ARTICLEI-GENERALPROVISIONSSECTION1.1PREAMBLEThisMemorandumofUnderstandingismadeandenteredintobetweentheCityofAtascadero,hereinafterreferredtoasthe“City”andtheAtascaderoPoliceAssociation,hereinafterreferredtoasthe“Association”pursuanttoCaliforniaGovernmentCodeSection3500,etseq.andtheCity'sEmployer-EmployeeRelationsPolicy.ThepurposeofthisMemorandumofUnderstanding(MOU)istheestablishmentofwages,hoursandothertermsandconditionsofemployment.TheCityandAssociationagreethattheprovisionsofthisMOUshallbeappliedequallytoallemployeescoveredhereinwithoutfavorordiscriminationbecauseofrace,creed,color,sex,age,nationalorigin,politicalorreligiousaffiliationsorassociationmemberships.WheneverthemasculinegenderisusedinthisMOU,itshallbeunderstoodtoincludethefemininegender.SECTION1.2RECOGNITIONa.TheCityofAtascaderorecognizestheAssociationastherecognizedandexclusiverepresentativeforthefollowingpositions:PoliceOfficerClassification•PoliceOfficer•PoliceOfficer-IntermediatePOST•PoliceOfficer-AdvancedPOSTPoliceCorporalClassification•PoliceCorporal•PoliceCorporal-IntermediatePOST•PoliceCorporal-AdvancedPOSTPoliceSergeantClassification•PoliceSergeant•PoliceSergeant-AdvancedPOST•PoliceSergeant-SupervisoryPOSTPropertyEvidenceSpecialistClassification•SeniorPropertyEvidenceSpecialist•SeniorPropertyEvidenceSpecialist-EMDSupportServicesClassification•LeadRecordsTechnician•PublicSafetyDispatcher•PublicSafetyDispatcher-EMD•PublicSafetyLeadDispatcher•PublicSafetyLeadDispatcher-EMDAPAMOU2024-2027Page2 OtherClassifications•PoliceOfficer-Recruit•CommunityServicesOfficerForpurposesofthisMOU,positionswithaPOSTorEMDdesignationarehereinafterincludedinanyreferencetoPoliceOfficer,PoliceCorporal,PoliceSergeant,SeniorPropertyEvidenceSpecialist,PublicSafetyDispatcher,andPublicSafetyLeadDispatcher.b.Thisrecognitionisexclusiveofmanagementemployeesandtemporaryemployees.c.TheCityagreestomeetandconferandotherwisedealexclusivelywiththeAssociationonallmattersrelatingtothescopeofrepresentationundertheMeyers-Milias-BrownAct(GovernmentCodeSection3500,etseq.),andasprovidedundertheCity'sEmployer-EmployeeRelationsPolicy.SECTION1.3SEVERANCEa.IfanyprovisionoftheAgreementshouldbefoundinvalid,unconstitutional,unlawful,orunenforceablebyreasonofanyexistingorsubsequentlyenactedconstitutionalorlegislativeprovisionshallbesevered,andallotherprovisionsoftheAgreementshallremaininfullforceandeffectforthedurationoftheAgreement.b.IntheeventthatanyprovisionoftheMOUshouldbefoundinvalid,unconstitutional,unlawfulorunenforceable,theCityandtheAssociationagreetomeetandconferinatimelymannerinanattempttonegotiateasubstituteprovision.SuchnegotiationsshallapplyonlytotheseveredprovisionoftheAgreementandshallnotinanywaymodifyorimpacttheremainingprovisionsoftheexistingMOU.SECTION1.4SOLEAGREEMENTSa.TheCityandtheAssociationagreethattotheextentthatanyprovisionaddressingwages,hours,andtermsandconditionsofemploymentnegotiableundertheMeyers-Milias-BrownActfoundoutsidethisMOUandareinconflictthereof,thisMOUshallprevail.b.If,duringthetermoftheMOU,thepartiesshouldmutuallyagreetomodify,amend,oraltertheprovisionsofthisMOUinanyrespect,anysuchchangeshallbeeffectiveonlyifandwhenreducedtowritingandexecutedbytheauthorizedrepresentativesoftheCityandtheAssociation.AnysuchchangesvalidlymadeshallbecomepartofthisMOUandsubjecttoitsterms.SECTION1.5FULLFORCESANDEFFECTa.Allwages,hours,andtermsandconditionsofemploymentthatarenegotiablesubjectsofbargainingundertheMeyers-Milias-BrownAct,includingthosesetinthisMOU,shallremaininfullforceandeffectduringthetermofthisMOUunlesschangedbymutualagreement.APAMOU2024-2027Page3 b.TheCitywillabidebytheMeyers-Milias-BrownActwhereandwhenitappliestotheAssociation.ARTICLEII-RESPECTIVERIGHTSSECTION2.1ASSOCIATIONRIGHTSTheAssociationshallhavethefollowingrightsandresponsibilities:a.ReasonableadvancenoticeofanyCityordinance,rule,resolution,orregulationdirectlyrelatingtomatterswithinthescopeofrepresentationproposedtobeadoptedbytheCityCouncil.b.ReasonableuseofonebulletinboardattheAtascaderoPoliceDepartment.c.TherighttopayrolldeductionsmadeforpaymentsororganizationduesandforCityapprovedprograms.d.TheuseofCityfacilitiesforregular,normalandlawfulAssociationactivities,providingthatapprovaloftheCityManagerorhis/herdesigneehasbeenobtained.e.ReasonableaccesstoemployeeworklocationsforofficersoftheAssociationandtheirofficiallydesignatedrepresentativesforthepurposeofprocessinggrievancesorcontactingmembersoftheorganizationconcerningbusinesswithinthescopeofrepresentation.Accessshallberestrictedsoasnottointerferewiththenormaloperationsofanydepartmentorwithestablishedsafetyorsecurityrequirements.SECTION2.2CITYRIGHTSa.TheauthorityoftheCityincludes,butisnotlimitedto,theexclusiverighttodeterminethestandardsofservice;determinetheproceduresandstandardsofselectionforemploymentandpromotion;directitsemployees;takedisciplinaryactionfor"justcause";relieveitsemployeesfromdutybecauseoflackofworkorforotherlegitimatereason;maintaintheefficiencyofgovernmentaloperations;determinethemethods,staffingandpersonnelbywhichgovernmentaloperationsaretobeconducted;determinethecontentofjobclassifications;takeallnecessaryactionstocarryoutitsmissioninemergencies;exercisecompletecontrolanddiscretionoveritsorganizationsandthetechnologyofperformingitsworkprovided,however,thattheexerciseandretentionofsuchrightsdoesnotprecludeemployeesortheirrepresentativesfromconsultingorraisinggrievancesovertheconsequencesorimpactthatdecisionsonthesemattersmayhaveonwage,hoursandothertermsofemployment.APAMOU2024-2027Page4 SECTION2.3PEACEFULPERFORMANCEa.ThepartiestothisMOUrecognizeandacknowledgethattheservicesperformedbytheCityemployeescoveredbythisAgreementareessentialtothepublichealth,safetyandgeneralwelfareoftheresidentsoftheCityofAtascadero.AssociationagreesthatundernocircumstanceswilltheAssociationrecommend,encourage,causeorpromoteitsmemberstoinitiate,participatein,norwillanymemberofthebargainingunittakepartin,anystrike,sit-down,stay-in,sick-out,slow-down,orpicketing(hereinaftercollectivelyreferredtoas’’work-stoppage”)inanyofficeordepartmentoftheCity,nortocurtailanyworkorrestrictanyproduction,orinterferewithanyoperationoftheCity.Intheeventofanysuchworkstoppagebyanymemberofthebargainingunit,theCityshallnotberequiredtonegotiateonthemeritsofanydisputewhichmayhaverisentosuchworkstoppageuntilsaidworkstoppagehasceased.b.IntheeventofanyworkstoppageduringthetermofthisMOU,whetherbytheAssociationorbyanymemberofthebargainingunit,theAssociationbyitsofficers,shallimmediatelydeclareinwritingandpublicizethatsuchworkstoppageisillegalandunauthorized,andfurtherdirectitsmembersinwritingtoceasethesaidconductandresumework.CopiesofsuchwrittennoticesshallbeservedupontheCity.IfintheeventofanyworkstoppagetheAssociationpromptlyandingoodfaithperformstheobligationsofthisparagraph,andprovidingtheAssociationhasnototherwiseauthorized,permittedorencouragedsuchworkstoppage,theAssociationshallnotbeliableforanydamagescausedbytheviolationofthisprovision.However,theCityshallhavetherighttodiscipline,uptoandincludingdischarge,anyemployeewhoinstigates,participatesin,orgivesleadershipto,anyworkstoppageactivityhereinprohibited,andtheCityshallalsohavetherighttoseekfulllegalredress,includingdamages,againstanysuchemployees.ARTICLEIII-HOURSOFWORKANDOVERTIMESECTION3.1HOURSOFWORKa.WorkPeriodIngeneral,employeesshallbescheduledtoworkconsecutivedaysonandconsecutivedaysoff.Workschedulechanges(e.g.,from5/8to4/10,3/12or9/80)requirea30-daynoticebytheChiefofPoliceortheirdesigneeortheAssociation.Eitherpartymayrequestachangeinworkschedulesbywrittennotificationatleastthirty(30)daysinadvanceofproposedchanges.Thenormalworkperiod,pursuanttoSection207(k)oftheFairLaborStandardsAct,shallbefourteen(14)days.Allhoursworkedinexcessoftheemployee’sregularlyrecurring80-hourbiweeklyworkscheduleshallbepaidattheovertimerateofoneandone-halftheemployee’sregularrateofpay.b.MealtimeMealtimeforshiftemployeesisthirty(30)minutesofpaidtime.APAMOU2024-2027Page5 c.MealtimeCall-outforShiftEmployeesMealtimemaybetakenduringtheshiftiftheworkloadpermitsandasauthorizedandscheduledbytheshiftsupervisor.Shiftemployeesreceivemealtimeaspaidtime,andthereforeshiftemployeeshallbesubjecttocalloutduringmealtime.d.RestPeriodsRestperiodswillnormallybeprovidedtoemployeesattherateoffifteen(15)minutesforeachfour-(4)hoursworked.Restperiodsarenottobeconstruedasmealtime.Insofaraspractical,restperiodsshallbeinthemiddleofeachworkperiod.Restperiodscannotbeusedinconjunctionwithamealperiods,normayrestperiodsbetakenduringtheemployee’sfirstorlastscheduledhourofwork.e.MissedRestPeriodsandMealtimeRestperiodsarepaidtime;thereforenothinginthissectionprovidesfororimpliesanyadditionalcompensationorbenefitsifarestperiodisnottaken.Mealtimeispaidtime,thereforenothinginthissectionprovidesfororimpliesanyadditionalcompensationorbenefitifamealperiodisnotcompletedortaken.f.MedicalAttentionforOn-the-JobInjuriesEmployeesshallmakereasonableattemptstoscheduleallmedicaltreatmentrelatedtoon-the-jobinjuriesduringnon-scheduledworkhours.Medicaltreatmentforon-the-jobinjuriesthatarerequiredduringscheduledworkhoursshallbepaidtime.Medicalappointmentsduringnormalscheduledworkhoursshouldbecoordinatedwiththeemployee’ssupervisorsothebestinterestsofthedepartmentaremaintained.Atnopointwilltheemployeebecompensatedformedicalappointmentsthatarenotduringhis/hernormalworkshift;norwillemployeesreceiveovertimeforattendingmedicalappointments.g.DefinitionofShiftEmployeesShiftemployeesthatareassignedtopositionsinwhichdutiesareperformedonatwenty-four(24)hourday,seven(7)daysaweekbasisshallincludeallclassificationsidentifiedSection1.2ofthisMOU.h.ShiftTradeEmployeesofequalrankwillbeallowedtotradeshiftsfromtimetotimeaslongasthefollowingcriteriaaremet:1.ThetradedoesnotadverselyimpacttheDepartment'soperatingneeds.2.Thetradedoesnotresultinthepaymentofovertimetothetradingemployees.3.Thetradeisbymutualconsentoftheemployeesinvolved.4.Thetraderequestmustbesubmittedinwritingtotheemployeessupervisor,signedbybothemployeesandapprovedbythePoliceChieforhis/herdesignee.5.Thetradedaysoccurwithinthesamepayperiod.APAMOU2024-2027Page6 SECTION3.2OVERTIMEa.RateEmployeesshallbepaidovertimeattherateoftimeandone-halfhis/herregularrateofpay.Allovertimeshallberecordedandpaidinthefollowingmanner:1to15minutes,overtimecompensation-VAhour16to30minutes,overtimecompensation-hour31to45minutes,overtimecompensation-3/4hour46to60minutes,overtimecompensation-1hourb.HoursPaidPaidtimeoffshallbeconsideredtimeworkedforovertimepurposes.c.CompensatoryTime(CT)Notwithstandingtheprovisionsofthissection,employeesmaybegrantedCTforovertimecreditcomputedattimeandone-halfatthemutualconvenienceofthePoliceDepartmentandtheemployee.Employeesmayaccumulateamaximumofonehundredandtwenty(120)hoursintheirCTaccount.d.SchedulingCompensatoryTimeRequeststouseCTshallbegrantedwithdueregardforoperationalnecessitysuchasstaffinglevels.e.Schools/Training/Qualifications/DepartmentMeetingsOvertimeforPoliceOfficers,PoliceCorporalsorPoliceSergeantsastheresultofDepartment-widetrainingandmeetingsauthorizedbytheChiefofPolicewillbecompensatedatthetimeandone-halfovertimerate.Hourstraveling,studying,oreveningclassesshallbepaidinaccordancewithallFLSAprovisions.Traveltimeformandatoryordepartmentassignedtraveleventsshallbecompensatedasfollows:WhenanemployeeisrequiredtotraveloutsideofSanLuisObispoCounty,theemployeewillbecompensatedfortheirtimespentintravelaspaidtime.Timespentintravelshallbemeasuredbythedifferenceinthetimenormallyrequiredtotravelbetweentheemployee’shomeandtheregularlyassignedworkplaceandthetimebetweenhomeandthetemporaryworksite.Wheneverpossibletheemployee’sworkscheduleshouldbeadjustedwithinthetwoweekworkperiodtoaccommodatethistraveltimeasstraightpaidtime.Anytimespentintravelinexcessofthe80hoursshallbecompensatedasovertime.APAMOU2024-2027Page7 Traveltimeforemployee-requested,promotionalorothervoluntarytrainingshallbecompensatedasfollows:WhenanemployeeisrequiredtotraveloutsideofSanLuisObispoCounty,theemployeemaybecompensatedfortheirtimespentintravelaspaidtimewhenthetraveltimecanbeaccommodatedwithintheemployee’s80hourwork-period.Timespentintravelshallbemeasuredbythedifferenceinthetimenormallyrequiredtotravelbetweentheemployee’shomeandtheregularlyassignedworkplaceandthetimebetweenhomeandthetemporaryworksite.Whenitmeetstheneedsofthedepartment,theemployee’sworkscheduleshouldbeadjustedwithinthetwoweekworkperiodtoaccommodatethistraveltimeasstraightpaidtime.Anytimespentintravelforvoluntarytraininginexcessofthe80hourtwoweekworkperiodshallnotbecompensated.SECTION3.3CALLBACKPAYEmployeeswhoarecalledtodutyatatimetheyarenotworkingshallbecompensatedaminimumcompensationoftwo(2)hoursattimeandone-halfrateofpay.SECTION3.4COURTTIME/STANDBYTIMEa.Employeesassignedstandbydutyshallreceivefiftydollars($50.00)foreachdayofstandbyduty.Adayisdefinedasa24hourperiod.b.Employeesplacedonstandbybythecourtatatimetheyarenotworkingshallbecompensatedattherateoftwo(2)hoursstraighttimecompensationforeveryfour(4)hoursofactualtimeinstandbyassignment,proratedformoreorlessthanfourhours.Minimumcompensationwillbefortwo(2)hoursofstraighttime.c.Employeesrespondingtoworkfromstandbyshallreceiveaminimumoftwohourspayatstraighttime.Employeesworkinginexcessofonehourandtwentyminutesoncecalledbackshallreceivetimeandone-halfpayforhoursworkedinexcessofonehourandtwentyminutes,ortwohoursstraighttime,whicheverisgreater.d.TheChiefofPolicemayplaceemployeesonstandbystatus.Standbydutyshallnotbeconsideredashoursworkedforthepurposeofcomputingovertime.e.EmployeesonstandbystatusshallprovidethePublicSafetyDispatcherortheirdesigneewithatelephonenumberwherehe/shecanbereacheddirectly;andbeabletorespondtothepredetermineddutyassignmentwithinonehourfromthetimeofnotification.APAMOU2024-2027Page8 SECTION4.10OUT-OF-CLASSPAYEmployeeswhoareassignedtoworkoutofclassforfifteen(15)ormoreconsecutivedaysshallreceivefivepercent(5%)ofcurrentbasesalaryinadditiontoregularsalaryinaccordancewithPersonnelSystemRulesSection4.10.SECTION4.11CANINEHANDLERPAYThetimespentbyacaninehandlerinthecare,groomingandfeedingofhis/herassignedpolicedogshallbehoursworkedpayableatthetimeandone-halfovertimerateperhourofthehandler.Itisagreedthatcaninehandlersnormallyspend7hoursperbiweeklypayperiodperformingsuchworkandwrittenauthorizationfromthePoliceChiefmustbeobtainedtoperformsuchworkformorethan7hours.Suchhoursworkedshallnotbeinterpretedtobe(1)shiftextension,(2)callbacktowork,or(3)scheduledworkperformedinexcessoftheregularshiftforovertimepurposes.SECTION4.12FIELDTRAININGOFFICERINCENTIVEPAYa.PoliceOfficersassignedtoactinthecapacityofFieldTrainingOfficershallbecompensatedattherateof$1.74perhour,nottoexceed$300.00permonth.CompensationshallbeprovidedonlyforhoursactuallyspentservinginthecapacityofFieldTrainingOfficer.b.PublicSafetyDispatchersassignedtoactasatrainerofanewlyhiredemployeeshallbecompensatedattherateof$1.74perhournottoexceed$300.00permonth.Compensationshallbepaidonlyforhoursactuallyspentservinginthecapacityofatrainer.c.CompensationshallbeprovidedonlywhentheChiefofPoliceordesigneehasspecificallyauthorizedtheassignment.SECTION4.13ACTINGWATCHCOMMANDERPAYa.EachPoliceOfficerassignedasActingWatchCommanderwillreceive$2.00perhourforeachhourworkedinthecapacityofActingWatchCommanderascompensationforadditionalresponsibility.SECTION4.14BILINGUALPAYTheCityshallpayanadditional2.5%ofsalarytothoseemployeeswhoareabletospeakoneofthetoptwonon-EnglishlanguagesasdefinedbytheU.S.Census.Atestingmechanismmutuallyagreedtobybothpartieswillbecreatedtoassesslanguageabilitiesbeforequalifyingfortheincentive.SECTION4.15LONGEVITYEXCLUSIVELYASSECTION457CONTRIBUTIONa.Forthoseactiveemployeesthathaveattained10yearsofcontinuousfulltimeemployment,theCity,consistentwithsections(b)through(f)below,shalldepositfundsintoaseparateAPAMOU2024-2027Page21 b.Forunitmemberswhoelecttohave‘Employee+1”coverage,theCityshallpayanamountnottoexceed$1,570.33permonthforemployeeselectingEmployee+1coverage.TheCitycontributionshallgotowardthecostofallmedical,dental,visionandlifeinsurancebenefitpremiumsfortheunitmemberemployeeanddependent.Cityshallpayforincreasedcoststomedical,dental,visionandlifeinsurancepremiumsfortheemployeeandfiftypercent(50%)ofincreasedcostsforthedependentbaseduponHMOplancosts.c.Forunitmemberswhoelecttohave“EmployeeOnly”coverage,theCityshallpayanamountnottoexceed$933.18permonthforemployeeselectingEmployeeOnlycoverage.TheCitycontributionshallgotowardthecostofallmedical,dental,visionandlifeinsurancebenefitpremiumsfortheunitmemberemployee.Cityshallpayforincreasedcoststomedical,dental,visionandlifeinsurancepremiumsfortheemployeebaseduponHMOplancosts.Forunitmemberswhoelecttohave“EmployeeOnly”coverage,availablefundsremainingfromtheCity’scontributiontowardinsurancecoverageshallbepaidtoanemployeehiredonorbeforeSeptember1,2000asadditionalcompensation.Thisamountshallnotexceed$240.56permonth.d.TheCityshallprovidetermlifeinsurancecoverageforeachemployeeinatotalamountoffiftythousanddollars($50,000).e.TheCityshallprovideatermlifeinsurancepolicyforeacheligibledependentenrolledinhealthcoverageinatotalamountofonethousanddollars($1,000)perdependentduringthetermofthisagreement.f.TheMedicalInsuranceCommitteemayrecommendchangesinthelevelofserviceandserviceproviderstotheCityduringthetermoftheagreement.Eachrecognizedbargainingunitshallhavearepresentativeonthecommittee,andmanagementwillhaveonerepresentative.g.TheCityshallmakeavailabletoemployeescoveredbythisMOUaFlexibleBenefitPlan,incompliancewithapplicableInternalRevenueCodeprovisions.Theplanwillenableanemployee,onavoluntarybasis,tocoveradditionaloutofpocketpremiumexpensesforinsurancethroughpre-taxpayrolldollars.h.StateDisabilityInsurance-TheCityhasprovidedStateDisabilityInsuranceasapayrolldeductionofeachemployee.SECTION5.2ANNUALCOUNSELINGTheCityagreestoprovideuptofour(4)counselingappointmentseachfiscalyearformembersoftheAssociationthatchoosetoseeacounselor/psychologist.ThisprogramisvoluntaryandemployeeswillparticipateontheirowntimewithoutcompensationfromtheCity.ThecounselororpsychologistmustbelicensedandundercontractwiththeCity.AttherequestoftheAssociation,theCitywillconsidercontractingwithadditionalspecificcounselors/psychologists.SECTION5.3UNIFORM/SAFETYEQUIPMENTALLOWANCEThepurposeoftheuniformallowanceisforthepurchase,replacement,maintenance,andAPAMOU2024-2027Page23 times,exceptinextremeclimaticconditions.Vestsshallbereplacedorrefurbishedeach4or5yearsasmanufacturer’sspecificationsdictate.Employeesalreadyowningavestshallcontinuetousethemuntilrepairorrefurbishmentbecomesnecessary,asdeterminedbytheChiefofPolice.h.ThefollowingadditionalsafetyequipmentshallbeprovidedtoallPoliceOfficers,PoliceCorporalsandPoliceSergeantsbytheCity:ServiceweaponBatonDutybeltwithholster,keeperstraps,handcuffcase,chemicalmacepouch,keyring,batonring,ammunitionpouch,radioholderHelmetwithfaceshieldRaingarment:TheCityshallcomplywiththerequirementsofCAL/OSHAasitrelatestoprovidingraingearincludingrainbootsi.AllCityequipmentshallbereturnedtotheCityupontheemployeeleavingsuchservice.j.TheCitywillpurchasethefollowingitemsrequiredbythePoliceAcademyforemployeesintheclassificationofPoliceOfficerRecruit:AcademyT-shirtAcademySweatshirtAcademyRunningShortsDarkBluePoloShirtorothershirtasrequiredbythePoliceAcademy.Thetotalannualmonetaryvalueoftheuniformsinthissubsection(j)isnottoexceed$250.00peremployee.Inadditiontotheitemslistedabove,theCitymayprovideadditionalsafetyequipmentaslistedinSection5.2(h)atthediscretionofthePoliceChief.SECTION5.4PROBATIONThelengthoftheprobationaryperiodforemployeescoveredunderthisMOUshallbeinaccordancewithRule9ofJuly2012CityofAtascaderoPersonnelSystemRules.Eachoriginalandpromotionalappointmentmadetoapositioninthecompetitiveserviceshallbesubjecttoaprobationaryperiod.Thelengthoftheoriginalandpromotionalprobationaryperiodshalleachbeatleast12monthofserviceinthepositionforallemployees.AtthediscretionoftheDepartmentHeadandwiththeapprovaloftheCityManager,theprobationaryperiodmaybeextendedforamaximumofsixadditionalmonthswhentheDepartmentHeadhasdeterminedthattheemployeehasnotyetsuccessfullycompletedhis/herprobationaryperiod.ARTICLEVI-OTHERSECTION6.1CELLPHONEREIMBURSEMENTSTheCityagreestoreimburseeachfull-timeemployeeaflatrateoftendollars($10.00)permonthfortheuseoftheirpersonalcellphoneforCitybusiness.ThisamountwillbepaidonceperyearAPAMOU2024-2027Page25
