Amendment to Agreement
Between the City of Atascadero and Chicago Grade Landfill, Inc.
For Exclusive Depositing of City Waste Collections
Into Chicago Grade Landfill
FOR VALUABLE CONSIDERATION, the receipt and sufficiency of which are
hereby acknowledged, the City of Atascadero, a municipal corporation, organized and
existing under the laws of the State of California ("City"), and Chicago Grade Landfill,
Inc. a California corporation ("Chicago Grade"), hereby amend that certain
Agreement Between the City of Atascadero and Chicago Grade Landfill, Inc.
for Exclusive Depositing of City Waste Collections Into Chicago Grade Landfill, dated
CLC- oar �, , 2003 ("Agreement"), as follows:
1) Section 4. A. 1. of the Agreement is modified to read in its entirety as
follows:
1. During the term of this Agreement, Chicago Grade
shall charge a maximum of Forty-One Dollars
($41.00) per ton of solid waste kept, accumulated, or
generated in the City of Atascadero that Chicago
Grade accepts from City's franchised waste hauler for
disposal in the Chicago Grade Landfill.
2) Section 4. A. 2. is modified to read in its entirety as follows:
2. In the event Chicago Grade shall reduce its landfill
disposal charges below Forty-One Dollars ($41.00)
per ton to any customer depositing solid waste at
Chicago Grade Landfill, Chicago Grade shall at the
same time reduce its landfill disposal charge in a like
amount for the solid waste kept, accumulated, or
generated in the City of Atascadero that Chicago
Grade accepts for disposal in its landfill.
3) Section 5. C is modified to read in its entirety as follows:
C. During the term of this Agreement, Chicago Grade
shall accept disposal of all non-hazardous "sludge"
generated by City at no cost to City.
4) The following provisions are added to Section 5:
D. During the term of this Agreement, Chicago Grade
shall provide construction demolition recycling
facilities for City residents consistent with the City's
Mandatory Construction and Demolition Debris
Recycling Program, Title 8, Chapter 13 of City's
Building Code. Chicago Grade's rates for this service
shall not exceed the rates approved by San Luis
Obispo County for uncompacted waste.
E. During the term of this Agreement, Chicago Grade
shall, at its own cost, participate in CALTRANS
`Adopt-a-Highway Program"on Highway 41, between
Capistrano and Homestead Road.
F. Recycling. Chicago Grade shall have onsite recycling
bins. The recycling will be free to the public, as long
as there is no cost for Chicago Grade to offer the
recycling.
5) This Amendment shall be effective January 1, 2008.
6) In all other respects, the Agreement shall remain in full force and effect as
originally written.
