RESOLUTIJN NO. 42-85
A RESOLUTION OF THE COUNCIL OF THE CITY. OF
APPROVING AGREEMENTS FOR THE CONSTRUCTION OF
DRAINAGE IMPROVEMENTS IN THE AMAPOA/TECORIDA
FLOOD HAZARD AREA
WHEREAS, the Developer has received preliminary approval of
a project subject to possible flooding in the Amapoa/Tecorida
area; and
WHEREAS, pursuant to the City Council action on May 28, 1985
various agreements have been presented to the Developer which
call for a contribution to future drainage improvements as a
condition of drainage plan approval. An agreement to join a
future assessment district for drainage improvements, and
deferment of road improvements to a future date.
NOW, THEREFORE, the Council of the City of Atascadero
resolves as follows:
Section 1.
The Council approves said agreements and authorizes the
Mayor to sign on behalf of the City provided that the Developer
has agreed to and executed these agreements.
Section 2.
The Council further directs the Planning Director to issue
,,, a building permit for said project provided that all conditions
of approval are met and the security called for in said agree-
ments is posted with the City.
On motion by Councilman Molina and seconded Councilwoman Mackey
the foregoing resolution is hereby adopted in its
entirety by the following vote:
AYES: Councilmembers Molina, Mackey and Mayor Nelson
NOES: Councilmembers Handshy and Norris
ABSENT: None
