HomeMy WebLinkAbout2006-081 RESOLUTION NO 2006-081 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATASCADERO, CALIFORNIA, ESTABLISHING A SCHEDULE OF DEVELOPMENT IMPACT FEES WHEREAS, the City of Atascadero has conducted an extensive and exhaustive analysis of its services, the costs reasonable borne of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services, and an extensive and exhaustive analysis of the current facilities, infrastructure, recreation, and the requirements that will have to be met to ensure that present ability and standards of service are not reduced by the costs of new residential and non-residential development; and WHEREAS, the City wishes to comply with both the letter and the spirit of Article XIIIB of the California Constitution and limit the growth of taxes, and WHEREAS, in order to protect the health, safety, and welfare of the community and to ensure that adequate capital facilities are provided for the residents of the City and so that new development in the City pays its fair share of the cost of providing these facilities, the levy of development impact fees is necessary; and WHEREAS, heretofore the City Council has adopted an Ordinance establishing its policy as to the recovery of costs of such impacts and directing staff as to the methodology for implementing said Ordinance, and WHEREAS, pursuant to Government Code Section 66017 the specific fees to be charged for development impacts must be adopted by the City Council by ordinance or resolution, after providing notice and holding a public hearing; and WHEREAS, Revenue & Cost Specialists, LLC, has prepared and presented to the City Council a Nexus Update, the "Master Facilities Plan and Develoment Impact Fee Calculation and Nexus Update Report for the City of Atascadero, California," dated February, 2006 (the "Nexus Update"), incorporated herein by this reference, which details the relationship between the use of the proposed fees to be levied within the City and the types of development on which the fees are imposed, the relationship between the need for the public facilities and the type of development on which the fees are imposed, and the relationship between the amount of the fees and cost of the public facilities, and WHEREAS, the City Council finds that the fee schedule detailed in Exhibit A attached hereto and the planned improvements detailed in the Nexus Update are consistent with the City of Atascadero General Plan, and WHEREAS, pursuant to Government Code section 66017, the data required to be made available to the public prior to increasing the amount of the development fees by this resolution was made available for public review at least 10 days prior to the date of this meeting; and WHEREAS, pursuant to Government Code sections 66014, 66018 and 6062a, notice of a public hearing on the increase to the amount of development fees was published in the City of Atascadero Resolution No.2006-081 Page 2 of 5 Atascadero News twice, with at least five days intervening the two publications, commencing at least ten days prior to the date of this meeting; and WHEREAS, a duly noticed public hearing before the City Council on the increased amount of the development impact fees was held on August 8, 2006, at which hearing public testimony was received and duly considered, and WHEREAS, the City Council has previously adopted Resolution No 2003-023 setting forth such fees, and desire to amend and restate that resolution in this one resolution to have all development impact fees contained in dust one resolution, without rescinding said adoption, and WHEREAS, the City Council desires to encourage commercial retail development in the Atascadero downtown area, and WHEREAS, the City Council finds that delaying the effective date of the amended fees will encourage the revitalization, commercial retail, and public welfare of the downtown area of Atascadero, and the City of Atascadero, and WHEREAS, the increase to the amount of the development fees is not a "project" subject to the California Environmental Quality Act because it is a funding mechanism having no physical effect on the environment. NOW,THEREFORE,BE IT RESOLVED,by the City Council of the City of Atascadero SECTION 1 Approval of Findings in Nexus Update. After considering the information and determinations contained in the Nexus Update and the testimony received at the public hearing, the City Council hereby approves and expressly adopted the findings, determinations, and conclusions contained in the Nexus Update. SECTION 2. Fee Schedule Adoption. The following schedule of development impact fees and charges are hereby directed to be computed by and applied by the various City departments, and to be collected by the City Community Development Department. This resolution shall be interpreted as restating in their entirety Resolution No 2003-023 such that only this resolution shall govern all development impact fees in the City of Atascadero SECTION 3. Listing of Fees The following fees shall be charged and collected for the following impacts of development See Exhibit A— from October 1, 2006 to June 30, 2007 See Exhibit B — from July 1, 2007 until revised by resolution of the City Council SECTION 4 Effective Date of Increased Fees Pursuant to Government Code section 66017(a), and as authorized by this Resolution, the amended fees set forth in Exhibit A, shall take effect on October 8, 2006 (which date is not sooner than 60 days after the adoption of this Resolution) On July 1, 2007, the amended fees as specified in Exhibit A shall be repealed and City of Atascadero Resolution No.2006-081 Page 3 of 5 void, and the amended fees as specified in Exhibit B shall take effect and shall remain in effect, until revised by resolution of the City Council SECTION 5. Constitutionality If any portion of this Resolution is declared invalid or unconstitutional then it is the intention of the City Council to have passed the entire Resolution and all its component parts, and all other sections of this Resolution shall remain in full force and effect. SECTION 6. Repealer All resolutions and other actions of the City Council in conflict with the contents of this Resolution are hereby repealed.
