(AMND25-0019). CEQA: This project qualifies for a Class 3 Categorical Exemption from the provisions of the California Environmental Quality Act (California Public Resources Code §§21000, et. seq. “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§15000 et. seq.) pursuant to CEQA Guidelines Section 15303, which exempts new construction or conversion of small structures. • Recommendation: Staff’s recommendation is for the Planning Commission to adopt the Draft Resolution approving an Amendment to CUP USE24-0014 allowing an expansion of the lease area for a telecommunications facility at 2605 Traffic Way for a total of 1,000 SF, subject to findings and conditions of approval. 4. VESTING TENTATIVE PARCEL MAP AT 5400 TECOLOTE ROAD The project is a request to consider a Vesting Tentative Parcel Map 24-0047 located on APN 054-251-007. CEQA: A Negative Declaration and Initial Study (Environmental Document # 2025 - 0001) was prepared for the project and circulated for public review. The Initial Study identified no significant impacts from this project that would require mitigation, as current codes mitigate impacts from new single-family residential development. DIRECTOR’S REPORT Planning Manager Gleason stated that there are two items scheduled for the next meeting, a 4-lot subdivision on the westside, and an Amendment to a telecom site on Traffic Way. Planning Manager Gleason provided an update on the Downtown Enhancement project, spoke about the Tamale Festival, and stated that there will be an opening celebration for the Downtown Infrastructure Project later this summer. Planning Manager Gleason answered a question in regard to repairs on the pavement at Highway 41/101 and stated that this falls within the jurisdiction of Caltrans. DISCUSSION: PROJECT SUMMARY Verizon Wireless proposes to increase the size of a previously approved telecommunications lease area from 585 SF to 1,000 SF. The lease area will continue to be utilized to construct an unmanned telecommunication facility on a 1.57-ac property in the Public (P) zoning district located at 2605 Traffic Way (APN 049-063-003). The site has a PD overlay zone (PD-35) which refines allowed uses for this specific public zoned area along Traffic Way. BACKGROUND In 2024, the Planning Commission approved Conditional Use Permit USE24-0014 allowing an unmanned telecommunication facility with various equipment and electrical cabinets, a diesel Telecom Lease Area Day Care Synagogue 9 5/20/2025 | Item 3 | Staff Report generator, and a 63’ tall monopine (artificial pine tree) cell tower with associated antennas and equipment enclosed within a 585 SF lease area of the subject property. The property is also developed with a 5,000 SF building that currently houses the Congr egation Ohr Tzafon Synagogue. ANALYSIS The applicant proposes to expand the lease area to allow for additional space for ground - mounted equipment and cabinets that will facilitate future collocation of other service carriers on the site. Co-location is generally encouraged among service providers to allow for shared infrastructure and expedite and increase services within the community. The amended project will continue to comply with all applicable requirements of the Public (P) Zoning District. Telecommunications Facilities are conditionally allowed in the P zone and in PD-35. The proposed expanded lease area will bring the facility to a 5’ distance from the side property line to the east and require removal of an existing parking stall to the south. To ensure consistency with City Code and conformance with previous project approvals, a condition is included requiring the installation of a bike rack on the property to replace the vehicle parking spot being removed. No side setbacks are required in the public zone, therefore, the 5’ separation complies with City standards. EQUIPMENT ENCLOSURE & LANDSCAPE SCREENING The telecommunication lease area is located in the northeast corner of the property within a landscape area adjacent to the eastern property line. The lease will be fully enclosed by a 9’ tall concrete masonry block wall, which will fully screen the utility and equipment cabinets, generator, and all other appurtenances from the road and neighboring uses, as previously approved. Minor modifications to the originally approved landscape plan include removal of two non-native trees and screening bushes within the lease area. A condition is included to Lease Area Additions Eastern Property Line 10 5/20/2025 | Item 3 | Staff Report supplement and restore the existing landscaping with a focus on reducing the visibility of the 9’ wall from Traffic Way and the east adjacent property at 2607 Traffic Way. NEIGHBORHOOD COMPATIBILITY The previous use permit for a telecommunications facility at this location was found to be compatible with the neighborhood. The expanded telecommunications facility will not expand the use, but rather provide additional enclosed area for supporting equipm ent. The expanded lease area will be approximately 5’ from the shared property line with the Atascadero Learning Tree Preschool Property. The preschool’s parking lot abuts this property line. The proposed location of the telecommunications facility is a minimum of 210 ft away from any buildings in the vicinity. Landscaping will be installed to provide visual screening of the block wall enclosing the facility. The wall will utilize dark, earth toned block for compatibility with the surrounding development and landscaping. Conditions for maintenance of the site are included that allow the City to enforce conformity with the final approved plans and ensure the cleanliness of the site and surrounding area in perpetuity. CONCLUSION • The request for an Amendment to Conditional Use Permit USE24-0014 allowing an increase in the size of the approved telecommunications lease area at 2605 Traffic Way (APN 049-063-003) to 1,000 SF complies with all requirements of the City Municipal Code and continues to be compatible with the surrounding neighborhood. ENVIRONMENTAL DETERMINATION: The proposed project qualifies for a Class 3 categorical exemption from the provisions of the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA Guidelines (Title 14 California Code of Regulations §§ 15000, et seq.) pursuant to CEQA Guidelines Section 15303, which exempts new construction or conversion of small structures. This exemption is included in the draft resolution (Attachment 2). ALTERNATIVES: 1. The Planning Commission may include modifications to the project and/or conditions of approval for the project. Any proposed modifications, including conditions of approval, should be clearly re-stated in any vote on any of the attached resolutions. 2. The Planning Commission may determine that more information is needed on some aspect of the project and may refer the item back to the applicant and staff to develop the additional information. The Commission should clearly state the type of information that is required. A motion, and approval of that motion, is required to continue the item to a future date. 3. The Planning Commission may deny the project. Draft Resolution 12 5/20/2025 | Item 3 | Staff Report ATTACHMENT 1: Draft Resolution AMND25-0019 DRAFT PC RESOLUTION RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ATASCADERO, CALIFORNIA, AMENDING CONDITIONAL USE PERMIT USE24-0014 ALLOWING AN INCREASE IN SIZE TO THE TELECOMMUNICATIONS LEASE AREA LOCATED AT 2605 TRAFFIC WAY (APN 049-063-003) Verizon Wireless Telecommunications Facility AMND-25-0019 WHEREAS, an application has been received from Verizon Wireless (Applicant) and The Congregation Ohr Tzafon (Owner) to consider an Amendment to Conditional Use Permit USE24- 0014 (AMND-25-0019) to allow an increase in the size of an approved telecommunications lease area to total of 1,000 SF on a 1.57-acre property located a 2605 Traffic Way (APN 049-063-003); and WHEREAS, the site has a General Plan Designation of Public Recreation (REC); and WHEREAS, the site is in the Public (P) zoning district and within Planned Development Overlay Zone #35; and WHEREAS, telecom facilities are allowed in the P zoning district with approval of a Conditional Use Permit; and WHEREAS, the laws and regulations relating to the preparation and public notice of environmental documents, as set forth in the state and local guidelines for implementation of the California Environmental Quality Act (CEQA) have been adhered to; and WHEREAS, a timely and properly noticed Public Hearing upon the subject Use Permit application was held by the Planning Commission of the City of Atascadero, at which hearing evidence, oral and documentary, was admitted on behalf of said application; and NOW, THEREFORE, the Planning Commission of the City of Atascadero, California, hereby finds, resolves, and determines as follows: SECTION 1. Recitals: The above recitals are true and correct and incorporated herein as if set forth in full. SECTION 2. Public Hearings. The Planning Commission held a duly noticed public hearing to consider the project on May 20, 2025 and considered testimony and reports from staff, the applicants, and the public. 13 5/20/2025 | Item 3 | Staff Report SECTION 3. Facts and Findings. The Planning Commission finds as follows: A. Findings for a Conditional Use Permit 1. The proposed use is consistent with the General Plan. Fact: The Project is consistent with all applicable General Plan goals and policies. The project site has a Public Recreation land use designation and is zoned Public. The project site is privately owned and developed with 5,000 SF structure utilized as a synagogue. Telecommunication facilities are an allowed use in the Public zoning district, subject to approval of a Conditional Use Permit. The increase in the approved lease area does not create any inconsistencies with the City’s General Plan. 2. The proposed project satisfies all applicable provisions of Title 9 of City of Atascadero Municipal Code (Zoning Regulations of the City of Atascadero). Fact: The Project will satisfy all provisions of the Atascadero Municipal Code Title 9 of City of Atascadero Municipal Code. The project site is zoned Public, which allows telecommunications facilities subject to the approval of a Conditional Use Permit. The telecom facility will continue to comply with applicable code standards with the expanded lease area. The use, as well as the general project location and design continue to be consistent with development standards prescribed by the municipal code. 3. The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use. Fact: The Project is not detrimental to the health, safety or welfare of the general public or persons residing or working in the neighborhood of the use, nor is it detrimental or injurious to property or improvements in the vicinity of the use. The 9’ wall will be constructed in compliance with all applicable local regulations, project conditions, and requirements of the state building code, as adopted by the City. 4. That the proposed project will not be inconsistent with the character or the immediate neighborhood or contrary to its orderly development. Fact: The project is consistent character of the immediate neighborhood and aligned with its orderly development. The telecommunications facility will cover a 1,000-SF area near the northeast corner of a 1.57-acre property that is currently developed with a 5,000-SF building utilized as the Congregation Ohr Tzafon synagogue. The site is adjacent the railroad (north), the Learning Tree Preschool (east), the Atascadero Unified School District Maintenance, Operations, and Transportation Center (south), and single-family residential development (west). The facility will be unmanned and minimally intrusive to any of the surrounding uses. Conditions of approval are included to ensure the facility is appropriately maintained for the life of the project. The expansion of the lease area will facilitate future collocations of telecommunications equipment which promotes orderly development and availability of services within the community. 14 5/20/2025 | Item 3 | Staff Report 5. That the proposed project will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element. Fact: Traffic generated by the Project will not exceed the road capacities of the General Plan. The facility will not have any permanent onsite employees and will require only occasional maintenance throughout its operation. SECTION 4. CEQA. The project is exempt from the California Environmental Quality Act (CEQA), under Categorical Exemption § 15303, Class 3: New Construction or Conversion of Small Structures as identified in the attached Notice of Exemption. SECTION 5. Approval. This approval is for an Amendment to Conditional Use Permit USE24-0014 as depicted and described on the attached exhibits allows for a 1,000 SF lease area at 2605 Traffic Way (APN 049-063- 003). The approval of this entitlement project runs with the land, regardless of the owner. All conditions of Conditional Use Permit USE24-0014 are incorporated herein by reference and shall remain in effect unless specifically modified by this approval. Ongoing PS 2. The approval of these entitlements shall become final and effective for the purposes of issuing building permits fourteen (14) days after the Planning Commission hearing unless an appeal is made in accordance with the Atascadero Municipal Code. In accordance with the Atascadero Municipal Code section 9-8.105, any violation of any of the conditions of approval may be cause for revocation of this entitlement and subject the applicant and/or future property owners to the penalties set for in the Atascadero Municipal Code, as well as any other available legal remedies. The Community Development Department shall have the authority to approve the following minor changes to the project that (1) modify the site plan project by less than 10%, and/or (2) result in a superior site design or appearance. At the end of the period, the approval shall expire and become null and void unless the project has received a time extension consistent with the Atascadero Municipal Code. BP PS 6. The applicant shall defend, indemnify, and hold harmless the City of Atascadero or its agents, officers, elected and appointed officials, and employees against any claim or action brought to challenge an approval by the City, or any of its entities, concerning this conditional use permit. A minimum of two (2) manzanitas or similar size shrubs (minimum 5-gallon plantings) shall be planted adjacent to the enclosure wall facing Traffic Way . c. A minimum of three (3) manzanitas shall be planted within the 5’ setback area along the eastern property line. d. The understory of the landscaped areas and dirt areas adjacent to the CMU wall shall be covered with redwood bark mulch, consistent with the previously approved landscape plan. All landscaping shall be installed consistent with the approved landscaped plans prior to final building inspection. The applicant shall maintain the approved landscaping for the life of the project. Compliance shall be monitored and enforced during subsequent permitting for the facility. 8. The proposed 9’ tall CMU wall shall utilize a darker earthtone split face block color to blend into the surrounding landscape and be less prominent. The final color shall be labeled on the construction plans and approved by planning staff prior building permit issuance. BP PS 9. The Permittee shall avail its facility and site to other telecommunication carriers and, in good faith, accommodate all reasonable requests for collocation in the future. Ongoing PS 10. DISCUSSION: Eric and Elizabeth Smith propose a Vesting Tentative Parcel Map to subdivide a vacant 21.4 -acre lot in the Residential Suburban (RS) zoning district located at 5400 Tecolote Road (APN 054 -251- 007) into a total of four (4) lots. The resulting four lots will range in size from 4.2-ac to 6.4-ac with average slopes of 18.76% to 27.5%. The properties will be served by onsite wastewater systems at the time of future development. Access to the proposed parcels will be from Llano Road and Tecolote Road. Parcel 4 5.6-ac Parcel 3 5.2-ac Parcel 2 4.2-ac Parcel 1 6.4-ac Llano Rd. 55 5/20/2025 | Item 4 | Staff Report ANALYSIS The subject property is a vacant 21.4-acre lot in the RS zone. The minimum lot size in this zone ranges from 2.5-10 acres depending on lot characteristics. Based on specific lot characteristics for this parcel, the minimum lot size is 3.2-ac. The applicant proposes four lots ranging in size range in size from 4.2-ac to 6.4-ac, consistent with their minimum lot size allowance. The subject property has a 24.15% average slope across the site with steep hills and drainages. No buildings are proposed at this time. Development envelopes of less than 20% slope are identified for each lot. Future development, as allowed by the RS zone, will be required to be constructed in these areas and consistent with the City’s Hillside Grading Policies. Any construction outside of these areas will require additional review with standards in place at the time of permit submittal. ACCESS AND RIGHT OF WAY DEDICATIONS Two (2) lots will take access from Tecolote Road and two (2) lot will take access from Llano Rd. Future access points have been reviewed to ensure adequate sight distance can be achieved. The Project includes right-of-way dedications to bring Tecolote Road into compliance with City Standards by providing for the proper termination with a cul-de-sac. The cul-de-sac will be located outside of the adjacent creek reservation parcel. A Covenant for Public Improvements will be recorded with the Final Map to ensure all required improvements along Tecolote Road (widening and cul-de-sac) are completed prior to final occupancy of any unit taking access from this road. A reimbursement agreement can be filed to recoup fair share costs from the other lot taking access from Tecolote when they develop. Standard Public Utility Easement (PUE) dedications are also provided along both road rights-of-way. ENVIRONMENTAL DETERMINATION: A Negative Declaration and Initial Study (Environmental Document No. 2025 -0001) was prepared for the project and circulated for public review. The Initial Study identified no significant impacts from this project that would require mitigation, as current codes mitigate impacts from new single-family residential development. The Planning Commission may include modifications to the project and/or conditions of approval for the project. Any proposed modifications, including conditions of approval, should be clearly re-stated in any vote on any of the attached resolutions. 2. The Planning Commission may determine that more information is needed on some aspect of the project and may refer the item back to the applicant and staff to develop the additional information. The Commission should clearly state the type of information that is required. A motion, and approval of that motion, is required to continue the item to a future date. 3. The Planning Commission may deny the project. Facts and Findings. The Planning Commission finds as follows: A. Findings for a Tentative Parcel Map 1. The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan (Government Code §§ 66474(a) and (b)). Fact: The General Plan designation for the site is Rural Estate (RE) with minimum lot size between 2.5 and 10 gross acres for properties in the Residential Suburban (RS) zoning district. The subject property is a vacant, 21.4 acre site in the RS zone with an RE land use designation. The project will result in four new legal lots ranging in size from 4.2-ac to 6.4-ac with the same land use and zoning designations. 2. The site is physically suitable for the type of development (Government Code § 66474(c)). Fact: Sufficient area exists on these properties to allow for viable residential development. The Vesting Tentative Parcel Map depicts building envelopes with slopes of <20% to identify locations of the site most suitable for future residential development. 3. The site is physically suitable for the proposed density of development (Government Code § 66474(d)). Fact: The Project will result in a potential density of 4 residential units across 21.4 acres. The proposed lots range in size from 4.2-ac to 6.4-ac, and provide sufficient developable area to accommodate four single-family residences and associated accessory uses typical of the RS zone. 4. The design of the subdivision or the proposed improvements will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (Government Code § 66474(e)). Fact: Future development will need to comply with the native tree protection ordinance, Hillside Grading Policies, and the General Plan’s watershed preservation policies. The cul-de-sac dedication is specifically designed to avoid conflicts with the adjacent creek preservation parcel. A Negative Declaration has been published and circulated for the project in accordance with the California Environmental Quality Act, is included herein by reference. 5. The design of the subdivision or the type of improvements will not cause serious health problems. (Government Code § 66474(f)), and Fact: The subdivision is proposed in an area that is currently developed with single- family homes. The proposed lot sizes meet the standards of the Atascadero Municipal Code. 59 5/20/2025 | Item 4 | Staff Report 6. The design of the subdivision will not conflict with easements for access through or use of property within the proposed subdivision. (Government Code § 66474(g)), and Fact: Llano Rd will remain unchanged. No private access easements exist on-site. Tecolote will need to be improved to meet public road standards before final occupancy of any unit taking access from that road. Improvements include road widening and proper termination of the road in a cul-de-sac. Access to neighboring properties from Tecolote will not be affected. 7. The subdivision is consistent with regulations adopted by the State Board of Forestry and Fire Protection pursuant to Public Resources Code Sections 4290 and 4291 or consistent with local ordinances certified by the State Board of Fire Protection as meeting or exceeding the state regulations. Fact: The Project will result in the creation of four parcels within in a vary high fire hazard area. Each property will be allowed to develop with individual single-family homes and any accessory structure allowed within the RS zone. Development will be required to comply with all applicable fire access, defensible space, weed abatement, water supply, and fire suppression requirements of the State Fire Code as adopted and implemented by the City of Atascadero. 8. Structural fire protection and suppression services will be available for the subdivision through the City of Atascadero Fire and Emergency Services. Fact: No development is proposed at this time. However, residential development is anticipated to occur on the lot after the subdivision. The parcels are sized and designed to meet required fire code regulations for residential development. The City Fire Department reviewed the Project and had no comments, with the understanding that compliance with state fire code will be verified in advance of building permit issuance for any new structures. SECTION 4. CEQA. The Project has been environmentally reviewed pursuant to the provisions of the California Environmental Quality Act (“CEQA”) (Cal. Pub. Res. Code § 21000 et seq.) and the CEQA Guidelines (14 Cal. Code Regs. § 15000 et seq.). The City of Atascadero prepared an Initial Study to determine if the proposed project would have a significant adverse effect on the environment. The Initial Study found that there is no substantial evidence that the Project will have a significant effect on the environment. Pursuant to CEQA Guidelines Section 15064 and 15081, and based upon the information contained in the Initial Study, the City prepared a Negative Declaration for the Project. The Negative Declaration (Environmental Document No. 2025-0001) was prepared in compliance with CEQA. The Negative Declaration concluded that there is no substantial evidence that the Project would result in significant impacts to environmental factors. The Planning Commission independently reviewed and considered the contents of the Negative Declaration prior to deciding whether the approve the Project. Based on the Negative Declaration, comments received, responses to comments thereon, and the record before the Planning Commission, the Planning Commission hereby finds that the Negative Declaration reflects the independent judgment of the City and the Planning Commission.
