December 2010 Accounts Pavable and Payroll ■ Fiscal Impact: $ 2,301,074.13. ■ Recommendation: Council approve certified City accounts payable, payroll and payroll vendor checks for December 2010. [Administrative Services] 5. December 2010 Investment Report ■ Fiscal Impact: None. ■ Recommendation: Council receive and file the City Treasurer's report for quarter ending December 2010. [Administrative Services] 6. Temporary Road Closure - Colony Days Parade Route ■ Fiscal Impact: No net fiscal impact to the General Fund, as the road closure fee covers the staff time and equipment required for traffic control and clean-up related to this event (estimated at $2,600.00). ■ Recommendation: Council adopt the Draft Resolution establishing a temporary Colony Days Parade Route on Saturday, October 15, 2011, and establishing associated tow-away and "No Parking" zones and road closures from October 13 — 16, 2011, on the dates, times and locations as specified in the Draft Resolution. [Community Services] 2 7. Second Reading - PLN 2009-1328 / ZCH 2010-0162 - Zoning Code & Zoning Map Update: RMF-20 (City of Atascadero) ■ Fiscal Impact: There is no fiscal impact in adopting the Housing Element; however, implementation of related programs in the future will result in yet undetermined costs to the City. ■ Recommendations: Council 1. Introduce Draft Ordinance A, for second reading, by title only, to approve Zoning Code Updates (PLN 2009-1328/ ZCH 2010-0162) to change RMF-16 to RMF-20 and update Zoning Ordinance definitions related to housing, based on findings; and, 2. Introduce Draft Ordinance B, for second reading by title only, to approve Zoning Map Update (PLN 2009-1328/ ZCH 2010-0162) to change RMF-16 to RMF-20, based on findings. [Community Development] 8. On-site Alcohol Sales License — Determination of Public Convenience — PLN 2011-1390 / ABC 2011-0009 — 8005 El Camino Real (BL T- Atascadero 7210, LLC/Walgreens) ■ Description: Request to approve an off-site sale of beer and wine to an existing establishment Alcohol Beverage Control license application. ■ Fiscal Impact: Slight positive fiscal impact expected from increased sales tax. • Recommendation: Council adopt Draft Resolution "A" finding that a public convenience would be served by allowing the issuance of a type 20 off-site sales of beer and wine license for Walgreens Drug Store, an existing retail establishment located at 8005 El Camino Real (APN 030- 141-077). Victoria Randall, Deputy City Clerk City of Atascadero 5 City of Atascadero WELCOME TO THE ATASCADERO CITY COUNCIL MEETING The City Council meets in regular session on the second and fourth Tuesday of each month at 6:00 p.m. unless there is a Community Redevelopment Agency meeting commencing at 6:00 p.m. in which event the Council meeting will commence immediately following the conclusion of the Community Redevelopment Agency meeting. Council meetings will be held at the City Hall Council Chambers, 6907 EI Camino Real, Atascadero. Matters are considered by the Council in the order of the printed Agenda. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the office of the City Clerk and are available for public inspection during City Hall business hours at the Front Counter of City Hall, 6907 EI Camino Real, Atascadero, and on our website, www.atascadero.org. City Council 2011 Meeting Schedule (Revised) ■ Fiscal Impact: None. ■ Recommendation: Council approve the revised City Council meeting schedule for 2011.[City Manager] 3. Traffic Signal Maintenance Services Award ■ Fiscal Impact: $1,428.00 per month between January 1, 2011, and January 3, 2014. ■ Recommendation: Council authorize the City Manager to execute a contract with Lee Wilson Electric in the amount of $ 51 ,408.00 to provide monthly traffic signal maintenance services for three years. [Public Works] 4. Las Lomas Landscape and Lighting District - Landscape Maintenance Services Award ■ Fiscal Impact: The City's share for Open Space Maintenance is currently estimated at $1,800.00 per year. ■ Recommendation: Council authorize the City Manager to execute an agreement with Madrone Landscapes, Inc., in the amount of $47,292.00 for annual landscape maintenance services in the Las Lomas Landscape and Lighting Assessment District. [Public Works] 5. Reiect Streetscape Phase III Bids (City Bid No. 2009-014) ■ Fiscal Impact: The fiscal impact of rejecting the bids is minimal as there are no changes to the existing plans, specifications and contracts which have already been developed. Minor staff time and minimal advertisement costs will be the only proposed expenses to re-bid the project. ■ Recommendations: Council: 1. Reject all bids for the Streetscape Phase III project; and, 2. Authorize the Public Works Director to re-bid the project. MOTION: By Council Member Clay and seconded by Council Member Sturtevant to approve Items #A-1, 3, 4, & 5 of the Consent Calendar. Motion passed 5:0 by a roll-call vote. (#A-3: Contract No. 2011- 001, #A-4: Contract No. 2011-002) Item #A-2: Council Member Kelley suggested that the Council meet the second and fourth Tuesdays in July and August instead of just one meeting per month. MOTION: By Council Member Fonzi and seconded by Council Member Sturtevant to approve Consent Calendar #2 as recommended. Motion passed 5:0 by a voice vote. UPDATES FROM THE CITY MANAGER: City Manager Wade McKinney gave an update on projects and issues within the City. Mr. McKinney introduced Mark Curran, of Piper Jaffray, who reviewed what the effects of the Governor's State budget proposal could have on Atascadero. Mr. McKinney asked the Council to call a Special Joint Meeting on Friday to allow staff to bring to the Council and RDA Board options regarding the Governor's proposal to eliminate Redevelopment Agencies. There was Council consensus to call the Special Meeting for Friday concerning the Governor's proposal to eliminate Redevelopment agencies. COMMUNITY FORUM: The following citizens spoke during Community Forum: Terry Mathis, Marty Brown (Exhibit A), Lee Perkins, Judy Vick, Linda Ekata, Marty Gurdis, Ken Mallett, Grenda Ernst, Leslie Halls, Mike Brennler, Richard Grise, and Jim Patterson. PUBLIC HEARINGS: Second Reading Title 4 / Title 8 Local Building Code and Fire Protection Code Adoption (City of Atascadero) ■ Ex Parte Communications: ■ Fiscal Impact: There are no significant fiscal impacts. • Recommendation: Council adopt on second reading, by title only, Draft Ordinance A, repealing Title 8 (Building Regulations) and Chapter 7 of Title 4 (Fire Code), and amending Title 8 and Chapter 7 of Title 4 of the Municipal Code to adopt and amend the latest editions of the Construction and Fire Codes, and adopt findings of facts to support the imposition of requirements greater than the requirements established by or pursuant to the California Building Standards Code. [Community Development] Community Development Director Warren Frace gave the staff report and answered questions from the Council. PUBLIC COMMENT: None MOTION: By Council Member Fonzi and seconded by Council Member Clay to adopt on second reading, by title only, Draft Ordinance A, repealing Title 8 (Building Regulations) and Chapter 7 of Title 4 (Fire Code), and amending Title 8 and Chapter 7 of Title 4 of the Municipal Code to adopt and amend the latest editions of the Construction and Fire Codes, and adopt findings of facts to support the imposition of requirements greater than the requirements established by or pursuant to the California Building Standards Code, will the following amendment: 903.2 Exception #2 will read, "Group B and M occupancies whenever single or multiple additions will not exceed 1,000 square feet (92.9 m2) beyond the size of the structure on the effective date of this regulation or the total combined floor area will not exceed 5,000 square feet (464.5 m2), and provided a second story or greater is not added, and/or the occupancy is not changed to a more hazardous use." Approve Exhibit A, ranking the top three qualified consultants to prepare an environmental impact report for the Eagle Ranch Specific Plan; and, 2. Authorize the City Manager to negotiate and execute a contract with Michael Brandman & Associates, the number one ranked consultant. If an acceptable contract cannot be reached, the City Manager is authorized to negotiate with the next qualified consultant on the list. Execute a contract with Earth Systems Pacific in the amount of $386,991 for the ACH-01 Deputy Inspection Services for the Historic City Hall Project; and, 2. Execute a contract addendum with Meca Consulting, Inc. (dba Millennium Consulting Associates) in the amount of $75,319 for Phase 3 of Hazardous Materials Abatement Consulting and Monitoring Services for the Historic City Hall Project; and, 3. Execute a contract addendum with Bernards in the amount of $2,876,562 for the remaining Construction Management / Project Management services for the Historic City Hall Project. DISCUSSION: On Saturday, October 15, 2011 , staff is proposing to close EI Camino Real, from Highway 41 to Traffic Way, from 8:00 a.m. until 1 :00 p.m., to conduct the annual Colony Days Parade. The route for this year's Colony Days Parade is proposed to begin and end at Olmeda Avenue. Additional road closures listed on the Draft Resolution (Attachment 1) are required for parade staging and events related to the Parade. The Annual Colony Days Parade is coordinated by the Colony Days Committee and Main Street. "Tent City" and festivities following the parade will be centered in and around the Sunken Gardens. Palma Avenue and East and West Mall are proposed to be closed in order to serve as a staging area for several of the events and vendor booths. FISCAL IMPACT: No net fiscal impact to the General Fund, as the road closure fee covers the staff time and equipment required for traffic control and clean-up related to this event (estimated at $2,600.00). REPORT-IN-BRIEF: Updates are proposed to the General Plan Land Use Element, Land Use Diagram, Zoning Ordinance, and Zoning Map in order to meet the City's Regional Housing Needs Allocation (RHNA) and to comply with Housing Element Policy 1.1, Programs 1 and 2. The updates must be adopted concurrently with the Housing Element adoption in order to receive certification from the State. On January 25, 2011, the City Council approved a General Plan update to modify the High Density Residential (HDR) Land Use Designation from a maximum of sixteen (16) units per acre to a minimum of twenty (20) units per acre. Example: Residential Suburban as the base zone within a Flood Hazard and Geologic Hazard overlay area would show on the official zoning maps as RS (FH) (GH). (c) Density in Residential Multiple Family Zoning District. A number specifying the maximum permitted number of dwelling units per net acre in multiple family residential zoning districts shall be appended to the base zoning district to designate the density on the official zoning maps (Section 9-1.102). Example: Residential Multiple Family allowingits (4 6) twenty.(20) units per net acre within a Historic Site overlay area would show on the official zoning maps as RMF/4-620 (HS). (d) Minimum Lot Size in Residential and Agricultural Zoning District Areas. In addition to the standards specified in Chapter 4 of this title, General Site Design and D.velopment Standards, the following development standards shall apply to mobilehome and multiple family residential projects: (a) Percent Coverage. The maximum percent of a lot that may be covered by *ructures (excluding decks less than thirty (30)inches from the ground) shall be forty percent (40%) for low density multiple family projects and fifty percent (50%) for high density multiple tamily projects. (b) Enclosed Storage. Each dwelling unit shall be provided a minimum of one hundred(100) cubic feet of enclosed storage space, exclusive of closets, which may be located in either a principal or accessory building. (c) Outdoor Recreation Areas. For developments of four(4) to seven (7) dwelling units, outdoor recreational open space shall be provided at a ratio of three hundred (300) square feet per unit. This open space may be provided either as (1) a private amenity designed for lusive use of a dwelling unit, or (2) as common open space provided that no individual open ..pace is less than one thousand (1,000) square feet. For developments of eight (8) or more dwelling units, outdoor recreational open space shall be provided at a ratio of three hundred 300) square feet per unit. This common open space may be provided in more than one location rrovided that no individual open space area is less than one thousand (1,000) square feet. (d) Screening Wall. DISCUSSION: The applicant has applied, through the Department of Alcohol Beverage Control (ABC), for an off-site sale of beer and wine at their existing location (8005 El Camino Real). This retailer currently does not sell wine or beer at this location. Walgreens is a neighborhood drug-store that contains a drive-through pharmacy, photo center and general merchandise for sale. The site is zoned both Commercial Professional (CP) and Commercial Retail (CR) with a General Commercial (GC) General Plan Land Use Designation. The drug-store with drive- through pharmacy was approved in December 2002 as Conditional Use Permit (CUP) 2002- 0069. The sale of beer and wine at this location will be ancillary to its existing use as a pharmacy and general merchandise retailer. The applicant estimates that approximately 24 feet of shelf space and one (1) 10-foot cooler will be utilized for the sale of beer and wine. It is estimated that beer and wine sales will amount to less than five (5) percent of total sales. 6 9 This particular location is a 24-hour operation, however sales will be limited from 6:00 am to 2-:00 am, consistent with State law. In addition, Walgreens product mix will only contain beer in six packs, 12 packs and 18 packs. No single or 40 ounce bottles will be sold. Spirits and malt liquor will also be limited to only those products that contain less than 5.9 percent alcohol by volume (refer to Attachment 2). Analysis: Section 23958.4 of the Alcoholic Beverage Control Act requires the local governing body of the area to determine that the license will serve public convenience or necessity. This process is only required when it is found that "Undue Concentration" of liquor licenses exists within the area. In this case, the Department of Alcoholic Beverage Control (ABC) has determined that there is an undue concentration of liquor licenses within the area and that a determination from the local governing body (City Council) will be required. The proposed site is located in census tract number 0125.03, which allows six (6) ABC licenses within the area without Council review. There are currently nine (9) licenses existing within the census tract, and therefore Council review is required prior to adding any additional licenses to the area. The site is also more than 500 feet from any public school properties. Staff has reviewed the request to determine that approval of this application, or conditional approval, would not negatively influence -the rate of criminal activity in the neighborhood and that it would be compatible with the neighborhood character. The Atascadero Police Department has determined that the impact to public safety would be negligible based on the consideration of the physical location of the current establishment and the number of 'Dast calls for service. This "one-stop" shopping will result in increased efficiency for shoppers, and is consistent with what today's consumers expect from a retail pharmacy and general merchandiser such as Walgreens. It is anticipated that the same customers who currently shop at the Store will continue to shop there, with the added benefit of being able to purchase beer and wine at the Store as opposed to having to travel to another possibly more distant and inconvenient location. The sale of beer and wine at the Store is consistent with adiacent uses. The Walgreens store is located in a zone designated as Commercial Professional (CP). This zoning allows for the sale of beer and wine off-premises. Current adjacent uses include various restaurants, shops and markets. Many of these businesses are licensed to sell alcohol and some, such as 7 Eleven, Albertson's, and Food 4 Less are licensed to sell alcohol off-premises. Therefore, because the Store is adjacent to other businesses where the sale of alcohol is an ancillary use, the sale of beer and wine at the Store is consistent with adjacent uses. V. The issuance of a Tyne-20 license to the Store will not create a burden on the Police Department. Based on information provided by the ABC, there are 6 off-sale liquor licenses allowed and 9 existing in census tract 0125.03. The ABC did not provide crime statistics for this area. However, Walgreens beaieves the addition of beer and wine at the Store will not add to crime or any police-related problems in the surrounding community,given that the product mix is not of a nature that would attract criminal elements. VI. The sale of beer and wine at the Store will not have a detrimental impact on the surrounding area. So as to ensure minimal disruption to surrounding neighborhoods, Walgreens has taken preemptive measures to ensure that alcoholic beverages will be sold in a highly responsible and conscientious manner. Detailed alcohol sales policies and procedures, endorsed by legal counsel and senior management, are already in place and will be strictly enforced. Some of these policies;and procedures are: • Employees must undergo training prior to beer and wine being made available at the Store; • Each cash register clerk must submit a policy acknowledgement as part of the daily log-in and log-out process; • Cash register clerks are required to request identification and proof of age for any customer attempting to purchase beer or wine who appears to be under the age of 40. Implementation of this program will help ensure that the sale of beer and wine at the Store will not be detrimental to residents, shoppers, or other businesses in the vicinity of this Store. To prevent abuses, Walgreens will only sell beer in 6 packs, 12 packs, 18 packs and cases. Walgreens will not sell beer by the individual can or bottle. Moreover, Walgreens will not sell spirits or any other product considered conducive to alcohol abuse. To further limit any possible nuisance in and around the Store, Walgreens has closed circuit security cameras that monitor the alcohol sales area and a public view monitor, which serves to discourage loitering and acts as an additional security measure. For security purposes, the beer and wine will not be located near any exit area, thereby discouraging theft. In addition,the Store's parking lot is well lit. VII. Conclusion. The sale of beer and wine as an ancillary use at the Store will enable Walgreens to provide shoppers in the City of Atascadero the convenience of one-stop shopping that consumers have come to expect from a national pharmacy and general retailer. Walgreens is committed to providing this convenience in a safe and conscientious manner, with minimal disruption to the surrounding neighborhood. DISCUSSION: The Fair Political Practices Commission (FPPC) was created by the Political Reform Act of 1974 (Act), a ballot initiative passed by California voters in 1974 as Proposition 9. To meet its responsibilities under the Act, the FPPC adopts and amends the California Code of Regulations (Regulations). It also develops required forms, prepares manuals and instructions, aids agencies and public officials with record keeping and reporting, and maintains a central file of statements of economic interests (Form 700) for certain state and local officials. There is a Section in the Regulations that addresses gifts received by public officials. The definition of a gift in the Regulations is any payment that confers a personal benefit. There are many times that a public official will receive a ticket for an event, or the City will receive tickets for events. Sometimes the City has sponsored an event, and included in the sponsorship is free tickets. Also, there are times where the City purchases tickets for a local event. Most of these situations involve events during which attendance of public officials would serve a public service. The FPPC has amended the Regulations to address these situations. The new Regulations allow the City to distribute to City officials tickets or passes given to the City, without the ticket or pass being counted as income to the official, as long as there is an official policy adopted by the City Council and the policy is posted on the City's website. The City must also post an FPPC Form 802 on the City website within 30 days of the distribution. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Atascadero, California, does hereby adopt this Resolution establishing a Ticket Distribution Policy. This Resolution shall take effect and be in force on the date of its adoption. The City of Atascadero hereby finds, determines and declares as follows: A. Purpose of Policy: The purpose of this Policy is to ensure that all tickets or passes (Tickets) provided to the City shall be distributed in furtherance of governmental and/or public purposes, in accordance with the California Fair Political Practices Committee (FPPC) Regulation 18944.1. No Right to Tickets. The use of complimentary Tickets is a privilege extended by the City and not the right of any person to which the privilege may from time to time be extended. 3. Limitations. a. This Policy shall only apply to the City's distribution of Tickets to a Designated Official. A Designated Official is any officer or employee who is designated in a Conflict of Interest Code because their position entails the making or participation in the making of decisions which may foreseeably have a material effect on any financial interest within the City. Designated Officials also are required to file FPPC Form 700's annually. b. Tickets provided as part of an Official's duties, or tickets provided so that the Official may perform a ceremonial role or function on behalf of the City, shall not be subject to this Policy. c. No Official who receives a Ticket pursuant to this Policy shall sell or receive reimbursement for the value of the Ticket. d.. No Official receiving a Ticket pursuant to this Policy shall transfer the Ticket to any other person, except to members of the Official's immediate family solely for their personal use. No Ticket provided to the City by an outside source, and distributed to a City Official pursuant to this Policy, shall be earmarked by the original source for provision to a particular City Official. implementation of Policy. The following list of governmental and/or public purposes the City may accomplish through the distribution of Tickets is illustrative rather than exhaustive: i. Facilitating the performance of a ceremonial role or function by a City Official on behalf of the City at an event. ii. Facilitating the attendance of a City Official at an event where the job duties of the City Official require his or her attendance at the event. iii. Promotion of intergovernmental relations and/or cooperation and coordination of resources with other governmental agencies, including but not limited to, attendance at an event with or by elected or appointed public officials from other jurisdictions, their staff members and their guests. iv. Promotion of City resources and/or facilities available to Atascadero residents. v. Promotion of City sponsored or supported community programs or events. vi. Promoting, supporting and/or showing appreciation for programs or services rendered by charitable and non-profit organizations benefitting Atascadero residents. vii. Economic, employment and business development on behalf of the City and businesses within the City, including conventions and conferences. viii. Promotion of business activity, development, and/or redevelopment within the. City. ix. Information gathering and education regarding matters of local, regional and statewide concerns that affect the City, including enhancing intergovernmental relations through attendance at events with or by elected and appointed officials from other jurisdictions. x. Promotion of City-owned businesses. xi. Promotion of tourism within the City and the surrounding region. xii. Promotion of City recognition, visibility, and/or profile on a local, state, national or worldwide scale. xiii. Promotion of open government by City official appearances, participation and/or availability at business and/or community events. xiv. Promotion of special events in accordance with any City contract, including those contracts where the City as a form of consideration has required that a certain number of Tickets be made available for City use. xv. Attracting or rewarding volunteer public service. xvii. Encouraging or rewarding significant academic, athletic, or public service achievements by Atascadero students, residents or businesses. xviii. Attracting and retaining highly qualified employees in the City service. xix. Recognizing or rewarding meritorious service by a City employee. xx.
