DISCLOSURE OF CAMPAIGN CONTRIBUTIONS: California Government Code section 84308 (“Levine Act”) requires a party to or participant in a proceeding involving a license, permit, or other entitlement, including all contracts other than competitively bid, labor, or personal employment contracts, to disclose any contribution of more than $500 that the party or participant (or their agent) has made to a member of the Planning Commission within the prior 12 months. The Planning Commission Member(s) who receive such a contribution are disqualified and not able to participate in the proceedings and are also required to disclose that fact for the official record of the subject proceedings. DISCUSSION: PROJECT SUMMARY The applicant, Central Coast Shed and Steel, proposes to establish an outdoor sales lot for prefabricated sheds on the undeveloped portion of a 1.95-acre property zoned Commercial Tourist and located at 9700 El Camino Real. The sales lot will occupy the 0.64-acre southwest portion of the subject property with frontage along East Front Street and will include approximately 14,200 square feet of outdoor sales area. The remaining 7,000 square feet will accommodate a 420 SF sales office, parking, portable restrooms, and loading/unloading areas. Site access is proposed from East Front Street, with no access to the existing California Meridian building parking lot. BACKGROUND The project site is an undeveloped portion of a larger commercial lot that has been used as a temporary staging area for temporary construction projects in the past. The original Master Plan of Development approved for the site in 2009 anticipated a hotel in this location, however, those plans did not move forward. The current sales lot was established without permits in July 2025 and is considered noncompliant due to the lack of entitlement. A conditional use permit is being retroactively sought to formally establish a sales lot on this site. The site contains minimal existing improvements, limited to a chain-link fence along its perimeter. No utilities currently serve this portion of the property, and none are proposed as part of the project. Frontage improvements are existing however, repairs and upgrades are needed to meet current code standards. ANALYSIS: Item: 1 Department: Community Development Date: 11/04/2025 Page 6 of 21 11/04/2025 | Item 1 | Staff Report The project site is a freeway fronting property located within the Commercial Tourist (CT) zone, which is generally intended to accommodate limited commercial uses primarily serving travelers along the highway corridor. Sales lots are conditionally allowed within the CT zone, subject to approval of a Conditional Use Permit. Surrounding uses include a gas station to the north, an office building (California Meridian) to the east, the postal office to the south, and Highway 101 to the west. The proposed use is not expected to generate a significant increase in traffic. The existing site surface is finished with compacted road base. A total of five parking spaces are proposed. The Atascadero Municipal Code (AMC) allows parking requirements for sales lots to be determined through the CUP process. The business anticipates no more than three customer vehicles on-site at any given time. The proposed parking layout, one space for employees, three for customers, and one ADA- accessible space is expected to adequately serve the use. An ADA-accessible portable restroom will be provided on site as well. All for-sale structures will be loaded and unloaded entirely on site. The Atascadero Municipal Code includes specific standards for sales lots in addition to standard code requirements. Pursuant to Atascadero Municipal Code Section 9-6.139, sales displays are limited to areas along the street frontage with other areas of the site screened from public view. Fencing is limited to three-feet or less along the street frontage with chain-link fencing permitted at the sides and rear if it is vinyl coated and within a landscaped planter where the landscaping acts as screening. A minimum 10-foot landscaped area is required along the street frontage. These standards are intended to enhance the aesthetic of the City’s commercial districts. The Planning Commission may waive or modify these requirements through the Conditional Use Permit process if the characteristics of the site warrant exceptions. The applicant is requesting a Planning Commission modification to retain the existing chain-link fencing along the perimeter of the site, including the six-foot tall chain-link fencing along East Front Street. The project site shares the chain-link fencing to the north and south with the Post Office and a gas station. The gas station site includes shrubs along the fence line creating a visual barrier. The Post Office similarly includes a row of native oak trees against the existing fence line. The existing chain-link fence interior to the site is not visible from either El Camino Real or East Front Street. The existing chain-link fencing along the sides, combined with landscaping, may be considered to provide adequate screening of the use due the nature of the neighboring uses and presence of existing vegetation. The AMC limits fencing along the frontage of a sales lot to no greater than three feet in height and decorative wrought iron or wood rail construction. The applicant requests to retain the existing six-foot tall chain link fence along the front of the property due to security concerns. However, staff recommends that the chain-link fencing along East Front Street be replaced with four foot tall decorative wrought-iron , metal picket, pipe rail, or split rail fencing with wire added to address safety concerns. This modification would be in keeping with the aesthetic intent of the code while allowing additional height to address safety concerns. Although no permanent structures are proposed as part of this application and some flexibility may be warranted, enforcing quality street frontage landscape and fencing standards is critical for development in the City’s commercial districts. Regardless of fencing type, the applicant is proposing a 10-foot wide landscaped area along the street frontage, consistent with code standards. The landscaped area will include street trees and medium height grasses. If the existing fencing remains, most of the landscape would be behind the fencing. Page 8 of 21 11/04/2025 | Item 1 | Staff Report CONCLUSION: • The Project is proposing a sales lot at 9700 El Camino Real on a currently vacant portion of a commercial site with a modification to fencing and screening standards. • The project, as conditioned and with approval of code modifications, will comply with all applicable zoning standards and be compatible with existing adjacent uses. ENVIRONMENTAL DETERMINATION: The project qualifies for a Class 4 exemption from the provisions of the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.) Section 15304, because it meets all required conditions to be considered minor alterations to land. ALTERNATIVES: 1. The Planning Commission may include modifications to the project and/or conditions of approval for the project. Any proposed modifications, including conditions of approval, should be clearly re-stated in any vote on any of the attached resolutions. 2. The Planning Commission may determine that more information is needed on some aspect of the project and may refer the item back to the applicant and staff to develop the additional information. The Commission should clearly state the type of information that is required. A motion, and approval of that motion, is required to continue the item to a future date. 3. The Planning Commission may deny the project. The Commission must specify what findings cannot be made, and provide a brief oral statement, based on the Staff Report, oral testimony, site visit, correspondence, or any other rationale introduced and deliberated by the Planning Commission. Existing Site Photos Page 9 of 21 11/04/2025 | Item 1 | Attachment 1 DRAFT RESOLUTION RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ATASCADERO, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT (USE25-0060) TO ESTABLISH AN OUTDOOR SALES LOT USE AND A FENCING AND SCREENING CODE MODIFICATION ON APN 056-081-036 CENTRAL COAST SHED AND STEEL 9700 El Camino Real WHEREAS, an application has been received from Central Coast Shed and Steel to consider a Conditional Use Permit (USE25-0060) for an outdoor sales lot at 9700 El Camino Real, Atascadero, CA 93422 (APN 056-081-036); and WHEREAS, the site has a General Plan Designation of General Commercial (GC); and WHEREAS, the site is in the Commercial Tourist zoning district (CT); and WHEREAS, the application includes a request for approval of a fencing and screening modification pursuant to Atascadero Municipal Code (AMC) § 9-4.128(b)(3); and WHEREAS, the laws and regulations relating to the preparation and public notice of environmental documents, as set forth in the state and local guidelines for implementation of the California Environmental Quality Act (CEQA) have been adhered to; and WHEREAS, a timely and properly noticed Public Hearing upon the subject Conditional Use Permit and Lot Merger application was held by the Planning Commission of the City of Atascadero, at which hearing evidence, oral and documentary, was admitted on behalf of said application; and NOW, THEREFORE the Planning Commission of the City of Atascadero, California, hereby finds, resolves, and determines as follows: SECTION 1. Recitals: The above recitals are true and correct and incorporated herein as if set forth in full. SECTION 2. Public Hearings. The Planning Commission held a duly noticed public hearing to consider the project on November 6, 2025, and considered testimony and reports from staff, the applicants, and the public. SECTION 3. Findings for Approval of a Conditional Use Permit 1. FINDING: The proposed project or use is consistent with the General Plan FACT: The Project is consistent with all applicable goals and policies of the General Plan. The property has a land use designation of General Commercial and is zoned Commercial Tourism. The General Plan states that one of the intended uses of this zone is for limited commercial uses that serve travelers along Highway 101. Sales lots are conditionally allowed within the Commercial Tourism zone. 2. FINDING: The proposed project or use satisfies all applicable provisions of the Zoning Ordinance FACT: The project as conditioned satisfies all applicable provisions of the Zoning Ordinance. The property is zoned Commercial Tourist. Sales lots are allowed in this zone, subject to approval of a Conditional Use Permit. A screening modification is included in this approval to retain existing fencing along the side and rear boundaries of the project site. 3. FINDING: The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use FACT: The project will not be detrimental to the health, safety, or welfare of the community. The proposed outdoor sales lot will sell premanufactured units. No construction will occur on site; therefore, the project will not pose any construction-related hazards to the public. The project has been reviewed by the Public Works, Planning, Building, and Fire departments for compliance with applicable building code, fire, and engineering standards. 4. FINDING: The proposed project or use will not be inconsistent with the character of the immediate neighborhood or contrary to its orderly development FACT: The project is consistent character of the immediate neighborhood and aligned with its orderly development. The project site is located along E Front Street commercial corridor. The project is intentionally designed to face the E Front Street frontage, with all the units facing Highway 101. The design allows for maximum compatibility and reduction of conflicts with adjacent commercial uses. 5. FINDING: The proposed use or project will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic Page 11 of 21 11/04/2025 | Item 1 | Attachment 1 volume of the surrounding neighborhood that would result from full development in accordance with the land use element FACT: The proposed project and use is consistent with the traffic projections and road improvements anticipated within the General Plan. 6.FINDING: The proposed project is in compliance with any pertinent City policy or criteria adopted by ordinance or resolution of the City Council. FACT: The project is consistent with the General Plan and municipal code, as conditioned. B. Findings for Fencing and Screening Modification 7. FINDING: The characteristics of the site or site vicinity would make required fencing or screening unnecessary or ineffective. FACT: The existing chain-link fencing along the sides and rear of the property, combined with landscaping, provides adequate screening and is appropriate for the use. The continued use of this existing chain-link fencing, supplemented with the existing landscaping, will not adversely affect the surrounding area. 8. FINDING: The existing fence is consistent with the neighborhood character and does not impair site distance for vehicular traffic. FACT: As conditioned, the fence will be consistent with the intended aesthetic for sales lot uses within the commercial tourism zone. The proposed required site fencing will provide site security while still meeting decorative fencing and screening standards expected of street and highway fronting properties. The City Engineer has reviewed the fence and has no concern regarding sight distance. SECTION 4. CEQA. The project is Categorically Exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15304 (Minor alterations to land) and Section 15311 (Accessory Structures) exemptions of the CEQA Guidelines, in accordance with the attached Notice of Exemption. SECTION 5. Approval. The Planning Commission of the City of Atascadero, in a regular session assembled on November 4, 2025, resolved to approve the Project consistent with the following: 1. At the end of the period, the approval shall expire and become null and void unless building permits have been finaled for the project or the project has received a time extension consistent with the Atascadero Municipal Code. The applicant shall defend, indemnify, and hold harmless the City of Atascadero or its agents, officers, and employees against any claim or action brought to challenge an approval by the City, or any of its entities, concerning this conditional use permit.
