A RESOLUTION OF THE ATASCADERO CITY COUNCIL
APPROVING A GRANT AGREEMENT BETWEEN THE COUNTY OF
SAN LUIS OBISPO AND THE CITY OF ATASCADERO
REGARDING THE USE OF RECYCLING BINS AT ATASCADERO LAKE PARK
WHEREAS, the City Council approved an Integrated Solid Waste Management
Plan in 1991 to reduce, reuse, and recycle Atascadero's waste stream; and
WHEREAS, providing the public with convenient means to recycle furthers the
City's waste reduction goals and
WHEREAS, the County of San Luis Obispo applied for and received a grant from
the California Department of Conservation in 1991 for recycling bins in parks
throughout the County in which Atascadero Lake Park was among those selected; and
WHEREAS, the City desires to enter into a Grant Agreement with the County
of San Luis Obispo to obtain 7 recycling bin clusters for the Atascadero Lake Park.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Atascadero as follows:
1 . The City Council approves the Agreement, hereby referenced as Attachment
A, regarding the use of the recycling bins.
On motion by Councilmember Nimmo, seconded by Councilmember Luna the
foregoing resolution is hereby adopted in its entirety on the following roll call vote:

SAN LUIS OBISPO COUNTY PARKS RECYCLING PROJECT
CITY AND COUNTY GRANT AGREEMENT
This contract, dated 1993, by and between San Luis Obispo
County (sometimes referred to as "County") and Atascadero (sometimes referred to
as "City"),
WITNESSETH
WHEREAS, The County of San Luis Obispo desires to provide the public with
convenient, cost effective opportunities to recycle throughout the County; and
WHEREAS, the County of San Luis Obispo applied for a grant from the
California Department of Conservation (sometimes referred as DOC), in January 1991
for recycling bins in parks throughout the County; and
WHEREAS, the City of Atascadero joined with the applicant County in
requesting the use of some of the recycling bins; and
WHEREAS, the County was awarded the grant from the Department of
Conservation in October, 1991 and entered into a contract in January, 1992 with the
DOC to provide funding for beverage container recycling bins at major parks
throughout the County; and
WHEREAS, the County has procured the components of the bins and is
beginning assembly of the bin clusters as desired by the City of Atascadero; and
WHEREAS, the parties are desirous of entering into the agreement in view of
the significant benefit to the residents from the beverage container recycling bins; and
WHEREAS, it is necessary to demonstrate and report to the State of California
the commitment of all parties to the conditions of the grant as described below;
NOW, THEREFORE, in consideration of the benefits to residents and in
consideration of the mutual conditions, promises and agreements set forth herein,the
County and City do hereby mutually covenant and agree as follows:
1. The County will provide up to 7 clusters of bins to the City, subject to
the terms and conditions of the contract with the DOC, referenced
above.
2. The City will keep and maintain in goodcondition and repair the bins for
the length of the contract.
3. The contract term is twelve months, after which time the City will retain
and may continue to use the bins.
4. The City agrees to manage and ensure service for the park recycling
program for the chosen City park. The City agrees to ensure that the
City program is properly certified with the DOC Division of Recycling, as
necessary.
5. In order for the County to meet the terms of the above referenced
contract with the DOC, the City agrees to report to the County Solid
Waste Coordinator the volume and type of material collected each month
by the 5th of the following month, in a format substantially represented
as Exhibit B.
6. The City agrees to provide prior approval to the DOC consistent with the
contract referenced above, Exhibit A, for materials relating to this
program, and, in addition, that those materials will contain a statement
acknowledging funding by the DOC.
7. The City agrees to continue to maintain and report on the use of the bin
clusters in accordance with above referenced time and format until the
date of termination. The parties understand and agree that the contract
with the DOC referenced above may be modified by the DOC to
incorporate program schedule changes. Therefore,the parties agree that
the County may modify the reporting schedule and time period to be
consistent with any changes by the DOC.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands the
year and date first above written, being duly authorized to so do.
