HomeMy WebLinkAboutResolution 066-86 R-la Y w CITY OF ATASCADERO IMPROVEMENT DISTRICT NO 4 RESOLUTION NO 66-86 RESOLUTION DETERMINING THAT THE CONSTRUCTION OF SANITARY SEWER IMPROVEMENTS IS NECESSARY AS A HEALTH MEASURE WHEREAS, the District Health Officer has recommended in writing that the construction of the public improvements as therein described for the proposed City of Atascadero Improvement District No 4 (Separado-Cayucas Assessment District) is a necessary health measure for the City of Atascadero, a copy of which recommendation is attached hereto and made a part hereof, labeled Exhibit A; and WHEREAS, said recommendation was in writing, and has been ordered spread upon the minutes of the regular meeting of this City Council held on July 14, 1986, NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of the City of Atascadero, as follows All of the foregoing recitals are true and correct, and this City Council so finds and determines It is hereby found and determined by this City Council that the necessity for the construction of the public improvements for the proposed City of Atascadero Improvement District No 4 (Separado-Cayucas Assessment District) , as recommended by the District Health Officer does exist, and T this City Council so finds and determines and concurs in such vrrf' conclusion of necessity and in such recommendation This City Council hereby declares that the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not be applicable to the proceedings hereinafter to be taken for the construction of said sanitary sewer improvements because the same are necessary as a health measure for the City of Atascadero This finding and determination herein made shall be final and conclusive upon all persons PASSED AND ADOPTED this 14th day of July, 1986, by the following vote (On Motion by Councilman Handshy, seconded by Councilwoman Borgeson) AYES COUNCILMEMBERS BORGESON, HANDSITY, MOLINA AND MAYOR MACKEY NOES NONE ABSENT COUNCILWOMAN NORRIS ATTEST � l r, 0YD C, SHARITZ, City Curr MARJOR�t R MACKEY, Mayor APPROVED AS TO FORM APPROVED AS TO CONTENT ROBERT M JONq, City Attorney R BEk J0Nz-2§i<ity Attorney EXHIBIT "A" COUNTY OF SAN LUIS OBISPO HEALTH AGENCY Department of Public Health ~` 2191 Johnson Avenue - P O.Box 1489 San Luis Obispo,California 93406 (805)549-5500 � � Reply to Division of Environmental Health 549-5544 July 8, 1986 The Honorable City Council City of Atascadero 6500 Palma Avenue Atascadero, CA 93423 Re Need for Sanitary Sewer Improvements for the Proposed City of Atascadero Improvement District No 4 (Separado/Cayucos Project) I have had occasion to carefully consider the sewage need of the area of the proposed City of Atascadero Improvement District No 4 (Separado/Cayucos Project) , NOW as such area is delineated on the map attached here to and incorporated herein as Exhibit A, and based upon the foregoing, it is my considered opinion and recom- mendation that construction of sanitary sewer improvements comprising (a gravity sewer interceptor system and sewage collection system throughout said area) substantially as described in the description of work prepared by John L Wallace and Associates dated July 3, 1986 is a necessary health measure for the City of Atascadero as referenced by the City of Atascadero on-site sewage disposal system survey of 1981 and the Central Coast Regional Water Quality Control Board Cease and Desist Order No 81-60 Sincerely, G M D City of Atascadero, Health Officer GBR ks Attachment
