Chairman Bentz called the meeting to order at 7:00 p.m. and Vice Chairman Fonzi led the Pledge of Allegiance. ROLL CALL Present: Commissioners Kelley, O'Malley, Fonzi and Chairman Bentz Absent: Commissioners Eddings, Jones and Norton Staff: Assistant Planner Glenn Rider, Planning Services Manager Steve McHarris and Recording Secretary Grace Pucci. Chairman Bentz noted for the record that Commissioner Norton had resigned from the Planning Commission and that Commissioners Eddings and Jones had advised him they would be absent. PUBLIC COMMENT Jonelle Norton, 7700 Atascadero Avenue, announced that she is now the Director of Atascadero Main Street. Ms. Norton stated that the obligations of this position would make it difficult to continue as a Planning Commissioner and for this reason she had resigned from her position. Ms. Norton thanked the Commissioners for their support during her period of service on the Planning Commission and stated she had enjoyed working with the City and the other Commissioners. Ms. Norton invited all present to visit her in her new office and share their vision of the downtown. Chairman Bentz congratulated Ms. Norton on behalf of the Commission for her new position with the Main Street program. CONSENT CALENDAR 1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING ON JULY 16, 2002 MOTION: By Commissioner O'Malley and seconded by Commissioner Kelley to approve the Consent Calendar. AYES: Commissioners O'Malley, Kelley, Fonzi and Chairman Bentz NOES: None ABSTAIN: None Motion passed 4:0 by a roll -call vote. PUBLIC HEARINGS None COMMUNITY DEVELOPMENT STAFF REPORTS 3. TREE REMOVAL PERMIT 2002-0018: 9760 CORONA ROAD Request to remove four (4) native oak trees, one of which exceeds 24 -inches dbh, in conjunction with the construction of a new single family at 9760 Corona Road (PPN 2002-0081). Staff Recommends: The Planning Commission adopt Resolution PC 2002-0039 approving the removal of a 38 -inch native Valley Oak subject to the mitigation requirements set forth in the Atascadero Native Tree Ordinance and specified within the project conditions. Planning Services Manager Steve McHarris provided the staff report and answered questions of the Commission. PUBLIC COMMENT Joan O'Keefe, 9985 Old Morro Road East, stated she was concerned that the tree protection plan was not included in the staff report. Additionally, Mrs. O'Keefe inquired if the site of the tree removals were an original Colony lot or if it was created as the result of a lot split. She explained that this lot is a ridge lot and the arborist's report stated that 20 oak trees would be impacted, which generally occurs due to grading within the drip line, and she contended that often when there are lot splits on the west side of town, it meets acreage requirements, but many times the impacts of developing that lot are not addressed. City of Atascadero Planning Commi;.., on Minutes Regular Meeting August 6, 2002 Page 3 of 3 Commissioner O'Malley stated that as he reads the report, the applicant has adopted the recommendations of the arborist and that the additional 16 trees would be protected by the adoption of the recommendations with the only impact being on the four trees requested to be removed. Commissioner O'Malley asked Mrs. O'Keefe if she would agree with this analysis. Mrs. O'Keefe stated that she trusts the arborist in question and that he does a very good job. However, she reiterated that her main concern was that the public did not have access to the arborist's report. Regarding Mrs. O'Keefe's question concerning the origins of the lot, Commissioner Kelley indicated that he has looked at the lot in question many times in the last 22 years and it has always been that size. Chairman Bentz closed the Public Comment period. MOTION: By Vice Chairman Fonzi and seconded by Commissioner Kelley to grant approval of the request to remove four native oak trees subject to the mitigation as required by the Atascadero Native Tree Ordinance, in accordance with the adoption of Resolution PC 2002-0039, and with the date change from August 13 to August 6. AYES: Commissioners Fonzi, Kelley, O'Malley and Chairman Bentz NOES: None ABSTAIN: None Motion passed 4:0 by a roll -call vote. COMMISSIONER COMMENTS & REPORTS None ADJOURNMENT Chairman Bentz adjourned the meeting at 7:25 p.m. to the next regularly scheduled meeting of the Planning Commission on August 20, 2002.
