CONSENT CALENDAR (All items on the consent calendar are considered to be routine and non-controversial by City staff and will be approved by one motion if no member of the Council or public wishes to comment or ask questions If comment or discussion is desired by anyone, the item will be removed from the consent calendar and will be considered in the listed sequence with an opportunity for any member of the public to address the Council concerning the item before action is taken DRAFT MINUTES Council meeting draft minutes are listed on the Consent Calendar for approval of the minutes Should anyone wish to request an amendment to draft minutes, the item will be removed from 1 the Consent Calendar and their suggestion will be considered by the City Council If anyone desires to express their opinion concerning issues included in draft minutes, they should share their opinion during the Community Forum portion of the meeting ) 1 December 2009 Investment Report • Fiscal Impact: None ■ Recommendation. Council approve the City Treasurer's report for December 2009 [Administrative Services] 2. December 2009 Accounts Payable and Payroll ■ Fiscal Impact: Total expenditures for all funds is $2,572,636.28 ■ Recommendation. Council approve certified City accounts payable, payroll and payroll vendor checks for December 2009 [Administrative Services] UPDATES FROM THE CITY MANAGER (The City Manager will give an oral report on any current issues of concern to the City Council ) COMMUNITY FORUM (This portion of the meeting is reserved for persons wanting to address the Council on any matter not on this agenda and over which the Council has jurisdiction Speakers are limited to three minutes Please state your name for the record before making your presentation The Council may take action to direct the staff to place a matter of business on a future agenda. A maximum of 30 minutes will be allowed for Community Forum, unless changed by the Council ) B PUBLIC HEARINGS None. C MANAGEMENT REPORTS 1 Storm Water Management Plan (SWMP) - Citizen Advisory Committee ■ Fiscal Impact: Minimal fiscal impact of additional staff time to support Committee work. ■ Recommendation. Each Council Member appoint one community member to serve on the Storm Water Advisory Committee [Public Works] 2. Proposed Resolution of Support of the Local Taxpayer, Public Safety, and Transportation Protection Act of 2010 ■ Fiscal Impact: There is no fiscal impact from the adoption of this Resolution If the Ballot Measure is successful, it will have a positive impact on the City's budget by preventing further takings or borrowings by the State ■ Recommendation. Council adopt the Draft Resolution in support of the Local Taxpayer, Public Safety, and Transportation Protection Act of 2010 [City Manager] 2 3. Water Efficient Landscape Ordinance - Title 8 Building Code Text Amendment (City of Atascadero) ■ Fiscal Impact: Staff time for review of landscape plans and Landscape Documentation Packages, and to verify landscape installation can be absorbed with existing staff for now ■ Recommendation. Council introduce for first reading, by title only, draft Ordinance A approving an amendment to Title 8, the Building Code, of the Atascadero Municipal Code, to establish a Water Efficient Landscape and Irrigation Ordinance as required by the State of California. [Community Development] 4. County Animal Services Contract Extension for FY 2009 - 2010 ■ Fiscal Impact: The cost for the one-year contract extension for FY 2009-10 ($199,440 00) is included in the Police Department's 2009-10 Budget. ■ Recommendation. Copies of the staff reports or other documentation relating to each item of business referred to on the Agenda are on file in the office of the City Clerk and are available for public inspection during City Hall business hours at the Front Counter of City Hall, 6907 EI Camino Real, Atascadero, and on our website, www.atascadero.org An agenda packet is also available for public review at the Atascadero Library, 6850 Morro Road. Californians to Protect Local Taxpayers and Vital Services is a coalition of local governments, transportation advocates, business, labor, public safety and others that is working to place the Local Taxpayers, Public Safety and Transportation Protection Act on the November 2010 ballot. The Act would stop the State from borrowing or raiding funding that voters have dedicated for local public safety, transportation, transit and essential local government services In order to qualify the measure for the November ballot, the Coalition will need to gather 1 1 million California voter signatures in order to ensure that it achieves the required 694,354 valid signatures that are needed The League of California Cities is requesting the support of its member cities in achieving the Coalition's goal to get this initiative on the November ballot. 34 While local governments and their employees are generally prohibited from expending public funds in support or opposition to a ballot measure, local legislative bodies are ; permitted to go on record at public meetings in favor of or opposed to a particular measure Specifically, the measure would • Prohibit the State from taking, borrowing or redirecting local taxpayer funds dedicated to public safety, emergency response and other vital local government services. The measure would close loopholes to prevent the taking of funds currently dedicated to cities, counties, special districts and redevelopment agencies It would also end the State's fiscally irresponsible practice of borrowing local government property tax funds • Protect vital, dedicated transportation and public transit funds from State raids. The measure would prevent State borrowing, taking or redirecting of the state sales tax on gasoline (Prop 42 funds) and Highway User Tax on gasoline (HUTA) funds that voters have dedicated to transportation maintenance and improvements It would also prevent the State from redirecting or taking public transit funds • Protect local taxpayers by keeping more of our local tax dollars local where there's more accountability to voters, and by ensuring once and for all that our gas taxes go to fund road improvements. The measure also reduces pressure for local tax and fee increases that become necessary when `■r the State redirects local funds. We need to pass this measure to protect these vital local services from State raids and borrowing FISCAL IMPACT There is no fiscal impact from the adoption of this Resolution If the Ballot Measure is successful, it will have a positive impact on the City's budget by preventing further takings or borrowings by the State ALTERNATIVES Council may decide to not adopt the Draft Resolution ATTACHMENT Draft Resolution 35 DRAFT RESOLUTION RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATASCADERO, CALIFORNIA, IN SUPPORT OF THE LOCAL TAXPAYER, PUBLIC SAFETY, AND TRANSPORTATION PROTTECTION ACT OF 2010 WHEREAS, California voters have repeatedly and overwhelmingly passed separate ballot measures to stop State raids of local government funds, and to dedicate the taxes on gasoline to fund transportation improvement projects, and, WHEREAS, these local government funds are critical to provide the police and fire, emergency response,parks, libraries, and other vital local services that residents rely upon every day, and gas tax funds are vital to maintain and improve local streets and roads, to make road safety improvements, relieve traffic congestion, and provide mass transit, and, WHEREAS, despite the fact that voters have repeatedly passed measures to prevent the State from taking these revenues dedicated to funding local government services and transportation improvement projects, the State Legislature has seized and borrowed billions of dollars in local government and transportation funds in the past few years, and, WHEREAS,this year's borrowing and raids of local government, redevelopment and ' transit funds, as well as previous, ongoing raids of local government and transportation funds, have lead to severe consequences, such as layoffs of police, fire and paramedic first responders, fire station closures, stalled economic development, healthcare cutbacks, delays in road safety improvements, public transit fare increases and cutbacks in public transit services, and, WHEREAS, State politicians in Sacramento have continued to ignore the will of the voters, and current law provides no penalties when state politicians take or borrow these dedicated funds, and, WHEREAS, a coalition of local government, transportation and transit advocates recently filed a constitutional amendment with the California Attorney General, called the Local Taxpayer, Public Safety, and Transportation Protection Act of 2010, for potential placement on California's November 2010 statewide ballot; and, WHEREAS, approval of this ballot initiative would close loopholes and change the Constitution to further prevent State politicians in Sacramento from seizing, diverting, shifting, borrowing, transferring, suspending or otherwise taking or interfering with tax revenues dedicated to funding local government services, including redevelopment, or dedicated to transportation improvement projects and mass transit. In order to address the specific needs of the local community, the City of Atascadero is proposing its own Water Efficient Landscape and Irrigation Ordinance Efforts have been made to ensure that the City of Atascadero's ordinance is at least as effective at achieving water savings as the Model Ordinance, while reducing the City's administrative costs and property owners costs in relation to the State's requirements City staff has coordinated with both the City of Paso Robles and the Atascadero Mutual Water Company on the development of the ordinance The approach of the ordinance is very similar to Paso Robles' and should help to simplify the process for landscape professionals working in the North County The State's Model Ordinance requires considerable technology-based irrigation infrastructure and processes for virtually any new or retrofitted landscaped area, including any new single-family home with greater than 2,500 sq ft. of landscaping The requirements include ■ A Maximum Annual Water Allowance be calculated for the project based on a complex formula using evapotranspiration rates ■ Developer/Owners provide a Landscape Documentation Package to include A Water Use Worksheet by HydroZone, Water Budget Calculations, Maximum Applied Water Allowance, Estimated Total Water Use, a Soil Management Report, a Landscape Design Plan, a detailed Irrigation Design Plan, and a Grading Design Plan ■ All plans be signed by a licensed landscape architect, licensed landscape contractor, or other landscape professional ■ Weather-based or soil moisture-based irrigation controllers ■ An audit of irrigation system operation be conducted and submitted ■ A landscape and irrigation system maintenance schedule be submitted with a Certificate of Completion ■ Annual account water use be monitored by the City to ensure compliance with annual water use allotment. The detailed plans, audits, and irrigation system requirements required by the State's Model Ordinance would result in high costs and potential hardships for homebuyers and builders In addition, the City does not currently, and would not in the future, have sufficient staff to check and evaluate plans and audits for all new single-family, multi- family, and non-residential projects Therefore, the City's draft ordinance takes an alternative approach to meeting the requirements of AB 1881 Under the City of Atascadero's proposed ordinance, new landscape would need to comply with a list of key water saving techniques and standards With the implementation of these water saving landscape techniques, the property owners and applicants would be exempt from completing the comprehensive technical data required by the State Model Ordinance This will simplify landscape plan 39 ITEM NUMBER C-3 DATE. 02/09/10 development and review and achieve significant reductions in landscape water use The implementation of these standards would also aid property owners in reducing the cost of their monthly water bills Similar to the City of Paso Robles, newly constructed single-family residential projects, a Landscape Design Documentation Package would not be required if the project meets all of the following 1 Irrigated landscape area limited to 1 acre maximum 2 Turf area limited to 2500 sq ft or 25% of total landscapable area, whichever is less (residential) 3 Prohibit turf on slopes 20% or greater and in areas less than 8 feet wide in any direction 4 Utilize a planting palette of low water use plants (non-turf areas) 5 Apply 2" mulch layer on all exposed soil (non turf areas) 6 Utilize rain sensors on irrigation system 7 Drip irrigation (non-overhead spray) required on all non-turf areas and irrigation designed to prevent runoff 8 Recirculate water in water features The required conditions would be shown on a "water efficient landscape plan" sheet and submitted for review with construction plans Projects would be field verified prior to rrrr final occupancy approval for consistency with approved plans This approach is supported by the Atascadero Mutual Water Company Only landscape projects with over one (1) acre of irrigated landscape would be required to provide detailed plans with the technical data. Typically, landscape projects over one (1) acre in size are designed by landscape architects or qualified landscapers that are familiar with this type of technical irrigation design, and therefore they would be able to complete the documentation for their clients A draft copy of the City's Landscape Documentation Package and Certification of Completion forms are provided as Attachment 1 of this report. Projects that would most likely be required to complete this documentation would include large common areas for single-family subdivisions, large multi-family projects and commercial projects with over one acre of irrigated landscape Conclusion. The Water Conservation in Landscaping Act of 2006 (Assembly Bill 1881) requires all cities and counties in California to adopt landscape water conservation ordinances which are at least as effective as the State Model Ordinance in regards to water conservation According to the City's proposed ordinance, new landscape would need to comply with a list of key water saving techniques and standards, including limiting turf, utilizing rain sensors and drip irrigation, and using low-water use plant species 40 ITEM NUMBER C-3 DATE 02/09/10 With the implementation of these water saving landscape techniques, the property owners and applicants would be exempt from completing the lengthy technical data required by the State Model Ordinance This will simplify landscape plan development and review and achieve significant reductions in landscape water use and be very similar to Paso Robles' requirements Only landscape projects with over one (1) acre of irrigated landscape would be required to provide detailed plans with the Landscape Documentation Package FISCAL IMPACT Staff time will be required • In order to review landscape plans submitted with building permits and ensure compliance with the key water saving standards • To verify landscape installation in the field prior to building permit final • To review Landscape Documentation Packages only for projects with over one acre of landscaped area With the current workload, existing staff can absorb these requirements for now These proposed code changes will also affect future City projects The energy and landscape efficiency standards may increase initial project construction costs However, the long term energy and water savings should result in a long term savings for the City The City's proposed ordinance would create far less fiscal impact and require much less staff time in comparison to the State's Model Ordinance. ALTERNATIVES 1 The Council may make modifications to the text amendments 2 The Council may determine that more information is needed on some aspect of the text amendments and may refer the item back to staff to develop the additional information The Council should clearly state the type of information that is required and move to continue the item to a future date 3 The Council may deny the ordinance In the absence of a local ordinance, the State model ordinance will be in effect, requiring Landscape Documentation Packages for all landscape areas over 2,500 square feet. ATTACHMENTS Attachment 1 Landscape Documentation Package 41 ITEM NUMBER C-3 DATE. 02/09/10 and Certificate of Completion forms Attachment 2 Draft Ordinance A ATTACHMENT 1 Landscape Documentation Package and Certificate of Completion forms Required to be completed for landscaped areas over one acre IRRIGATIONLANDSCAPE AND Title 8 of the Atascadero Municipal Code requires the following for landscaped areas over one (1) acre. The Landscape Documentation Package be submitted in conjunction with or prior to the submittal of construction drawings for building plan check. ■ A Certificate of Completion needs to be issued by the City prior to issuance of a Certificate of Occupancy of the associated project/building. LANDSCAPE DOCUMENT PACKAGE The Landscape Documentation Package shall include the following six (6)elements. 1 COMPLETED APPLICATION FORM: Fill out Standard Development Application Form from Community Development Department. (Attachment 1) 2. WATER EFFICIENT LANDSCAPE WORK SHEET A. Project applicant shall complete the Water Efficient Landscape Worksheet which contains two sections (see sample worksheet Attachment 3) 1 A hydrozone information table (Attachment 3, Section A)for the landscape project; and 2. A water budget calculation (Attachment 3, Section B)for the landscape project. For the calculation of the Maximum Applied Water Allowance and Estimated Total Water Use 42 ITEM NUMBER. C-3 DATE. 02/09/10 (Attachment 3, Section C), a project applicant shall use the ETo values from the Reference Evapotranspiration Table (Attachment 2, Section A) B Water budget calculations shall adhere to the following requirements: 1 The plant factor used shall be from WUCOLS The plant factor ranges from 0 to 0.3 for low water use plants, from 0 4 to 0 6 for moderate water use plants and from 0 7 to 10 for high water use plants. 2.All water features shall be included in the high water use hydrozone and temporarily irrigated areas shall be included in the low water use hydrozone 3. All Special Landscape Areas shall be identified and their water use calculated as described below 4 ETAF for Special Landscape Areas shall not exceed 10 C Maximum Applied Water Allowance The Maximum Applied Water Allowance shall be calculated using the equation, MAWA= (ETo) (0 62) [(0 7 x LA)+ (0.3 x SLA)] See Example Calculations, Attachment 2 3. SOIL MANAGEMENT REPORT In order to reduce runoff and encourage healthy plant growth, a soil management report shall be completed by the project applicant, or his/her designee, as follows: 1 Submit soil samples to a laboratory for analysis and recommendations. a. Soil sampling shall be conducted in accordance with laboratory protocol, including protocols regarding adequate sampling depth for the intended plants. b The soil analysis may include. 1 soil texture, 2. infiltration rate determined by laboratory test or soil texture infiltration rate table, 3. pH; 4 total soluble salts; 5. sodium; 6 percent organic matter; and 7 recommendations. 2. The project applicant, or his/her designee, shall comply with one of the following: a. If significant mass grading is not planned,the soil analysis report shall be submitted to the local agency as part of the Landscape Documentation Package, or b If significant mass grading is planned, the soil analysis report shall be submitted to the local agency as part of the Certificate of Completion 43 ITEM NUMBER C -3 DATE. 02/09/10 3 The soil analysis report shall be made available, in a timely manner, to the professionals preparing the landscape design plans and irrigation design plans to make any necessary adjustments to the design plans. 4 The project applicant, or his/her designee, shall submit documentation verifying implementation of soil analysis report recommendations to the local agency with Certificate of Completion 4 LANDSCAPE DESIGN PLAN: For the efficient use of water, a landscape shall be carefully designed and planned for the intended function of the project. A landscape design plan meeting the following design criteria shall be submitted as part of the Landscape Documentation Package 1 Plant Material a. Any plant may be selected for the landscape, providing the Estimated Total Water Use in the landscape area does not exceed the Maximum Applied Water Allowance To encourage the efficient use of water,the following is highly recommended: 1 protection and preservation of native species and natural vegetation, 2. selection of water-conserving plant and turf species; 3. selection of plants based on disease and pest resistance, 4 selection of trees based on applicable local tree ordinances or tree shading guidelines; and 5 selection of plants from local and regional landscape program plant lists. b Each hydrozone shall have plant materials with similar water use, with the exception of hydrozones with plants of mixed water use c. Plants shall be selected and planted appropriately based upon their adaptability to the climatic, geologic, and topographical conditions of the project site.To encourage the efficient use of water,the following is highly recommended: 1 Use the Sunset Western Climate Zone System which takes into account temperature, humidity, elevation,terrain, latitude, and varying degrees of continental and marine influence on local climate, 2. Recognize the horticultural attributes of plants (i.e., mature plant size, invasive surface roots)to minimize damage to property or infrastructure [e g., buildings, sidewalks, power lines]; and 3. Consider the solar orientation for plant placement to maximize summer shade and winter solar gain. d. Turf is not allowed on slopes greater than 20%where the toe of the slope is adjacent to an impermeable hardscape and where 20% means 1 foot of vertical elevation change for every 4 feet of horizontal length (rise divided by run x 100= slope percent) 44 ITEM NUMBER C- 3 DATE 02/09/10 e. A landscape design plan for projects in fire-prone areas shall address fire safety and prevention A defensible space or zone around a building or structure is required per Public NOWO Resources Code Section 4291(a) and (b) Avoid fire-prone plant materials and highly flammable mulches. f The use of invasive and/or noxious plant species is strongly discouraged. g. The architectural guidelines of a common interest development, which include community apartment projects, condominiums, planned developments, and stock cooperatives, shall not prohibit or include conditions that have the effect of prohibiting the use of low-water use plants as a group 2.Water Features a. Recirculating water systems shall be used for water features. b Where available, recycled water shall be used as a source for decorative water features c. Surface area of a water feature shall be included in the high water use hydrozone area of the water budget calculation d. Pool and spa covers are highly recommended. 3. Mulch and Amendments a. A minimum two inch (2") layer of mulch shall be applied on all exposed soil surfaces of planting areas except in turf areas, creeping or rooting groundcovers or direct seeding applications where mulch is contraindicated. b Stabilizing mulching products shall be used on slopes. c. The mulching portion of the seed/mulch slurry in hydro-seeded applications shall meet the mulching requirement. d. Soil amendments shall be incorporated according to recommendations of the soil report and what is appropriate for the plants selected. 4 The landscape design plan, at a minimum, shall: a. delineate and label each hydrozone by number, letter, or other method; b identify each hydrozone as low, moderate, high water or mixed water use Temporarily irrigated areas of the landscape shall be included in the low water use hydrozone for the water budget calculation , c. identify recreational areas, d identify areas permanently and solely dedicated to edible plants; e. identify areas irrigated with recycled water; f identify type of mulch and application depth, g identify soil amendments, type, and quantity; h. identify type and surface area of water features, i. identify hardscapes (pervious and non-pervious), j. identify location and installation details of any applicable stormwater best management practices that encourage on-site retention and infiltration of stormwater Stormwater best 45 ITEM NUMBER C-3 DATE 02/09/10 management practices are encouraged in the landscape design plan and examples include, but are not limited to 1 infiltration beds, swales and basins that allow water to collect and soak into the ground; 2. constructed wetlands and retention ponds that retain water, handle excess flow and filter pollutants; and 3. pervious or porous surfaces (e.g , permeable pavers or blocks, pervious or porous concrete, etc.)that minimize runoff k. identify any applicable rain harvesting or catchment technologies (e.g , rain gardens, cisterns, etc.), I. contain the following statement: "I have complied with the criteria of the ordinance and applied them for the efficient use of water in the landscape design plan;"and m. bear the signature of a licensed landscape architect, licensed landscape contractor or any other person authorized to design a landscape. (See Sections 55001, 5615, 5641, 5641 1, 5641.2, 5641.3, 56414, 5641.5, 5641.6, 6701, 7027.5 of the Business and Professions Code, Section 832.27 of Title16 of the California Code of Regulations, and Section 6721 of the Food and Agriculture Code.) 5. IRRIGATION DESIGN PLAN. For the efficient use of water, an irrigation system shall meet all the requirements listed in this section and the manufacturers' recommendations.The irrigation system and its related components shall be planned and designed to allow for proper installation, management, and maintenance An irrigation design plan meeting the following design criteria shall be submitted as part of the Landscape Documentation Package 1 Irrigation System A. Automatic irrigation controllers utilizing either evapotranspiration or soil moisture sensor data shall be required for irrigation scheduling in all irrigation systems, excluding single-family residential irrigation systems. B The irrigation system shall be designed to ensure that the dynamic pressure at each emission device is within the manufacturer's recommended pressure range for optimal performance 1 If the static pressure is above or below the required dynamic pressure of the irrigation system, pressure-regulating devices such as inline pressure regulators, booster pumps or other devices shall be installed to meet the required dynamic pressure of the irrigation system. 2.Static water pressure, dynamic or operating pressure and flow reading of the water supply shall be measured at the point of connection These pressure and flow 46 ITEM NUMBER C-3 DATE 02/09/10 measurements shall be conducted at the design stage If the measurements are not available at the design stage, the measurements shall be conducted at installation C Sensors (rain, freeze, wind, etc.), either integral or auxiliary, that suspend or alter irrigation operation during unfavorable weather conditions shall be required on all irrigation systems, as appropriate for local climatic conditions. Irrigation should be avoided during windy or freezing weather or during rain D Manual shut-off valves (such as a gate valve, ball valve, or butterfly valve) shall be required, as close as possible to the point of connection of the water supply, to minimize water loss in case of an emergency(such as a main line break) or routine repair E. Backflow prevention devices shall be required to protect the water supply from contamination by the irrigation system.A project applicant shall refer to the applicable local agency code (i.e., public health)for additional backflow prevention requirements. F High flow sensors that detect and report high flow conditions created by system damage or malfunction are recommended G The irrigation system shall be designed to prevent runoff, low head drainage, overspray, or other similar conditions where irrigation water flows onto non-targeted areas, such as adjacent property, non-irrigated areas, hardscapes, roadways or structures. H Relevant information from the soil management plan, such as soil type and infiltration rate, shall be utilized when designing irrigation systems. I The design of the irrigation system shall conform to the hydrozones of the landscape design plan. J The irrigation system must be designed and installed to meet, at a minimum, the irrigation efficiency criteria as described in Section 492.4 regarding the Maximum Applied Water Allowance K. It is highly recommended that the project applicant or local agency inquire with the local water purveyor about peak water operating demands (on the water supply system)or water restrictions that may impact the effectiveness of the irrigation system. L. In mulched planting areas,the use of low volume irrigation is required to maximize water infiltration into the root zone. 47 ITEM NUMBER C-3 DATE 02/09/10 M Sprinkler heads and other emission devices shall have matched precipitation rates, unless otherwise directed by the manufacturer's recommendations. N Head to head coverage is recommended. However, sprinkler spacing shall be designed to achieve the highest possible distribution uniformity using the manufacturer's recommendations. 0 Swing joints or other riser-protection components are required on all risers subject to damage that are adjacent to high traffic areas P Check valves or anti-drain valves are required for all irrigation systems. Q Narrow or irregularly shaped areas, including turf, less than eight(8) feet in width in any direction shall be irrigated with subsurface irrigation or low volume irrigation system. R. Overhead irrigation shall not be permitted within 24 inches of any non-permeable surface. a. Allowable irrigation within the setback from non-permeable surfaces may include drip, drip line, or other low flow non-spray technology The setback area may be planted or unplanted b The surfacing of the setback may be mulch, gravel, or other porous material.These restrictions may be modified if- 1 the landscape area is adjacent to permeable surfacing and no runoff occurs; or 2. the adjacent non-permeable surfaces are designed and constructed to drain entirely to landscaping; or 3 the irrigation designer specifies an alternative design or technology, as part of the 4 Landscape Documentation Package and clearly demonstrates strict adherence to irrigation system design criteria in Section IV F (1) (H) Prevention of overspray and runoff must be confirmed during the irrigation audit. S Slopes greater than 20%shall not be irrigated with an irrigation system with a precipitation rate exceeding 0 75 inches per hour This restriction may be modified if the landscape designer specifies an alternative design or technology, as part of the Landscape Documentation Package, and clearly demonstrates no runoff or erosion will occur Prevention of runoff and erosion must be confirmed during the irrigation audit. 2. Hydrozone 48 ITEM NUMBER: C-3 DATE 02/09/10 A. Each valve shall irrigate a hydrozone with similar site, slope, sun exposure, soil conditions 1400` and plant materials with similar water use. B Sprinkler heads and other emission devices shall be selected based on what is appropriate for the plant type within that hydrozone. C Where feasible,trees shall be placed on separate valves from shrubs, groundcovers and turf D Individual hydrozones that mix plants of moderate and low water use or moderate and high water use, may be allowed if- 1 plant factor calculation is based on the proportions of the respective plant water uses and their plant factor; or 2. the plant factor of the higher water using plant is used for calculations. E. Individual hydrozones that mix high and low water use plants shall not be permitted. F On the landscape design plan and irrigation design plan, hydrozone areas shall be designated by number, letter or other designation On the irrigation design plan, designate the areas irrigated by each valve, and assign a number to each valve. Use this valve number in the Hydrozone Information Table (see Attachment 3, Section A) This table can also assist with the irrigation audit and programming the controller 3. The irrigation design plan, at a minimum shall contain A. location and size of separate water meters for landscape, B location,type and size of all components of the irrigation system, including controllers, main and lateral lines, valves, sprinkler heads, moisture sensing devices, rain switches,quick couplers, pressure regulators and backflow prevention devices, C. static water pressure at the point of connection to the public water supply; D flow rate (gallons per minute), application rate(inches per hour) and design operating pressure (pressure per square inch)for each station; E. recycled water irrigation systems (if applicable), F the following statement: "I have complied with the criteria of the ordinance and applied them accordingly for the efficient use of water in the irrigation design plan,"and 49 ITEM NUMBER. C- 3 DATE. 02/09/10 G the signature of a licensed landscape architect, certified irrigation designer, licensed landscape contractor or any other person authorized to design an irrigation system. (See Sections 55001, 5615, 5641, 56411, 5641.2, 5641.3, 56414, 5641.5, 56416, 6701, 7027 5 of the Business and Professions Code, Section 832.27 of Title16 of the California Code of Regulations, and Section 6721 of the Food and Agriculture Code ) 6. GRADING DESIGN PLAN For the efficient use of water, grading of a project site shall be designed to minimize soil erosion, runoff and water waste. A grading plan shall be submitted as part of the Landscape Documentation Package A comprehensive grading plan prepared by a civil engineer for other local agency permits satisfies this requirement. 1 The project applicant shall submit a landscape grading plan that indicates finished configurations and elevations of the landscape area including: A. Height of graded slopes, B. Drainage patterns; C. Pad elevations; D Finish grade, E. Stormwater retention improvements, if applicable 2. To prevent excessive erosion and runoff, it is highly recommended that project applicants: "kaw A. Grade so that all irrigation and normal rainfall remains within property lines and does not drain on to non-permeable hardscapes, B. Avoid disruption of natural drainage patterns and undisturbed soil, and C Avoid soil compaction in landscape areas. 3. The grading design plan shall contain the following statement: "I have complied with the criteria of the ordinance and applied them accordingly for the efficient use of water in the grading design plan"and shall bear the signature of a licensed professional as authorized by law 1%W 50 ITEM NUMBER C-3 DATE 02/09/10 CERTIFICATE OF COMPLETION 1 The project applicant shall 1 Submit the signed Certificate of Completion to the City for review; 2. Ensure that copies of the approved Certificate of Completion are submitted to the property owner or his or her designee The City will 1 Receive the signed Certificate of Completion from the project applicant; 2. Approve or deny the Certificate of Completion If the Certificate of Completion is denied, the local agency shall provide information to the project applicant regarding reapplication, appeal or other assistance. The Certificate of Completion (see Attachment 4 for certificate form) shall include the following six (6) elements: 1 Project information sheet that contains: •Standard Development Application Form from the Community Development Department; 2. Certification by either the signer of the landscape design plan,the signer of the irrigation design plan, or the licensed landscape contractor that the landscape project has been installed per the approved Landscape Documentation Package, •Where there have been significant changes made in the field during construction,these"as- built"or record drawings shall be included with the certification, 3 Irrigation scheduling parameters used to set the controller; 4 Landscape and irrigation maintenance schedule, 5 Irrigation audit report; and 6 Soil analysis report, if not submitted with Landscape Documentation Package, and documentation verifying implementation of soil report recommendations. 2. IRRIGATION SCHEDULING For the efficient use of water, all irrigation schedules shall be developed, managed, and evaluated to utilize the minimum amount of water required to maintain plant health Irrigation schedules shall meet the following criteria. 1 Irrigation scheduling shall be regulated by automatic irrigation controllers. 51 ITEM NUMBER C-3 DATE. 02/09/10 2. Overhead irrigation shall be scheduled between 7.00 p.m. and 9.00 a.m. unless weather conditions prevent it. Operation of the irrigation system outside the normal watering window is allowed for auditing and system maintenance, only when audit and maintenance staff are present. 3. For implementation of the irrigation schedule, particular attention must be paid to irrigation run times, emission device, flow rate, and current reference evapotranspiration, so that applied water meets the Estimated Total Water Use Total annual applied water shall be less than or equal to Maximum Applied Water Allowance (MAWA) Actual irrigation schedules shall be regulated by automatic irrigation controllers using current reference evapotranspiration data (e.g , CIMIS) or soil moisture sensor data. 4 Parameters used to set the automatic controller shall be developed and submitted for each of the following: •The plant establishment period, •The established landscape, and •Temporarily irrigated areas. 5 Each irrigation schedule shall consider for each station all of the following that apply- - Irrigation interval (days between irrigation), • Irrigation run times (hours or minutes per irrigation event to avoid runoff), •Number of cycle starts required for each irrigation event to avoid runoff; •Amount of applied water scheduled to be applied on a monthly basis, •Application rate setting; • Root depth setting; 1�ftm► • Plant type setting; •Soil type, •Slope factor setting, •Shade factor setting; and • Irrigation uniformity or efficiency setting 3. LANDSCAPE AND IRRIGATION MAINTENANCE SCHEDULE. 1 Landscapes shall be maintained to ensure water use efficiency A regular maintenance schedule shall be submitted with the Certificate of Completion. 2. A regular maintenance schedule shall include, but not be limited to, routine inspection, adjustment and repair of the irrigation system and its components; aerating and dethatching turf areas; replenishing mulch, fertilizing, pruning;weeding in all landscape areas and removing and obstruction to emission devices. Operation of the irrigation system outside the normal watering window is allowed for auditing and system maintenance 3. Repair of all irrigation equipment shall be done with the originally installed components or their equivalents. 4 A project applicant is encouraged to implement sustainable or environmentally-friendly practices for overall landscape maintenance. 4 IRRIGATION AUDIT, IRRIGATION SURVEY AND IRRIGATION WATER USE ANALYSIS 1 All landscape irrigation audits shall be conducted by a certified landscape irrigation auditor 52 ITEM NUMBER C-3 DATE. 02/09/10 2. For new construction and rehabilitated landscape projects installed after January 1,2010- the project applicant shall submit an irrigation audit report with the Certificate of Completion to the local agency that may include, but is not limited to, inspection, system tune-up, system test with distribution uniformity, reporting overspray or run off that causes overland flow, and preparation of an irrigation schedule 5. Findings for Approval. The City Council finds as follows 1 The proposed ordinance is consistent with the intent of the Water Conservation in Landscaping Act of 2006 2 The proposed ordinance is at least as effective as the State Model Water Efficient Landscape Ordinance SECTION 2. Approval. The City Council of the City of Atascadero, in a regular session assembled on February 9, 2010 resolved to introduce for first reading by title only, an ordinance that would amend Title 8, the Building Code, of the Atascadero Municipal Code with the following: Title 8 BUILDING CODE Chapter 8 WATER EFFICIENT LANDSCAPE AND IRRIGATION ORDINANCE 8-8.101 Purpose. 8-8.102 Definitions. 8-8.103 Applicability 8-8.104 Landscape Standards and Limitations for New Construction and Rehabilitated Landscapes. 8-8.105 Requirements for Landscaped Areas Equal to or Greater than One (1) Acre. 8-8.101 Purpose. Consistent with California State Law, it is the purpose of this ordinance to (a) promote the values and benefits of landscapes while recognizing the need to use water resources as efficiently as possible, (b)prevent unreasonable water waste by limiting landscape water use to the amount reasonably required for beneficial use, *400 61 ITEM NUMBER C-3 DATE 02/09/10 (c) establish a structure for planning, designing, installing, maintaining, and managing err water efficient landscapes in new construction and rehabilitated projects, 8-8 102 Definitions. "Certificate of Completion" means the document required under Section 8-8 105 (c) "Landscapable area" means all the planting areas, turf areas, and water features in a landscape design plan. The landscape area does not include footprints of buildings or structures, sidewalks, driveways, parking lots, decks, or patios. "Landscape contractor" means a person licensed by the state of California to construct, maintain, repair, install, or subcontract the development of landscape systems. "Landscape Documentation Package (LDP)" means the documents required under Section 8-8 105 9 (b) "Landscape project" means total area of landscape in a project as defined in "landscape area" for the purposes of this ordinance. "Multi-family Residential"means two or more attached residential units Landscape areas for multiple detached units on one parcel will be considered single family units for the purposes of this Ordinance. "New construction" means, for the purposes of this ordinance, a new building with a landscape or other new landscape, such as a park, playground or greenbelt without an associated building. "Permit" means an authorizing document issued by local agencies for new construction or rehabilitated landscapes. "Pervious" means any surface or material that allows the passage of water through the material and into the underlying soil. "Project applicant" means the individual or entity requesting a permit, plan check or design review from the local agency A project applicant may be the property owner or his or her designee "Rehabilitated landscape" means any re-landscaping project that requires a permit, plan check, or design review "Runoff" means water which is not absorbed by the soil or landscape to which it is applied and flows from the landscape area. For example, runoff may result from water that is applied at too great a rate (application rate exceeds infiltration rate) or when there is a slope. "Single Family Residential" one home on one lot, or multiple detached units on one lot (not attached) 62 ITEM NUMBER C-3 DATE 02/09/10 "Soil moisture sensing device" or "soil moisture sensor" means a device that measures the amount of water in the soil.The device may also suspend or initiate an irrigation event. "Turf' means a ground cover surface of mowed grass. Annual bluegrass, Kentucky bluegrass, Perennial ryegrass, Red fescue, and Tall fescue are cool-season grasses Bermudagrass, Kikuyugrass, Seashore Paspalum, St. Augustinegrass, Zoysiagrass, and Buffalo grass are warm- season grasses "Valve" means a device used to control the flow of water in the irrigation system. "Water conserving plant species" means a plant species identified as having a low plant factor "Water waste runoff'means water flowing away from property and which is caused by excessive application(s) of water beyond reasonable or practical flow rates, water volumes or duration of application. 8-8 103 Applicability The information within this Chapter applies to new construction and rehabilitated landscapes for commercial, industrial and residential projects that are subject to the development review process and/or a building permit with the exception of Section (f), which applies to all properties within the City limits. (a) Development Review Process In conjunction with the submittal of a project for development review (tentative parcel map, tentative tract, development plan or conditional use permit), conceptual landscape and irrigation plans shall be provided that demonstrate that the design of the landscaping and irrigation complies with the standards within this Ordinance These plans shall be reviewed by City Staff during the development review process. (b) Building Permit In conjunction with the submittal of a project for building permit plan check, final landscape and irrigation plans, in compliance with this Ordinance, shall be submitted with the project. After a plan check review by the Planning and/or Building and/or Public Works Departments for compliance with this Ordinance, a Building Permit may be issued. Fees consistent with the fees established for building plan check will be applied for staff review of the landscape and irrigation plan. (1) Residential Building Permits (i) Landscape plans in compliance with this ordinance shall be required to be submitted with all new single-family residences and new second unit building permits 63 ITEM NUMBER C-3 DATE. 02/09/10 wrrr (ii) Landscape plans shall be required in conjunction with residential remodels and additions only when new landscape is proposed to be installed. All new landscape and relandscaping shall be compliant with this ordinance (2) Non-residential Building Permits. (i) Landscape plans in compliance with this ordinance shall be required to be submitted with building permits for all new non-residential construction (ii) When submitting a building permit for non-residential remodels and additions, a landscape plan shall be submitted to bring the site into compliance with section 8-8 104 of this ordinance Only alterations required for compliance with section 8-8 104 shall be required to be shown on the landscape plan. (c) Certificate of Completion Once the landscape and irrigation plans and necessary documentation has been provided in substantial compliance with the LDP, a Certificate of Completion may be issued. A Certificate of Completion shall be issued prior to the project receiving a Certificate of Occupancy by the Building Division. (d) Landscape and Irrigation Installation For both projects less than or greater than 1 acre, the landscape and irrigation shall be installed per the approved plans prior to the issuance of a Certificate of Occupancy or "final of the building/project. (e) Landscape Bond (1)For projects that have a landscape area of 1-acre or greater and require a LDP, a bond may be posted which would allow a building to be finaled and a Certificate of Occupancy to be issued prior to the site landscape and irrigation being completed. The bond shall be based on an estimate for labor and materials to complete the landscape and irrigation project per the approved plans, plus an additional 25-percent. The applicant shall fill out the Landscape Bond Security Bond Agreement along with the necessary bonding information, to the Public Works Department for review and approval to determine the specific bond amount. (2) For projects that have a landscape area of less than 1-acre which does not require the LDP, the Community Development Director or his or her designee may approve a bond to be posted which would allow a building to be finaled and a Certificate of Occupancy to be issued prior to the site landscape and irrigation being completed. 64 ITEM NUMBER C-3 DATE 02/09/10 (f) Water Waste Prevention This provision applies to all properties with the City limits (1) Overhead irrigation of residential and commercial landscapes, including golf courses,parks, school grounds and recreation fields, shall be prohibited between the hours of 10 a.m. and 5 p.m. (i)Exceptions to the permitted watering timeframe are permitted for renovation or repair of the irrigation system with an operator present, landscape irrigation audits, the reseeding or planting of turf grass not to exceed an establishment period of twenty-one consecutive days, or the application of a landscape fertilizer that requires watering in. (2) Water runoff shall be prohibited. Watering or irrigating of any lawn, landscape or other vegetated area in a manner that causes or allows excessive water flow or runoff onto an adjoining sidewalk, driveway, parking lot, street, alley, gutter, ditch, or adjacent property is prohibited. 8-8.104 Landscape Standards and Limitations for New Construction and Rehabilitated Landscapes. (a) All project landscaping and irrigation plans/designs (residential,commercial, industrial) shall comply with the following standards and limitations: (1)Turf areas less than 8 feet in width in any direction are prohibited, (2)Turf shall be prohibited within the public right-of-way, including parkways, (3)Turf shall be prohibited on slopes greater than 20% where the toe of the slope is adjacent to an impermeable hardscape (where 20% means 1 foot of vertical elevation change for every 5 feet of horizontal length rise divided by run X 100 = slope percent), (4)Developments shall be graded to maximize the on-site distribution of runoff to planted areas, (5)For non-turf areas, landscape shall utilize a planting palette of low water use plants designated by the Atascadero Mutual Water Company's list of water conserving plants, (6) A minimum two inch (2") layer of mulch shall be applied on all exposed soil surfaces of planting areas except in turf areas, creeping or rooting groundcovers, or direct seeding applications where mulch is contraindicated, 65 ITEM NUMBER C-3 DATE. 02/09/10 (7) For non-turf areas, drip irrigation and non overhead spray methods shall be vftw utilized, (8) Irngation control systems shall utilize rain sensors, either integral or auxiliary, that suspend irrigation during and after rainfall events, (9) lrngation systems shall be designed to prevent runoff, low head drainage, overspray, or other similar conditions where irrigation water flows onto non- targeted areas, such as adjacent property, non-irrigated areas, hardscapes, roadways, or structures (10) Spray irrigation shall be prohibited within 24 inches of a non-permeable surfaces such as but not limited to concrete sidewalks and driveways. Allowable irrigation within the setback from non-permeable surfaces may include drip, dnp line, or other low-flow non-spray type of systems. The setback area may be planted or non-planted. The surfacing of the setback may be mulch, gravel, cobles, or other porous material. These restrictions may be modified if the landscape area is adjacent to permeable surfacing, and no runoff occurs or the adjacent non permeable surface drains entirely to landscaped areas, (11) Water features shall use recirculating water systems, (12) The architectural guidelines and Codes, Covenants, and Restrictions of common interest developments shall not have the effect of prohibiting the use of low-water use plants or requiring turf grass in landscaped areas. (13) The Building Official shall have the authority to grant modifications to items (1) through (12) above for individual cases provided that the Building Official first finds that the modification is in compliance with the intent and purpose of this ordinance and that such modification does not create water waste or additional water use than would be created if items (1) through (12) were implemented. (b) Commercial and industrial projects shall comply with the following turf limitations. (1) The area planted in turf grass and irrigated with spray irrigation shall be limited to 10 percent of the development's landscapable area or 2,500 square feet, whichever is less. (i)Exceptions This section does not apply to Cemeteries, plant collections as part of botanical gardens and arboretums open to the public, City and public parks, and school sports fields. 66 ITEM NUMBER C-3 DATE. 02/09/10 (c) Single-family residences shall comply with the following turf limitations: (1) Turf grass installed with spray irrigation on residential lots shall be limited to 25 percent of the landscapable area or 2,500 square feet, whichever is less. (d) Multi-family projects and residential subdivision tracts shall comply with the following turf limitations. (1)Turf grass installed with spray irrigation on individual residential lots shall be limited to 25 percent of the landscapable area or 2,500 square feet, whichever is less (i)Landscape area for new residential subdivisions will be calculated on an individual lot basis as each lot develops, not a total of landscape areas prior to subdivision. (2)Turf grass in common outdoor areas (including landscape and lighting district areas) shall be limited to 10 percent of the landscapable area. (i)The 10 percent limitation shall be exclusive of areas designed as active play surfaces (e g. ballfields, playgrounds, picnic areas) All other common landscape within the subdivision or multifamily project will be designed under one permit subject to the maximum turf limitations r.rr (ii) Active play areas open to the public are exempt from this provision. (e) Model homes shall comply with the following: (1)Turf grass shall be prohibited in the front yards of model homes, and shall be limited to 50 percent of the landscapable area in back and side yards, or 2500 square feet, whichever is less. (2) Model homes shall be used to educate future home owners about water efficient landscape and irrigation techniques. Education features for Model homes shall include (i)The installation of interpretive landscape information signs that describe the principles of water efficient landscapes including features such as hydrozones, appropriate irrigation equipment and others techniques that contribute to the overall water efficient irrigation theme (ii) Information shall be provided to new home owners that include techniques on designing, installing, managing, and maintaining water efficient landscapes. 67 ITEM NUMBER. C-3 DATE. 02/09/10 (f) Rehabilitated landscapes shall comply with the following: (1)Rehabilitated landscapes shall comply with the turf limitations and water use standards as outlined in Sections (a) through (e) above, as appropriate to the property type (2)Landscape plans for rehabilitated landscapes shall be reviewed for compliance with the standards when proposed or required as part of a building or grading permit, discretionary review, and/or when required by section 8-8 105 below 8-8 105 Requirements for Landscaped Areas Equal to or Greater than One (1) Acre. (a) Projects that have a landscape area equal to or greater than 1 acre shall meet the following requirements (1) Project shall comply with all of the items identified in Section 8-8 104 (2) Weather-based imgation controllers, soil moisture-based controllers, or other self-adjusting irrigation controllers shall be required for irrigation scheduling (b) The following documents and plans shall be submitted prior to the issuance of a Building Permit for the associated project (Please refer to the Landscape &IMgation Design Guide for specific forms and cntena) Compliance with Landscape Documentation Package which includes completion of the following items. 1) Project Information 2) Water Efficient Landscape Worksheet 3) Soil Management Report 4) Landscape Design Plan 5) Imgation Design Plan 6) Grading Design Plan Note the landscape area for new residential subdivisions will be calculated on an individual lot basis as each lot develops, not a total of landscape areas prior to subdivision. Therefore, generally a residential subdivision will not require an LDP for individual lot landscaping However, if the common landscape areas within the subdivision, multifamily project, or Landscape and Lighting District total 1 acre or greater, an LDP for those areas shall be completed under a single permit. sheltering and quarantine services, dog licensing, animal adoption, and other services as required either by State law or City Municipal Code The most recent three-year contract with the County expired on June 30, 2009 All other incorporated cities in the County also contract with the County for animal services and these contracts also expired on June 30, 2009 However, the County continues to provide this contracted service pending contract approval Contract Extension In the spring of 2009, the County proposed a new three-year contract, and the City was notified that the contract costs being proposed by the County were increasing substantially Contract costs continued to increase largely because the County had not been achieving full cost recovery from the cities utilizing their services The new contract proposed phasing in the estimated increased costs over three years, however, the cost increases being proposed for 2009 through 2012 caused concern for all of the cities involved 70 ITEM NUMBER C-4 DATE. 02/09/10 Proposed AnimalControl Contract Amounts As of Sprin,g 2009E $300000 / $250,000 '61 1 $200000 $164,391 $150,000 5126,786 : $100,000 , $50000 1A - $- 2006-07 2007-08 2008-09 2009-10 2010-11 2011-12 It was agreed by all City participants in the animal control services contract that the contract should be extended for 3 months at the new proposed rate while the underlying reasons for the increased costs could be studied On June 23, 2009, the Council authorized a contract extension for the County to provide animal control services through September 30, 2009 in order to allow the team to complete the study Similar contract extensions were executed by the other contract cities However, due to an oversight, the County did not submit the 3 month contract extensions to the Board of Supervisors so they were not formally executed by the County The County has, however, continued to provide services and the City has continued to pay the County The contract amendment before you tonight extends the contract through June 30, 2010 at the original allocation rate and method proposed last spring Findings of the Study Staff representing all seven contract cities worked with the County to form a committee to conduct an in-depth study and an analysis of the animal services being provided to the cities and the associated costs The study team was comprised of representatives from San Luis Obispo County Administration and the County Health Agency, the County Animal Services Manager, the Police Chiefs from the cities of San Luis Obispo and Arroyo Grande, and the City of San Luis Obispo Finance Director The initial study has been completed In general the committee found that the costs and revenues being proposed for animal control services were reasonable, however it also found that the allocation amongst cities was not equitable for all cities Historically the net cost of animal control services were allocated on a formula using percentage of population and an assigned "service factor" During the study it was found that some cities use more services than others and that the current formula does not properly reflect that use The City of Atascadero and City of Paso Robles were identified as the two cities that use more services per capita than the other participating cities 71 ITEM NUMBER C-4 DATE 02/09/10 The committee determined that the most equitable method of charging fees was to use the current formula for 2009-2010 and to use a new service-based allocation method for future contracts This would allow this City and the City of Paso Robles additional time to accommodate further increased costs (Although final allocations have not been determined, it is estimated that a service-based allocation method will cost the City $15,000425,000 annually more than the current allocation method ) The committee continues to work on details for the best way to allocate certain costs and revenues and the City is participating in those discussions In addition, the City is working with the County to determine why its use is higher than its neighbors to the south Preliminary review reveals that Atascadero is taking in a disproportionate number of cats Most cities are running close to a 1 1 ratio on cat versus dog intakes Atascadero (and also Paso Robles) is running closer to a 2 1 ratio Atascadero is second only to Paso Robles in both the number of cats and dogs taken into the Shelter Possible future considerations will focus on a number of points. • Acceptance of ownership responsibilities regarding cats • Promotion of spay and neuter practices • Control of feral cat populations It is expected that a new three year contract incorporating a new service-based allocation method will be proposed sometime this spring An in-depth staff report will be brought to Council at that time FISCAL IMPACT The cost for the one-year contract extension for FY 2009-10 ($199,440 00) is included in the Police Department's 2009-10 Budget. ALTERNATIVES Council may choose to not approve the Animal Services Contract with the County This would leave the City without the ability to provide such services and without a viable in- house or contract alternative Many of the services are required by law Therefore, staff does not recommend this alternative ATTACHMENT First Amendment to Contract for Animal Services from July 1, 2009 to June 30, 2010 in the amount of $199,440 00 72 ITEM NUMBER C-4 DATE 02/09/10 FIRST AMENDMENT TO CONTRACT FOR ANIMAL SERVICES This FIRST AMENDMENT is entered into between the County of San Luis Obispo, a public entity in the State of California (hereafter referred to as "County") and the City of Atascadero, (hereafter referred to as .,City„) WHEREAS, on July 1, 2006, the County executed a contract with the City to provide animal services within its boundaries by the County's Division of Animal Services, and, WHEREAS, the contract expires on June 30, 2009; and, WHEREAS, Health Agency and Administrative staff, working with a contingent of city representatives, are currently performing an Animal Services study which includes identifying specific animal services provided to the City data collection elements, allocation and fee setting methodology, with the intent that the Cities will gain a clearer understanding of the rate setting process, and, WHEREAS, County and City wish to extend the contract for an additional twelve months beyond the " expiration date and desire to amend the contract to reflect the extended term. NOW THEREFORE. 1 The following line shall be added to the original Attachment A to include the twelve month extension July 1,2009 to June 30, 2010 $199,440 2. The following paragraph shall be added to the Section labeled TERM AND RENEWAL and the Contact is hereby amended with the following language added. The term of this Contract is hereby extended to June 30, 2010, unless terminated earlier by mutual agreement of the parties The Health Agency Director shall have authority to act pursuant to this paragraph. All other terms and conditions of the Contract shall remain in full force and effect.
