APPS E ,v:4 rc 6 2001` CITY OF ATASCj PLANNING Chairman Bentz called the meeting to order at 7:00 p.m. and Commissioner Kelley led the Pledge of Allegiance. ROLL CALL Present: Commissioners Eddings, Kelley, Norton, O'Malley, Fonzi and Chairman Bentz Absent: Commissioner Jones Staff: Community Development Director Warren Frace, City Engineer Steve Kahn, Planning Services Manager Steve McHarris, Assistant Planner Glenn Rider and Recording Secretary Grace Pucci. PUBLIC COMMENT Wade McKinney, City Manager, thanked the Commission for the time, dedication and commitment they put in on behalf of the City. Mr. McKinney presented each of the Commissioners with new city shirts. CONSENT CALENDAR 1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING ON JUNE 4, 2002. 2. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION MEETING ON JUNE 18 2002. MOTION: By Commissioner Eddings and seconded by Commissioner Kelley to approve the Consent Calendar. ROAD ABANDONMENT # 2001-0006 / LOT LINE ADJUSTMENT # 2001-0032 Project Title: Allen & Sandra Wright Project Proponent: Road Abandonment 2001-0006 / Lot Line Adjustment 2001-0032 Project Location: 10051 Santa Lucia Road, Atascadero, CA (Southwest corner of Santa Lucia Road/San Gabriel Road intersection) Project Description: A request for a Road Abandonment combined with a Lot Line Adjustment in the vicinity of Santa Lucia Road and San Gabriel Road. The applicant is requesting that unused portions of San Gabriel Road right-of-way be abandoned and revert back to the underlying property owner. The right-of-way has not been used as San Gabriel Road has previously been realigned and improved to City standards. The project will return the road area to the applicant and will allow the lot line along San Gabriel Road to be adjusted accordingly. General Plan Designation: Single Family Suburban Zoning District: Residential Suburban Environmental PROPOSED CATEGORICAL EXEMPTION CLASS 5(A)&(C): Determination: The proposed project qualifies for a Class 5(a) Categorical Exemption - Minor lot line adjustments not resulting in the creation of any new parcel; and a Class 5(c) Categorical Exemption - Reversion to acreage in accordance with the Subdivision Map Act. Staff Recommends: Staff recommends that the Commission: 1. Adopt Resolution PC 2002-0012, recommending that the City Council summarily vacate a portion of San Gabriel Road colony right-of-way as conditioned and subject to the appropriate findings. 2. Adopt Resolution PC 2002-0013, recommending that the City Council adjust a lot line along a portion of San Gabriel Road colony right-of-way as conditioned and subject to the appropriate findings. Planning Services Manager Steve McHarris provided the staff report and answered questions of the Commission. Chairman Bentz closed the Public Comment period. MOTION: By Commissioner Kelley and seconded by Vice Chairman Fonzi to adopt Resolution PC 2002-0012, recommending that the City Council summarily vacate a portion of San Gabriel Road colony right-of-way as conditioned and subject to the appropriate findings, and add a condition to Resolution PC 2002-0013 requiring resolution of Southern California Gas Company easement issue within the abandonment area prior to City Council approval of lot line adjustment, and adopt Resolution PC 2002-0013 recommending that the City Council adjust a lot line along a portion of San Gabriel Road colony right-of-way as conditioned and subject to the appropriate findings. AYES: Commissioners Kelley, Fonzi, Norton, Eddings, O'Malley and Chairman Bentz NOES: None ABSTAIN: None Motion passed 6:0 by a roll -call vote. COMMUNITY DEVELOPMENT STAFF REPORTS 4. TREE REMOVAL PERMIT- TRP 2002-0003: 8200 Graves Creek Road Request to remove six native trees, three of which are over 24 -inches in diameter, within the Residential Suburban zoning district located at 8200 Graves Creek Road. The trees have been determined by a certified arborist and planning staff to be diseased or dead and/or are obstructing proposed improvements that cannot be reasonably designed to avoid the need for tree removal. Staff Recommends: The Planning Commission adopt Resolution PC 2002-0030 approving the removal of three native oaks subject to the mitigation requirements set forth in the Atascadero Native Tree Ordinance and specified within the project conditions and exhibits. Assistant Planner Glenn Rider provided the staff report and answered questions of the Commission. PUBLIC COMMENT Chairman Bentz acknowledged for the Minutes an anonymous letter expressing opposition to the tree removal, which was received by the Commission earlier in the evening. MOTION: By Commissioner Eddings and seconded by Commissioner Kelley to adopt Resolution PC 2002-0030 approving the removal of three native oaks subject to the mitigation requirements set forth in the Atascadero Native Tree Ordinance and specified within the project conditions and exhibits. AYES: Commissioners Eddings, Kelley, O'Malley, Norton, Fonzi and Chairman Bentz NOES: None ABSTAIN: None Motion passed 6: 0 by a roll -call vote. COMMISSIONER COMMENTS & REPORTS Commissioner O'Malley reported that he had attended the Atascadero Youth Task Force meeting earlier in the day and there was a discussion regarding the Highway 41/San Gabriel intersection. Commissioner O'Malley informed City Engineer Steve Kahn that he would most likely be hearing from the current PTA President Lynne Bloomflield as well as the upcoming President Marie Whiten, regarding safety concerns at this intersection. City Engineer Kahn thanked Commissioner O'Malley for his report and stated that this particular intersection is in the circulation element for a signal in the future. However, if a safety or accident history develops at this intersection, the City might be eligible for Cal Trans Minor A funding. A signal would run approximately $200,000,which would fall within the limits for this type of funding. City Engineer Steve Kahn reported that the 101/41 intersection is being aligned for a new interchange and the initial study, an environmental document, is currently out and comments are requested. A workshop will be held in the Rotunda Room on July 10, 2002, 6:00 p.m. ADJOURNMENT Chairman Bentz adjourned the meeting at 7:29 p.m. to the next regularly scheduled meeting on July 16, 2002.
