accordance with the market rate lease agreement. This is a large capital project and the timing of payments to contractors are often hard to project with accuracy. Due to the type of grant funding received the for the Project, amounts funded by bonds versus grants is also estimated and is subject to change based on FEMA determinations of eligibility. The remaining Project budget at 7/1/1 1 was $27,970,000 with dedicated bond proceeds making up $12,118,000 of the remaining amount. The Project is projected to be on time and at budget. 48-53 - All these obligations relate to commitment of bond proceeds to bond holders and granting agencies. These are reported at a zero value since the expenditure to vendors that fulfill these commitments are reported in other line items above 54-121 - All these obligations were closed out prior to 6/30/12 and have zero balance remaining Notes/Comments RECOGNIZED OBLIGATION PAYMENT SCHEDULE (ROPS III) -- Notes (Optional) January 1, 2013 through June 30, 2013 - Bond indenture agreements require that the RDA move increment totaling the following year's debt service payment into a restricted fund at the time of the first increment distribution. Because of this covenant, the Successor Agency worked with County and determined that the entire 2013 calendar year debt service was due in the restricted fund in December 2012, therefore it was listed on the July 2012-December 2012 ROPS. When the Successor Agency received these funds in June 2012, the funds were immediately transferred to the restricted fund. Payments from this restricted fund will be made in February and August.
