Executive Director Wade McKinney gave the staff report and answered questions of the
Board.
Board Member Luna commented on the meeting he had attended with Chairperson
O'Malley and spoke in support of the staff recommendation.

Staff Report - Executive Director
Facade Improvement Rebate Program
RECOMMENDATION:
Agency Board approve the Facade Improvement Rebate Program, related Participant
Agreement, and authorize the implementation thereof with initial funding of the program
in the amount of $50,000.00.
DISCUSSION:
Background: The Fagade Improvement Rebate Program is intended to assist property
and/or business owners improve the appearance of commercial buildings located in the
Community Redevelopment Project Area through the use of rebates for costs
associated with improvements to building exteriors. Tenants are required to provide
written concurrence from the owner(s) of the property to participate in the program.
In order to implement this program, funds may, from time to time, be set aside in the
Redevelopment Agency's annual budget to provide rebates to qualified and eligible
applicants who upgrade the exterior of their buildings.
Each participating property will be eligible to receive a maximum rebate of ten thousand
($10,000) dollars, and the Agency will provide the services of an Architect to each
applicant to assist in project development. Architect consulting fees will be paid by the
Agency apart from the rebate.
With the possible exception of projects of $1,000 or less, the Fagade Improvement
Program falls under California Redevelopment law set forth in Health and Safety Code
Section 33423 et seq., and California Labor Code Section 1720, which requires the
payment of prevailing wages on private projects receiving public assistance.
Accordingly, all Redevelopment Agency projects or assisted projects will require the
payment of prevailing wages for each craft or type of workman needed throughout
construction. Staff will provide assistance in complying with these requirements.

Improvement projects must enhance the appearance of the street elevation or additional
primary access points to the building such as an alley or parking lot. Attractive new
colors, appropriate design, shadow relief, consistent signage and landscaping will be
evaluated. Existing architectural features on the subject building and on the
surrounding structures will be considered. The design standards or proposed
improvement must comply with any design standards or guidelines adopted by the City
of Atascadero and/or the Community Redevelopment Agency.
A typical project may consist of exterior painting, decorative fagade treatment, signs,
canopies, awnings, decorative exterior lighting, minor landscaping and streetscaping. A
project may also include repair or replacement of entryways, exterior doors and
windows, decorative fascia structures, correction of building, health, nonconforming
signage, or zoning code violations, and removal of deteriorated signs and extraneous
structures related to the building fagade.
Agency and Community Development Department staff will review applications for the
eligible structures and evaluate projects based on design, community impact, and
budget. Applicants must make an application for assistance prior to the start of the
renovation, and work with the Architect and staff to produce program compliant projects.
The Fagade Improvement Rebate Program may not be used for any interior
improvements such as carpeting, drapery, blinds, interior signage, or other related interior
improvements; purchase of inventory; fixtures or furnishings related to the merchandising
or operations of the building; purchase of business equipment or displays; security bars
and roofing; mechanical equipment; exterior improvements not approved by the
Agency; buildings in which existing businesses operating without a valid City of
Atascadero Business License; and any building housing an adult related business as
defined in the City of Atascadero Municipal Code.
While priority will initially be placed on projects with the most visual impact and benefit
to the community located in the core area as defined in the Atascadero Downtown
Revitalization Plan, the program is available throughout the entire Community
Redevelopment Project Area.
Conclusion: The Fagade Improvement Rebate Program represents a pro -active
approach by the Agency toward achieving some of the goals, objectives and priorities
reflected within the Redevelopment Plan, and the Atascadero Downtown Revitalization
Plan. Staff recommends approval of the program and related documents as presented,
and that the Agency Board authorize funding as requested.
FISCAL IMPACT:
Initial funding in the amount of $50,000.00 from the Public Improvements account for
program rebates, consultant and related costs.

FACADE IMPROVEMENT REBATE PROGRAM
OBJECTIVES
The Fagade Improvement Rebate Program is intended to improve the appearance of
commercial buildings located in the Community Redevelopment Project Area through the
use of rebates for costs associated with improvements to building exteriors.
II
ELIGIBLE AREA AND BUSINESS
Commercial structures located within the boundaries of the Community Redevelopment
Project Area. However, initial emphasis will be on the downtown area (see section VII).
Property owners or tenants of commercial buildings are eligible to apply. However,
tenants are required to provide written concurrence from the owner(s) of the property to
participate in the program.
III
IMPLEMENTATION
In order to implement this program, funds may, from time to time, be set aside in the
Community Redevelopment Agency's annual budget to provide rebates to qualified and
eligible applicants who upgrade the exterior of their buildings.
IV
REBATE LEVELS
Each participating property will be eligible for a rebate of up to $10,000, subject to prior
approval and verification of the sums paid by Applicant on the project.
V
PUBLIC WORKS PROJECT
HEALTH AND SAFETY CODE SECTIONS 33423 et seq.
The Fagade Improvement Program falls under California Redevelopment law set forth in
Health and Safety Code Section 33423 et seq., and California Labor Code Section 1720,
which requires the payment of prevailing wages on private projects receiving public
assistance. Accordingly, all Redevelopment Agency projects or assisted projects will
require the payment of prevailing wages for each craft or type of workman needed
throughout construction. City staff will provide assistance in complying with these
requirements. Please see "Prevailing Wage Packet" attached.

PROGRAM COMMITTEE
The Program Committee shall be comprised of City staff from the Community
Redevelopment Agency, the Community Development Department, and the consultant
architect.
Unless otherwise designated by the Agency, the Agency shall sit and issue all approvals
related to the Fagade Improvement Program description, and the Agreement for Fagade
Improvement Rebate. The Agency must approve all Agreements prior to the
commencement of work.
VII
DESIGN
Applicants must make application for assistance prior to the start of the renovation, and
meet with an architect, under contract with the Agency, to assist applicant(s) in the
preparation of preliminary concept plans and drawings taking into account design
guidelines, building codes and zoning ordinances.

PROGRAM EMPHASIS
Priority will be placed on projects with the most visual impact and benefit to the
community located in the core area as defined in the Atascadero Downtown
Revitalization Plan shown below:

GUIDELINES
1. All projects shall comply with current City codes and ordinances. Applicant shall
obtain building permits when required by law.
2. Participants shall pay for all agreed upon improvements by cashiers check or personal
check with appropriate documentation. The participant must submit copies of
cancelled personal checks or receipts along with supporting documentation
evidencing completion of work for which the rebate has been approved.
3. Applicants must complete all agreed upon work with 90 days of the date of approval.
If it is determined that the time limit is unreasonable, an extension can be granted by
the Agency to remain eligible for the rebate.

4. Before, during and after the improvement are made, the Agency shall have the right
to inspect all exterior work. The project is not qualified for a rebate until all
improvements have been completed to the satisfaction of the Agency.
5. A licensed contractor, the owner of the building, or his/her tenant, shall perform the
work if they are qualified to perform the work.
6. In the event Applicant undertakes to do the work herself/himself, the
reimbursement will be limited to the actual cost of equipment and materials. Truly
volunteer assistance is permissible provided the approved project rebate is $1,000 or
less; however, if the rebate is $1,000 or more and Applicant employs temporary
help, utilizes existing employees, utilizes volunteers or engages in barter to do the
work, payment of prevailing wages will be required.

ELIGIBLE IMPROVEMENTS
The following improvements will be eligible under the Facade Improvement Program.
1. Exterior painting, decorative facade treatment, signs, fascia, canopies and awnings.
2. Correction of building, health, nonconforming signage, or zoning code violations as it
applies to the proposed improvement of the facade only.
3. Installation of decorative exterior lighting.
4. Minor landscaping and streetscaping directly relating to the buildings positive image
5. Improvements to the exterior -facing alley
6. Other improvements authorized by the Commission.
7. Restoration of historic building facades.
Repair or replacement of entryways, exterior doors and windows, and decorative fascia
structures
9. Removal of all deteriorated signs and extraneous structures as part of an overall
improvement concept plan for the building facade.
XI
EXCLUSIONS
1. Project related costs and improvements started prior to approval, except for design
work necessary to make the application. Pre -project design work is eligible only for a
project subsequently approved.

2. Anything not visible from the exterior of the building along the main street or other
primary access point such as alleys or parking lots.
3. Any interior improvements such as carpeting, drapery, blinds, interior signage, or other
related interior improvements.
4. Purchase of inventory.
5. Fixtures or furnishings related to the merchandising or operations of the building.
6. Purchase of business equipment or displays.
7. Other actions not directly listed on the above eligibility list.
8. Security bars, roofing, and mechanical equipment.
9. Exterior improvements not approved by the Agency.
10. Buildings in which existing businesses operating without a valid City of Atascadero
Business License.
11. Any building housing an adult related business as defined in the City of Atascadero
Municipal Code.
XII
PROCESS
I. Submit Application:
Applicant completes and signs application form including description of the desired
rehabilitation work.
**In the case of a lessee, approval of the property owner is required.
2. Consultation with Architect:
Applicant contacts the Redevelopment office to arrange a meeting with staff and the
architect to discuss desired improvements to the building.
3. Preliminary Plan Review:
The architect will submit a conceptual rendering, detailed description of work and
preliminary cost estimate to the Redevelopment staff and applicant for review by the
Program Committee.
4. Site Review of Property:
Depending upon the scope of the proposed work, an on-site review of the proposed
exterior improvements by the owner and/or lessee, City staff, a building inspector,
and the architect may be desirable to facilitate the proper progression of the design
and project review process.

If the building to be improved is listed as having historical significance, the project
will also be reviewed by the Community Development Department.
5. Final Approval of Plans:
Following departmental input, the Community Redevelopment Agency and
Community Development Department, in conjunction with the architect, will review
the proposed facade improvements to determine whether to approve rebate
incentives and/or provide further program -paid architectural services (working
drawings).
6. Bidding Procedures:
Applicants are required to get at least two bids for proposed improvements in excess
of $1,000. A contractor selected by the applicant must be licensed and insured in
accordance with City requirements. It should be noted that the low bidder need not
be selected, however, a justification for accepting an alternative bid should be
provided to the Agency. The selected contractor must also provide proof that
prevailing wage is paid to individuals working on the project.
7. Pre -Construction Meeting/Notice to Proceed:
A meeting between City staff, property owner and/or lessee, architect, building
inspector and contractor may be necessary prior to the start of construction to discuss
the scope of work and clarify any issues. A project may not proceed until the
Agreement is approved by the Agency. Authorization to proceed is included in the
Agreement.
S. Award of Contract(s):
Community Redevelopment staff shall be notified of all contracts awarded for
services connected with the approved facade improvements. Copies of contracts and
proof of required insurance will be provided by Applicant to Community
Redevelopment Staff. Receipts for all improvements for which financial assistance
is requested shall be provided and verified by staff prior to the payment of any grant
funds.
9. Timeline:
The applicant has 10 days from the date the project is approved by the Community
Development Commission to apply for Building Permits.
Construction shall commence within 10 days of issuance of building permits by
the Building Department.
If no building permits are required, the applicant has 20 days from the date the
project is approved by the Community Redevelopment Agency to begin
improvements.
Exterior building improvements must be completed within 90 days of issuance of
building permits.
The Community Redevelopment Agency representative may consider a 30 -day
extension, if the applicant can demonstrate that any delay was due to factors beyond
his control (such as weather, etc.). The Executive Director must approve extensions
beyond 30 days.

10. Compensation:
The Agency will reimburse the applicant for the appropriate amount of funds upon
completion of the project, and when all receipts have been received.
11. Alterations and Maintenance of Improvements:
The facade and signage as designed, approved, and constructed, cannot be altered
for five (5) years without Agency review and approval. The improvements funded
in part by the Community Redevelopment Agency must be maintained in good
condition for a period of five years following project completion.
XIII
DISPLAY OF PROGRAM SIGN
If requested by the Agency, the applicant shall display a sign indicating participation in
the program. This sign shall be located on the front of the building for a minimum period
of thirty (30) days. This sign will be provided by the Agency.
XIV
APPLICATION
Prior to the start of construction, the applicant must submit the following:
1. A completed and sign application form.
2. Plans for the proposed building improvements including sign and awning designs or
architectural plans in sufficient detail to identify the nature and quality of the
improvements.
3. A breakdown of proposed project costs. The submittal of more than one bid is
encouraged and the Agency reserves the right to require additional bids in its sole
discretion.
4. Name of licensed contractor at the time the project is approved, if applicable.

Prevailing Wages
Frequently Asked Questions
What are prevailing wages?
■ Prevailing wages are the minimum hourly rates, predetermined by Federal or
State government that must be paid to construction workers on public works
proj ects.
Public works projects are defined as construction, alteration, demolition or
repair work done under contract and paid for in whole or in part out of public
funds.
• Prevailing wages also stipulate fringe benefit amounts for health insurance,
pension, vacation and holiday time off.
How are prevailing wage rates determined?
• Individual rates are determined for various crafts and trades (e.g., operating
engineers, carpenters, cement mason, laborers, ironworkers, pipe fitters, etc
for different experience levels, tasks and types of projects.
■ Rates are usually, but not always, based on local (San Luis Obispo County)
collective bargaining agreements.
■ Federally funded jobs require prevailing wage rates on contracts more than
$2,000; state -funded jobs require prevailing wage rates on contracts more than
$1,000.
• When City of Atascadero projects are funded with a combination of federal and
state funds, the higher wage rate must be paid.
■ If a wage rate increases during the course of a project, depending upon the
collective bargaining agreement, the rate of pay may need to be adjusted.

What are the requirements for prevailing wages?
As awarding agency, the City of Atascadero must ensure contractors working
on federal or state funded construction projects comply with prevailing wage
laws, regulations and codes.
The City requests submission of certifies payroll records on CalTrans form
HC -347; or state Department of Industry Relations Public Works Payroll
Reporting form A-1-131.
Where can I find prevailing wage rate information?
■ The easiest and most up to date information can be obtained by accessing the
State of California Department of Industrial relations web site at
http://www.dir.ca.gov/DLSR/PWD/slo.xls for basic trades and
http://Nvww.dir.ca.�ov/DLSR/PWD/index.htm for sub -trades.
■ Rates may be reviewed at the Public Works Department, City Hall Annex, 6905
El Camino Real, Suite 6.
• Federal rates are listed at http://www.access.gpo gov/davisbacon/ca html
■ California state laws and regulations covering prevailing wages are set forth in
the California Labor Code, Division 2, Part 7, and California Code of
Regulations, Title 8.
■ Rates are regional; therefore local firms must refer to rates for San Luis Obispo
County and California.
What if I am an owner -builder?
■ You must indicate on the Payroll Form that all work was done by the owner -
builder — provide name, SS# and type of work — and certify to that fact on
Certification Form.

This predetermined increase for the above named craft applies only to the current determination for
work being performed on public works projects with bid advertisement dates on or after September
1, 2003, until this determination is superseded by a new determination or a predetermined increase
modification notice becomes effective.
When referencing our prevailing wage determinations, please note that if the prevailing wage rate
determination which was in effect on the bid advertisement date of a project has a single asterisk (*)
after the expiration date, the rate will be good for the life of the project. However, if a prevailing
wage rate determination has double asterisks (**) after the expiration date, the rate must be updated
on the following date to reflect the predetermined rate change(s).
LABORER
Determination SC -23-102-2-2003-2 is currently in effect and expires on June 30, 2004**
Effective July 1, 2004, there will be a $0.71 allocation to wages and/or fringe benefits and an
increase of $0.64 to Pension.
Effective July 1, 2005, there will be a $1.00 allocation to wages and/or fringe benefits and an
increase of $0.40 to Pension.
There will be no further increases applicable to this determination.

Operators on hoists with three drums shall receive fifteen cents (15¢) per hour additional pay to the regular rate of pay. The additional pay shall be added to the regular rate and become the base
rate for the entire shift.
All heavy duty repairman and heavy duty combination shall receive twenty- five cents (25¢) per hour tool allowance in addition to their regular rate of pay and this shall become their base rate of
pay.
Employees required to suit up and work in a hazardous material environment, shall receive Two Dollars (52.00) per hour in addition to their regular rate of pay, and that rate shall become the basic
hourly rate of pay.
