HomeMy WebLinkAboutResolution 2005-080 RESOLUTION NO. 2005-080 'rr RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATASCADERO, CALIFORNIA, CERTIFYING PROPOSED NEGATIVE DECLARATION 2004-0043 PREPARED FOR ZONE CHANGE 2005-0100 (Citywide/City of Atascadero) WHEREAS, an application has been received from the City of Atascadero (6905 El Camino Real, Suite 6), to consider Zone Change Text Amendments to establish development standards for fence height, lot line adjustments affecting flag lots, and landscape requirements; and, WHEREAS, an Initial Study and Proposed Negative Declaration 2004-0043 were prepared for the project and made available for public review in accordance with the requirements of the California Environmental Quality Act (CEQA); and, WHEREAS, the Planning Commission of the City of Atascadero held a public hearing on July 19, 2005 following the close of the review period to consider the Initial Study and Proposed Negative Declaration; and, WHEREAS, the Planning Commission has determined that the project will have no �✓ significant impacts; and, WHEREAS, the City Council of the City of Atascadero held a public hearing on September 13, 2005, following the close of the review period, to consider the Initial Study and Proposed Negative Declaration; and, NOW THEREFORE, the City Council of the City of Atascadero, hereby resolves to certify Proposed Negative Declaration 2005-0043 based on the following Findings, and as shown in Exhibit A: 1. The Proposed Negative Declaration has been completed in compliance with CEQA; and, 2. The Proposed Negative Declaration was presented to the Planning Commission, and the information contained therein was considered by the Planning Commission, prior to recommending action on the project for which it was prepared; and, 3. The project does not have the potential to degrade the environment; and, 4. The project will not achieve short-term to the disadvantage of long-term environmental goals; and, 5. The project does not have impacts which are individually limited, but cumulatively 'rr+ considerable; and, City of Atascadero Resolution No.2005-080 Page 2 of 3 �r 6. The amendments include the following:define a minimum landscaping area applied to Residential Multi-Family and Commercial zoning designations(AMC 9-4.125);incorporate existing portions of Title I 1 Subdivisions,Chapter 6 Flag Lots(deep lot subdivisions)into Title 9- Li 18 and Title 9-4 for Lot Line Adjustments;and update fencing and screening standards(t%MC 9- 4.128). Findings: 1. The project does not have the potential to degrade the environment. 2. The project will not achieve short-term to the disadvantage of long-term environmental goals. 3. The project does not have impacts which are individually limited,but cumulatively considerable. 4. The project will not cause substantial adverse effects on human beings either directly or indirectly. Determination: Based on the above findings,and the information contained in the initial study 2005-0043-(made a part hereof by reference and on file in the Community Development Department),it has been determined that the above project will not have an adverse impact on the environment.
