Regular Meeting
March 19, 2002 — 7:00 P.M.
Chairman Bentz called the meeting to order at 7:04 p.m. and Commissioner Eddings led the
Pledge of Allegiance.

Absent: Commissioners Blaser and Kelley
Staff: Community Development Director Warren Frace, Assistant Planner Glenn Rider
and Recording Secretary Grace Pucci.

CONSENT CALENDAR
1. APPROVAL OF MINUTES OF THE REGULAR PLANNING COMMISSION
MEETING ON MARCH 5, 2002.
MOTION: By Commissioner Eddings and seconded by Commissioner Norton to approve the
Consent Calendar.

2. PROJECT TITLE: CONDITIONAL USE PERMIT 2002-0052, REVISED PD -7
MASTER PLAN OF DEVELOPMENT 9244 SAN RAFAEL ROAD.

Project
The proposed project is a request to revise the master plan of development (site

plan) and architectural elevations of an 8 -unit single family residential planned
development. The project was previously approved as a PD -7 overlay (ZC
94007). The site has a General Plan Designation of LDMF (Low Density Multi -
Family) and a Zoning District of RMF-10/PD-7 (Residential Multi -Family 10 -
bedrooms). An 8 -lot subdivision map is under construction on the 1.6 acre site.
The project is located on San Rafael Road between El Camino Real and US 101
(APN: 045-361-027, 028). Owner and Applicant: Kelly Gearhart.
Environmental
RECERTIFICATION OF THE JANUARY 30, 1996 PROJECT NEGATIVE
Determination
DECLARATION: Staff is recommending that the Planning Commission
recertify the negative declaration of environmental impact that was previously
adopted for ZC 94007 based on the findings that so substantial changes have
occurred to the project setting and the project revisions are consistent with the
previously approved project.
Staff
Adopt Resolution No. PC 2002-0014, thereby recertifying the 3/12/96 Negative
Recommendation
Declaration and approving CUP 2002-0052 subject to the findings, exhibits and
conditions as attached.
Community Development Director Warren Frace provided the staff report and answered
questions of the Commission.
Vice Chairman Fonzi questioned the square footage of the houses as shown on the table included
in the staff report. Director Frace stated that there was a misprint in the table and all homes in
the project are planned at 1,461 square feet.
Commissioner O'Malley questioned drainage in the area behind the retaining wall. Director
Frace indicated that the City Engineer who inspects periodically during the construction phase
handles drainage issues on a subdivision design; he will bring this issue to the City Engineers
attention.
PUBLIC COMMENT — None
Vice Chairman Fonzi expressed concern regarding architectural review of this project. It was
her understanding that these homes were to be in the Craftsman style, however the homes lack a
front porch, which is a dominant feature for this style.
Commissioner Norton asked if the fencing as shown on the plans, which incorporate a decorative
element at the top, would be the design that is actually used. Director Frace stated that he was

uncertain if it was the applicant's intent to utilize that design. He believes that the fence is a
standard six-foot wooden fence without any special trim at the top. Commissioner Norton stated
she is concerned that once a project is completed, it does not always look like the plans as
originally presented to the Commission for their approval. Director Frace indicated that the
Commission has the ability to condition the fence however they see fit because it is part of the
approval process. Commissioner Norton would like to see a more exact representation in the
plans when presented by the applicant.
Commissioner O'Malley stated he has similar concerns and he assumes when the Commission
approves a project, it will be constructed as presented.
Commissioner Eddings felt that these homes as presented do qualify as the Craftsman style with
their wood -like siding, trim, beams and gable ends.
Vice Chairman Fonzi indicated that she has concerns regarding windows and doors, the style of
which are sometimes changed in the construction process from those as indicated in the approved
plans.
Chairman Bentz referred to the staff report, page 33, and stated that by reading the description of
the color and materials board it was possible to tell what colors will be utilized. Additionally, he
referred to page 25, and pointed out that the covered porch area on the prior plans was smaller
than on the new plans.
MOTION: By Commissioner O'Malley and seconded by Commissioner Eddings to adopt
Resolution No. PC 2002-0014, thereby recertifying the 3/12/96 Negative
Declaration and approving CUP 2002-0052 subject to the findings, exhibits and
conditions as attached with the addendum that the proposed architectural
elevations, design and other pictures included would be followed in the final
approval of this project, with special attention to the fence.

COMMUNITY DEVELOPMENT STAFF REPORTS
Community Development Director Frace reminded the Commission of the special meeting
scheduled for Thursday, March 21, 2002. The Commission will be taking testimony on the
General Plan EIR.
Commissioner Norton asked how the public was noticed for the meeting. Director Frace stated
that notices were sent to every address and post office box in the city, in addition to notices in the
Atascadero News.

Chairman Bentz adjourned the meeting at 7:38 p.m. to the next regular meeting of the Planning
Commission on April 2, 2002.
