RESOLUTION OF THE COUNCIL OF THE
CITY OF ATASCADERO GRANTING AN EASEMENT
TO THE GAS COMPANY
WHEREAS, The Gas Company provides natural gas service within
the City of Atascadero; and
WHEREAS, extension of service facilities across property owned
by the City of Atascadero is required for service expansion; and
WHEREAS, The Gas Company has prepared the required easement
documents (Attached Exhibit A) .
NOW, THEREFORE, BE IT RESOLVED that the Mayor is authorized to
execute all documents necessary for the granting of this easement.
On motion by Councilmember Luna, and seconded by Councilmember
Kudlac, the foregoing Resolution is hereby adopted in its entirety
on the following roll call vote:
AYES: Councilmembers Bewley, Borgeson, Kudlac, Luna and Mayor
Nimmo
NOES: None
ABSENT: None
ADOPTED: November 10, 1992

FOR A OONBIDERATION, The City of Atascadero, a Body Politic
and Corporate of the State of California, hereby grant(s) to
Southern California Gas Company, a corporation organized and
existing under and by virtue of the laws of the State of
California their successors and assigns, a right of way to lay,
construct, maintain, operate, repair, renew, change the size of
and remove one or more pipelines, with metering, measuring,
regulating and other equipment, for the transportation of gas,
petroleum products and other substances, with the right of
ingress and ogress to and from the same, over, through, under and
along their parcel of land in Ban Luis Obispo County,
California, which is described as follows:
See Exhibits "A" and "B" attached hereto and made a part
hereof by reference.
The grantor reserves the right to fully use the premises,
except as to the rights granted; and the grantee agrees to pay
any damages which may arise to crops, fences or buildings from
the laying, construction, maintenance or operation of the
pipeline.
Grantors shall not construct or maintain, on the premises
over which this right of way is granted, any buildings or other
structures, plant trees, inundate, or change the grade of the
premises.

LEGAL DESCRIPTION
Being that portion of Atascadero Creek Res. No. 4 of Atascadero, In the
City of Atascadero. County of San Luis Obispo, State of California, as
per map recorded In Book 4, Page 30 of Maps In the Office of the County
Recorder of said county, said portion being a strip of land 20.00 feet
wide, the centerline of which Is described as follows:
Commencing at the northeasterly corner of the property described in deed
recorded In Book 1506, Page 368 of Official Records of said county, said
point also being on the southwesterly right-of-way line of EI Camino Real,
said point being marked by a found brass tag stamped R.C.E. 14944 as
shown on the map recorded to Book 37, Page 42 of Parcel Maps of said
county;
Thence 5 470 421 50" W 15.26 feet along the southeasterly line of said
property described in said deed and the southeasterly line of Parcel 2 of
said Parcel Map, said line also being the northwesterly line of said
Atascadero Creek Res. No, 4 to the True Point of Beginning;
Thence S $60 071 47" E 124.64 feet to a point on the northeasterly line
of said Atascadero Creek Res. No, 4, said point being the Point of
Terminus.
Except any portion of said Atascadero Creek Res. No. 4 lying within the
property described in deed recorded In Book 1510, Page 285 of Official
Records of said county.
Containing 2,478.99 square feet, more or less.
The above described parcel of land is graphically shown on Exhibit "B"
attached hereto and made a part hereof,
