HomeMy WebLinkAboutAUP Resolution 2012-0003JAN 31 2012 CITY OF ADMINISTRATIVE HEARING OFFICER RESOLUTION 2012-0003 APPROVAL OF ADMINISTRATIVE USE PERMIT PLN 2099-1066 / AUP 2012-0057 TO ALLOW OFF-SITE SUBDIVISION SIGNS FOR DOVE CREEK AT 9200 SANTA BARBARA ROAD THE HEARING OFFICER OF THE CITY OF ATASCADERO DOES HEREBY RESOLVE THAT: WHEREAS, a request has been received from Motivational Systems Inc. (2695 N. Fowler Ave. 4101, Fresno, CA 93727) Applicant, and Emile Lasalle Family Trust (PO Box 817, Fall River Mills, CA 96028) Property Owner, to permit a V -board off-site subdivision sign for Dove Creek, with 60 square feet of signage on each of the two sides; and, WHEREAS, the Hearing Officer of the City of Atascadero held a duly noticed Administrative Hearing in Room 4 of City Hall on January 31, 2012, at 2:00 P.M.; and, NOW, THEREFORE, BE IT RESOLVED THAT THE HEARING OFFICER FOR THE CITY OF ATASCADERO MAKES THE FOLLOWING FINDINGS AND DETERMINATIONS: 1. The proposed project is determined to qualify for a Class 11 Categorical Exemption from the California Environmental Quality Act (CEQA), consistent with Section 15311. 2. The proposed project, as conditioned, is consistent with the General Plan. The proposal, as conditioned, will not be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use. 4. The proposal will be consistent with the character of the immediate neighborhood. NOW, THEREFORE, BE IT FURTHER RESOLVED THAT THE HEARING OFFICER FOR THE CITY OF ATASCADERO APPROVES THIS RESOLUTION. 1. Exhibit 1: Conditions of Approval 2. The granting of this Administrative Use Permit shall apply to the proposed site at 9200 Santa Barbara Road only 2. The V -board shall be installed on private property, and Ongoing PS, CS, PW located outside the public road right-of-way. The applicant shall work with the Public Works Department to locate the sign outside the line of sight triangle at the corner of EI Camino Real and Santa Barbara Road. 3. No more than three (3) off-site subdivision signs shall be Ongoing PS, CS allowed for the Dove Creek development. The V -board sign permitted with this AUP at the corner of EI Camino Real and Santa Barbara Road shall count as two (2) of the three (3) allowed off-site signs due to the wide spacing of the sides on the V -board 4. The sign area on each side of the V board shall not exceed Ongoing PS, CS 60 square feet of sign area. The sign structure will be a total height of 12 feet tall, and 10 feet in width. 5. No flags, banners or other decorations shall be affixed to the BP, Ongoing PW, CS, PW signs Ongoing PS, BS 6. The signs shall not be illuminated 7. A building permit shall be obtained by the applicant prior to BP PS, BS installation of the signs. 8. The signs shall be removed prior to final occupancy of the Ongoing PS last unit in the tract or after a period of three (3) years whichever is less.
