Chairman Bentz called the meeting to order at 7:00 p.m. and Commissioner Kelley led the Pledge of Allegiance. ROLL CALL Present: Commissioners Kelley, Porter, Fonzi and Chairman Bentz Absent: Commissioner Eddings and Jones Staff: Community Development Director Warren Frace, Planning Services Manager Steve McHarris and Recording Secretary Grace Pucci. PUBLIC COMMENT None CONSENT CALENDAR 1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING ON NOVEMBER 19 2002. 2. APPROVAL OF THE PLANNING COMMISSION MEETING SCHEDULE FOR 2003. MOTION: By Commissioner Kelley and seconded by Vice Chairman Fonzi to approve the Consent Calendar. PUBLIC HEARINGS 3. TENTATIVE PARCEL MAP 2002-0030: Regular Meeting December 3, 2002 Page 2 of 4 Applicant: Marvin & Elizabeth Dotson, 6998 Kingsbury Road, Templeton, CA 93465 Laila Johnson, 1909 Traffic Way, Atascadero, CA 93422 Project Title: Tentative Parcel Map (TPM) 2002-0030 Project 3300 Traffic Way (North of Chico Road), Atascadero, San Luis Obispo County APN 049 - Location: 071-012 Project A proposed subdivision of an existing 3.78 acre lot into three parcels of 1.26 acres each. The Description: site is currently developed with a single-family residence, detached garage, and pool. The existing improvements will be confined to two new lots allowing development of a single- family residence on each. The parcels are slight to moderately sloped. The project will not impact on-site native trees. The new parcels contain building sites with slopes under 10%. The properties will be served by on-site waste disposal systems (septic) and water is available from Atascadero Mutual Water Company. General Plan Designation: Single Family Residential (SFR). Zoning District: Residential Single Famil -Y (RSF-Y) Proposed PROPOSED NEGATIVE DECLARATION 2002-0042: Environmental Based on the findings of the initial study, the Community Development Department Determination recommends that the Planning Commission find that no significant harm would come to the environment from approval of this project. The proposed Negative Declaration is available for public review at 6500 Palma. Avenue, Community Development Department, Room 104, from 8:00 a.m. to 5:00 .m., Monday through Friday Planning Services Manager Steve McHarris provided the staff report and answered questions of the Commission. PUBLIC COMMENT Joan O'Keefe, 9985 Old Morro Road East questioned whether this subdivision falls under the new General Plan with a reduction in acreage. Mrs. O'Keefe also commented that the staff report did not address the issue of percolation rates, only referring to them as "normal." She felt it would be informative if this information were included in the staff report and asked what the percolation rates were for this site. Chairman Bentz asked Community Development Director Frace to address the issues raised by Mrs. O'Keefe. Regarding the question of whether this project would fall under the new General Plan, Director Frace stated that this area was re -designated under the new General Plan from a 2 { City of Atascadero Planning Commi..ion Minutes Regular Meeting December 3, 2002 Page 3 of 4 %2 to 10 -acre district to a one -acre district. On the issue of percolation rates, Director Frace indicated that this area was fairly flat with sandy soils. Percolation tests were done on the site and came in at 50 minutes per inch. The percolation tests will be submitted with the building permits. Chairman Bentz closed the Public Comment period. MOTION: By Commissioner Kelley and seconded by Commissioner Porter to adopt Resolution No. PC 2002-0070, certifying the proposed Mitigated Negative Declaration 2002-0042 and approving Tentative Parcel Map 2002-0030, a request to subdivide one lot totaling 3.78 acres into three parcels of 1.26 acres each (all lot areas are gross area), based on findings and subject to conditions. AYES: Commissioners Kelley, Porter, Fonzi and Chairman Bentz NOES: None ABSTAIN: None Motion passed 4: 0 by a roll -call vote. COMMUNITY DEVELOPMENT STAFF REPORTS Community Development Director Warren Frace reminded the Commission that the December 17th meeting has a fairly heavy agenda. Any Commissioners who may be absent for the meeting are requested to inform Chairman Bentz or staff. COMMISSIONER COMMENTS & REPORTS Commissioner Kelley inquired if the Planning Department has been working on guidelines or ratios for inclusionary housing and/or deed restricted housing for multi -family projects. Director Frace stated that the issue is being discussed with the City Council, and staff is aware that an inclusionary housing ordinance must be adopted so that staff, Commission and Council will have clear guidelines on what requirements will be in terms of percentages of units deemed affordable within projects. Commissioner Fonzi referred to a project on the corner of Curbaril and El Camino Real to be considered at the next Planning Commission meeting and asked whether the traffic study, which was to be done along El Camino Real, would be included in the agenda packet for that project. Director Frace indicated that a traffic study has been prepared and the mitigations of that study have been incorporated in the project. Commissioner Fonzi stated that she thought there was another traffic study required after the Gearhart project on Pueblo went in. Mr. Frace responded that the City Engineer was working on collecting funds for improvements based on the Pueblo Project; the money needed for the study was obtained from Albertson's and the upcoming drug store project so no other applicants were asked to contribute. Director Frace stated that the traffic study would be included as an attachment to the staff report. City of Atascadero Planning Comms—ion Minutes Regular Meeting December 3, 2002 Page 4 of 4 Commissioner Kelley referred to a communication he had received from the City containing a letter written by Mrs. Williams about improvements being made to property behind her home by Gary Bang. Director Frace stated that this project would also be on the next Commission agenda. ADJOURNMENT Chairman Bentz adjourned the meeting at 7:18 to the next regularly scheduled meeting on December 17, 2002.
