HomeMy WebLinkAboutResolution 73-93 RESOLUTION NO. 73-93 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATASCADERO, CALIFORNIA, AUTHORIZING THE EXECUTION OF AN INTERIM EMPLOYMENT CONTRACT WITH ANDREW J. TAKATA FOR THE POSITION OF CITY MANAGER WHEREAS, the position of City Manager is an appointive position serving at the pleasure of the City Council; and WHEREAS,the Council desires to appoint Andrew J. Takata to the position of City Manager, with certain interim contractual provisions defining his rights and benefits; and, WHEREAS, the specific provisions of a final contract are currently being negotiated. The City Council of the City of Atascadero, California, hereby resolves as follows; 1. Andrew J. Takata, is hereby appointed as City Manager of the City of Atascadero effective July 1, 1993. 2. The Mayor is hereby authorized to execute on behalf of the City and Interim Employment Agreement, dated June 29, 1993, by and between the City and Andrew J. Takata, attached hereto as Exhibit "A". 2. The Finance Director is hereby authorized and directed to appropriate funds; release and expend funds; and issue warrants to comply with the terms of this agreement. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Atascadero held on the 29th of June, 1993. &LEER4ABOIN, CITY OF ATASCADERO y Clerk �� MKIJALACMayor Resolution No. 73-93 EXHIBIT "A" INTERIM EMPLOYMENT AGREEMENT THIS INTERIM AGREEMENT is made and entered into on the 29th day of June, 1993, by and between the City of Atascadero (hereinafter referred to as "CITY") and Andrew J. Takata, (hereinafter referred to as" EMPLOYEE"), pursuant to these terms and conditions: A. WHEREAS, the City and Employee mutually desire to setforth herein certain procedures, benefits and requirements regarding the employment of Employee by the City; and, B. WHEREAS, the City wishes to employ the services of Andrew J. Takata on these interim terms and conditions set forth herein as City Manager of the City of Atascadero; and C. WHEREAS, Employee wishes to accept employment as City Manager of said City under these interim terms and conditions recited herein. NOW, THEREFORE, the City and the Employee hereby mutually agree to the following: 1. DUTIES. The City agrees to employe Andrew J. Takata as the City Manager of the City of Atascadero, effective July 1, 1993, to perform all duties as specified by law and ordinance, and to perform such other proper duties as assigned by the City council; and Employee agrees thereto, all on the terms and conditions set forth herein. 2. COMPENSATION. The annual interim compensation of Employee shall be $67,000.00. 3. BENEFITS. Employee shall retain, accrue, and have credits to his personal account, City-paid employee benefits to be in the amount and rates as he currently is entitled to as a member of the executive management employees of the City of Atascadero. 4. AUTOMOBILE ALLOWANCE. City shall provide Employee with $300.00 monthly automobile allowance. 5. TERMINATION BY CITY. City may, by a majority vote of the City Council, at any time, for any or no reason whatsoever, terminate the employment of Employee by directing written notice of termination, effective on the date of notice of termination, to the Employee by Certified or Registered mail, return receipt requested. In the event of such termination while Employee is ready, willing and able to perform the duties of City Manager, and the termination was not for legal cause, City shall pay Employee a sum equal to twelve (12) months salary including full health benefits, to be paid on a pro rata basis, according to the regular City pay-day schedule, for a period not to exceed twelve (12) months. Employee shall keep on file with the City Personnel Coordinator his current residence address. 6. TERMINATION BY EMPLOYEE. Employee may, at any time, for any reason whatsoever, terminate his employment with the City by directing sixth days (60), written notice of termination to City by certified or registered mail, return receipt requested. In the event of such termination, Employee shall not be entitled to receive the termination pay provided for in Section 5 of this agreement. 7. Employee and City will enter into and negotiate in good faith towards a final Employment Agreement setting forth in detail the terms and conditions of employment of the City Manager.
