HomeMy WebLinkAboutResolution 24-94 RESOLUTION NO. 24-94 A RESOLUTION OF THE COUNCIL OF THE CITY OF ATASCADERO CERTIFYING ADOPTION OF A RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION PLAN WHEREAS, The City of Atascadero hereby certifies: that the City of Atascadero will replace all occupied and vacant occupiable Targeted Income Group dwelling units demolished or converted to a use other than as Targeted Income Group housing in connection with an activity assisted with funds provided under the Housing and Community Development Act of 1974, as amended, as described in 24 CFR 570.496(a) ; and WHEREAS, all replacement housing will be provided within three years of the commencement of the demolition or conversion. Before obligating or expending funds that will directly result in such demolition or conversion, the City will publish a Public Notice in a local paper of general circulation and submit to the Department the following information in writings 1. A description of the proposed activity; 2 . The location on a map and number of dwelling units by size (number of bedrooms) that will be demolished or converted to a use other than as Targeted Income Group dwelling units as a direct result of the assisted activity; 3 A time schedule for the commencement and completion of the demolition or conversion; 4. The location on a map and the number of dwelling units by size (number of bedrooms) that will be provided as replacement dwelling units . If such data are not available at the time of the general submission, the City will identify the general location on an area map and the approximate number of dwelling units by size and provide information identifying the specific location and number of dwelling units by size as soon as it is available, 5. The source of funding and a time schedule for the provision of replacement dwelling units; 6. The basis for concluding that each replacement dwelling unit will remain a Targeted Income Group dwelling unit for at least 10 years fromthedate of initial occupancy. 7 . Information demonstrating that any proposed replacement of dwelling units with smaller dwelling units (e.g. , a 2-bedroom unit with two 1-bedroom units) is consistent with the housing needs of targeted income group households in the City; and Resolution No. 24-94 Page 2 WHEREAS, the Community Development Department of the City of Atascadero [ (805) 461-5035] is responsible for tracking the replacement of housing and ensuring that it is provided within the required period; and WHEREAS, the Community Development Department is also respon- sible for ensuring requirements are met for notification and provision of relocation assistance, as described in . Section 570.496(a) , to any targeted income group displaced by the demoli- tion of any dwelling unit or the conversion of a targeted income group dwelling unit to another use in connection with an assisted activity; and WHEREAS, the City will make every effort to provide equal relocation assistance to each Targeted Income Group household displaced by the demolition of housing or by the conversion of a< Targeted Income Group dwelling to another use as a direct result of assisted activities and, to each separate class of Targeted income group persons temporarily relocated as a direct result of CDBG- assisted activities; and WHEREAS, consistent with the goals and objectives of activities assisted under the Act, the City will take the following steps to minimize the displacement of persons from their homes: 1. Stage rehabilitation of apartment units to allow tenants to remain during and after rehabilitation by working with empty units or buildings first. 2 . Adopt public policies to identify and mitigate displacement resulting from intensive public investment in neighborhoods. 3. Adopt policies which provide reasonable protection for tenants faced with conversion to a condominium or cooperative. 4. Make temporary relocation assistance available to owner- occupants that voluntarily participate in a housing rehabilitation program; HOW, ' THEREFORE BE IT RESOLVEDthatthe City Council of the City of Atascadero does hereby resolve to approve adoption of a Residential Antidisplacement and Relocation Assistance Plan.
