Council Member Clay announced that he attends the Youth Task Force meetings. He commented that it is important that the older generation make contact with the younger generation and encouraged everyone to reach out to our young people. Atascadero State Hospital EIR Review. Principal Planner Warren Frace gave a brief staff update on the Atascadero State Hospital EIR Review. Council Member Luna asked why a more thorough review was not done. Mr. Frace replied that it was based on direction given by Council to go no further do to lack of public support. Council Member Luna asked if we have a plan if Atascadero becomes a more probable site for the project. Mr. McKinney commented that we would already have, if chosen, a greater environmental impact. Principal Planner Warren Frace answered questions of the Council. PUBLIC COMMENT Lon Allan, Atascadero News, stated that Imperial County is strongly opposed to the development of the project in their area. Mayor Johnson closed the Public Comment period. B. DISCUSSION: City Code, Section 6-13.03, addresses the abatement of vegetative growth and/or refuse, which constitute a hazard. Adoption of the proposed Resolution is the first step in this annual program, which requires council action. The remodeling required to accomplish this move has been handled by the Building Maintenance Division of the Community Services Department. Design and Appearance The Master Plan of Development will control site design and appearance issues including landscaping and architecture. The project has been designed with single story residential units that incorporate architectural materials found on neighboring historic houses. All street elevations will have lap siding with a stone wainscot treatment at the base. Architectural embellishments including Craftsman's style eave corbels, window shutters and covered front porches are included on all units. Two separate color schemes are proposed for the project. All trash storage and air conditioning condenser units will be screened from view behind fenced enclosures. Shrub planter areas are proposed around the parking areas, street frontages and building foundations to accent the project's architecture. All landscape maintenance will be the responsibility of the individual property owner. 4. Oak Tree Preservation The site contains two native oak trees along the Sombrilla Road frontage. The project has been design and conditioned to preserve and protect the trees. The landscape plan has been designed to protect the area within the trees drip lines from over irrigation. The other non- native trees located on the site will be removed to accommodate site grading. 5. Project Benefits One of the required findings for the approval for a planned development rezone is that the project must"offer certain redeeming features to compensate for the requested modification." Due to the site's limited area no room is available on site for any common recreational facilities. However, it appears that the project will have a number of"redeeming features" which include the following: 1) each unit will have a private yard area that will allow for outdoor recreational opportunities, 2) architectural and landscape features of the project have been designed to enhance the project's appearance and benefit the surrounding neighborhood, and 3) the project will provide a small, two-bedroom, detached single family housing product that is in limited supply throughout the community. 6. Parcel Map A four lot parcel map is proposed as part of the project consistent with the Master Plan of Development. The parcel map has been conditioned by staff and the City Engineer to meet all City standards including street frontage improvements. The applicant will be required to record CC&R's for the map that will cover maintenance and access of common areas. Proposed Environmental Determination Staff has prepared an initial study for the project in conformance with the California Environmental Quality Act. Based on the findings of the initial study, staff determined that the project does not have the potential to create any significant environmental impacts. A proposed negative declaration has been prepared and posted for the project. The Council will take the final action on the environmental determination. The Commission is recommending the City Council adopt the Mitigated Negative Declaration. Conclusion • The proposed project is an attractive small lot residential project that will provide a two- bedroom housing product that is in short supply. • As a result of creative site planning, appears suited to the site and will provide a number of redeeming features. • It appears that all of the required findings for approval can be made. ITEM NUMBER: DATE: 04/25/2000 FISCAL IMPACT: The proposed project consists of a Planned Development Overlay that would allow individual units on separate parcels, but does not create an entitlement for additional residential dwelling units that do not currently exist. Therefore, the fiscal impact of the project would be expected to be negligible. ALTERNATIVES: 1. The Council may approve the project with modifications of any of the conditions of approval. 2. The Council may deny the zoning map amendment and the subdivision map. The parcel would retain its designation of Residential Multi-Family. 3. Michael Cross, on behalf of applicant, indicated they revised the project as suggested by the Commission and that the loan approval for the project was based on a particular budget which included a modular building. Mr. Cross requested that the landscaping requirement along the southern boundary be eliminated and that the landscape setback along Highway 101 be reduced from 8 feet to 4 feet. Mr. Cross also indicated that the modifications requested by the applicant would result in additional sales area from 8-10 units which would increase their sales potential. Commissioner Clark inquired about the cost difference between the roof material. Mr. Cross indicated it would be approximately $1,000 in additional costs. Commissioner Eddings inquired if there were other landscape modifications that could accomplish the same reduction that the applicant was proposing. Mr. Frace indicated that the trees along the southern boundary could be removed; however, the buffer should remain. Commissioner Clark requested alternative roofing material be considered. PUBLIC COMMENT Jim Shores, applicant, indicated he agreed with the staff report and summary of the project. He indicated that he would like to see 2 bedroom homes, however, the standards did not provide that option. Commissioner Fonzi inquired about the price of the homes. Mr. Shores estimated the sales price to start between$139,000 and$149,000. Chairman Carden closed the Public Comment period. Chairman Carden asked why 2 bedroom units were not considered and what the process would be for the Commission to consider 2 bedroom units. Mr. Frace responded that 2 bedroom units are not allowed by the site's zoning standards, but could be considered with either a variance or a density bonus in conjunction with affordable housing restrictions. Mr. Frace stated that a public hearing would be required in order to grant the variance and that certain findings would need to be made. Commissioner Eddings inquired about the location of the high-pressure gas line. Staff responded that it is located in the right of way. Chairman Carden asked the applicant if he would be willing to have the project continued in order to have 2 bedroom units. Mr. Shores indicated his preference is to have the Commission take action tonight on the proposal. Commissioner Clark asked about the difference in parking requirements between the current proposal and 2 bedroom units. Staff responded that there would be no additional parking requirements. Chairman Carden asked if the Commission could approve the action this evening with a recommendation to the City Council that it grant a variance for 2 bedrooms. Staff indicated the Commission could only take the action as listed on the agenda. Commissioner Jeans indicated that the Commission could not take action on increasing the number of bedrooms and that the applicant is requesting the Commission take action to approve the project this evening. Chairman Carden asked staff to review the findings and requirements for the granting of a variance. Commissioner Bentz and Commissioner Fonzi stated their agreement with Commissioner Clark's statement. Chairman Carden asked the applicant if he would be willing to work with staff to. see if the project is eligible and could be modified to include 2 bedroom units. Mr. Shores indicated that he would be interested in pursuing this option; however, he wanted to ensure that the item would be heard at the next Commission meeting. Findings for Approval of Master Plan of Development. The Planning Commission finds as follows: a) The proposed project or use is consistent with the General Plan and the City's Appearance Review Manual; and, b) The proposed project or use satisfies all applicable provisions of the Title (Zoning Ordinance) including the PD-7 Ordinance; and, c) The establishment, and subsequent operation or conduct of the use will not, because of the circumstances and conditions applied in the particular case, be detrimental to the health, safety, or welfare of the general public or persons residing or working in the neighborhood of the use, or be detrimental or injurious to property or improvements in the vicinity of the use; and, d) That the proposed project or use will not be inconsistent with the character or the immediate neighborhood or contrary to its orderly development; and, e) That the proposed use or project will not generate a volume of traffic beyond the safe capacity of all roads providing access to the project, either existing or to be improved in conjunction with the project, or beyond the normal traffic volume of the surrounding neighborhood that would result from full development in accordance with the Land Use Element. f) The project as conditioned will provide for one moderate income dwelling unit and is therefore entitled to a 25% density bonus. The approval of this Master Plan of Development shall become final and effective following the end of the referendum period for zone change 99007(Rezone to RMF-10/PD-7). 2. Approval of this Master Plan of Development shall be valid concurrently with the life of Tentative Parcel Map 99010 and then indefinitely following final map. The Master Plan of Development approval shall expire and become null and void unless a final map is recorded consistent with the Master Plan of Development. 3. The Community Development Department shall have the authority to approve minor changes to the project the(1)increase the intensity of the project by less than 10%, (2)result in a superior site design or appearance, and/or(3)address a construction design issue that is not substantive to the Master Plan of Development. The Planning Commission shall have the final authority to approve any other changes to the Master Plan of Development and any associated Tentative Maps. 4. All subsequent Tentative Parcel Maps and construction permits shall be consistent with the Master Plan of Development contained herein. 5. All exterior elevations, finish materials and colors shall be consistent with the Master Plan of Development as shown in EXHIBIT G and EXHIBIT H. 6. All site work,grading and site improvements shall be consistent with the Master Plan of Development as shown in EXHIBIT B,EXHIBIT E and EXHIBIT F. 7. All site development shall be consistent with the maximum intensities described in the statical project summary as shown on EXHIBIT C. 8. Native oaks trees shall be preserved and protected during construction. A tree protection plan shall be approved and in place prior to the issuance of any construction permits. 9. A final landscape and irrigation plan shall be approved prior to the issuance of building permits and included as part of site improvement plan. The landscape plan shall include the location, variety and container size of all plant material. Approval of this Tentative Parcel Map shall be valid for twenty-four(24)months after its effective date. At the end of the period,the approval shall expire and become null and void unless a final map has been filed or a time extension granted. 2. The form of the Final Tract Map shall substantially conform with the approved Tentative Parcel Map shown in Exhibit A. 3. The tentative parcel map shall not be deemed approved until the ordinance approving Zone Change 99007 becomes effective. 4. Prior to, or concurrently with recordation of the final map the applicant shall record a deed restriction against one of the parcels restricting the sales price or rent of that dwelling to not exceed the income limits of a"moderate income family"as defined by the County of San Luis Obispo Affordable Housing Standards for a period of 15-years 5. All native trees in the proximity of street improvements will be preserved. Tree protection shall be installed prior to the issuance of permits for subdivision improvements. All tree protection shall be shown on improvement plans. 6. The applicant record CC&R's for the subdivision subject to the review and approval of the City Engineer, City Attorney and Planning Department. The CC&R's shall identify to the maintenance responsibilities of all private driveways, sewer facilities, drainage facilities, common parking areas, site lighting, landscape areas,fencing, and other common facilities. The CC&R's shall also state that each unit shall have no more than one bedroom and that all exterior colors, exterior materials, and yard fencing shall be consistent with the overall master plan of development. 7. The project shall be conditioned to comply with the following District regulations _ pertaining to the control of fugitive dust(PM-10). All site grading and demolition plans notes shall list the following regulations. A. All material excavated or graded shall be sufficiently watered to prevent excessive amounts of dust. Watering shall occur at least twice daily with ,. complete coverage,preferably in the late morning and after work is finished for the day. B. All clearing, grading, earth moving, or excavation activities shall cease during periods of high winds (i.e. greater than 20 mph averaged over one hour) so as to prevent excessive amounts of dust. C. All material transported off-site shall be either sufficiently watered or securely covered to prevent excessive amounts of dust. 0G0 Planning Commission Resolution 2000-021 April 4,2000 Page 6 of 9 D. The area disturbed by clearing, grading, earth moving, or excavation operations shall be minimized so as to prevent excessive amounts of dust. E. Permanent dust control measured identified in the approved project revegetation and landscape plans shall be implemented as soon as possible following completion of any soil disturbing activities. F. Exposed ground areas that are planned to be reworked at dates greater than one month after initial grading shall be sown with fast-germinating native grass seed and watered until vegetation becomes established. G. All disturbed areas not subject to revegetation shall be stabilized using approved chemical soil binders,jute netting, or other methods in advance by the APCD. H. All roadways, driveways, sidewalks, etc. to be paved shall be completed as soon as possible. In addition, structural foundations shall be completed as soon as possible following building pad construction. I. On-site vehicle speed shall be limited to 15 mph for any unpaved surface. J. All unpaved areas with vehicle traffic shall be watered at least twice per day, using non-potable water. K. Streets adjacent to the project site shall be swept daily to remove silt which may have accumulated from construction activities so as to prevent excessive amounts of dust from leaving the site. City Engineer 8. All public improvements shall be constructed in conformance with the City of Atascadero Engineering Department Standard Specifications and Drawings or as directed by the City Engineer. 9. The applicant shall enter into an Plan Check/Inspection agreement with the City. All fees and invoices shall be paid in full prior to recordation of Final Map. 10. A six (6) foot Public Utility Easement(PUE) shall be provided contiguous to the Robles Avenue and Sombrilla Avenue property frontages. 11. Slope easements shall be provided on each side of the right-of-way as needed to accommodate cut or fill slopes. 12. The applicant shall be responsible for the relocation and/or alteration of existing utilities. 13. The applicant shall install all new utilities (water, gas, electric, cable TV and telephone) underground. Utilities shall be extended to the property line frontage of each lot or its Planning Commission Resolution 2000-021 April 4,2000 Page 7 of 9 public utility easement. 14. The applicant shall monument all property corners for construction control and shall promptly replace them if disturbed. 15. All existing and proposed utility,pipeline, open space, or other easements are to be shown on the final map. If there are building or other restrictions related to the easements, they shall be noted on the final map. 16. Arelimin subdivision hall p i ary i s b son guarantees be submitted for review in conjunction with the processing of the final map. 17. The applicant shall provide notice either on the parcel map or by separate instrument recorded on, concurrently with, or prior to the recording of the parcel map that there are requirements for off-site and on-site improvements and that the construction of the improvements shall be required prior to the issuance of building permits or other grants of approval for development of the parcels. 18. Prior to recording the final map, the applicant shall acquire title or interest in any off-site land that may be required to allow for the construction of the improvements required by these conditions of approval. The applicant shall bear all costs associated with the necessary acquisitions. The applicant shall also gain concurrence from all adjacent property owners whose ingress or egress is affected by these improvements. 19. Prior to recording the final map,the applicant shall submit the drainage calculations necessary to demonstrate that existing downstream drainage facilities have adequate capacity to handle the total flow from the fully developed watershed without adverse affect on other properties. If downstream facilities do not have adequate capacity, the applicant shall design and construct improvements to the downstream facilities or the applicant shall detain storm water on-site in conformance with City Standards. 20. Prior to recording the final map, the applicant shall submit a map drawn in substantial conformance with the approved tentative map and in compliance with all conditions set, forth herein shall be submitted for review and approval by the City in accordance with the Subdivision Map Act and the City's Subdivision Ordinance. 21. Prior to recording the final map,the applicant shall set monuments at all new property, corners and a registered civil engineer or licensed land surveyor shall indicate, by, certificate on the final map, that corners have been set or shall be set by a date specific and that they will be sufficient to enable the survey to be retraced. 22. Prior to recording the final map,the applicant shall pay all outstanding plan check/inspection fees. 23. Prior to recording the final map, the applicant shall submit a grading and drainage plan prepared by a registered civil engineer for review and approval by the City Engineer. Drainage shall only 1 g g y cross of lines where private drainage easements have be provided. 24. Prior to recording the parcel map, the applicant shall design the following street improvements. Plans for street improvements shall be submitted for review and approval by the City Engineer. Plans shall be prepared by a regiestered civil engineer and shall be prepared in conformance with City Standards. R-value testing shall be done, and pavement section designed by a registered civil engineer to the satisfaction of the City Engineer. a) The northerly half of Robles Avenue shall be improved in conformance with City Standard 405 (local) along the entire property frontage, or as approved by the City Engineer. b) The westerly half of Sombrilla Avenue shall be improved in conformance with City Standard 405 (local) along the entire property frontage, or as approved by the City Engineer. c) The existing streets adjacent to the property frontage shall be overlayed to remedy an inadequate structural section or to remedy deteriorated paving surface as directed by the City Engineer. Transitions shall be constructed between the proposed improvements and the existing improvements as directed by the City Engineer. d) The minimum property line radius at the intersection of Robles Avenue with Sombrilla Avenue shall be 20-feet. 25. Prior to recording the final map, the applicant shall have the map reviewed by all applicable public and private utility companies (cable, telephone, gas, electric, Atascadero Mutual Water Company). The applicant shall obtain a letter from each utility company which indicates their review of the map. The letter shall identify any new easements which may be required by the utility company. A copy of the letter shall be submitted to the City. New easements shall be shown on the parcel map. 26. Prior to the parcel map being placed on the agenda for City Council acceptance,the map shall be signed by the City Engineer. 27. Upon recording the final map,the applicant shall provide the City with a black line clear Mylar (0.4 mil) copy and a blue line of the recorded map, 28. Prior to issuance of building permit, the applicant shall submit a grading and drainage plan prepared by a registered civil engineer for review and approval by the City Engineer. 29. Prior to the final inspection, all outstanding plan check and inspection fees shall be paid. 30. Prior to the final inspection,the applicant shall submit a written statement from a 063 Planning Commission Resolution 2000-021 April 4,2000 Page 9 of 9 registered civil engineer that all work has been completed and is in full compliance with the approved plans and the Uniform Building Code (UBC)prior to the final inspection. 31. Prior to the final inspection,the applicant shall submit a written certification from a registered civil engineer or land surveyor that all survey monuments have been set as shown on the final map. 32. The approval of this Master Plan of Development shall become final and effective following the end of the referendum period for zone change 99007(Rezone to RMF-10/PD-7). 2. Approval of this Master Plan of Development shall be valid concurrently with the life of Tentative Parcel Map 99010 and then indefinitely following final map. Approval of this Tentative Parcel Map shall be valid for twenty-four(24)months after its effective date. At the end of the period,the approval shall expire and become null and void unless a final map has been filed or a time extension granted. 2. The form of the Final Tract Map shall substantially conform with the approved Tentative Parcel Map shown in Exhibit A. 3. The tentative parcel map shall not be deemed approved until the ordinance approving Zone Change 99007 becomes effective. 4. Prior to,or concurrently with recordation of the final may,the applicant shall record a deed restriction against one of the parcels restricting the sales price or rent of that dwelling to not exceed the income limits of a"moderate income family" as defined by the County of San Luis Obispo Affordable Housing Standards for a period of 15-mss, 5. All native trees in the proximity of street improvements will be preserved. Tree protection shall be installed prior to the issuance of permits for subdivision improvements. All tree protection shall be shown on improvement plans. 6. The applicant record CC&R's for the subdivision subject to the review and approval of the City Engineer, City Attorney and Planning Department. The CC&R's shall identify to the maintenance responsibilities of all private driveways, sewer facilities, drainage facilities, common parking areas, site lighting, landscape areas, fencing, and other common facilities. The CC&R's shall also state that each unit shall have no more than one bedroom and that all exterior colors, exterior materials, and yard fencing shall be consistent with the overall master plan of development. 7. The project shall be conditioned to comply with the following District regulations pertaining to the control of fugitive dust(PM-10). All site grading and demolition plans notes shall list the following regulations. A. All material excavated or graded shall be sufficiently watered to prevent excessive amounts of dust. Watering shall occur at least twice daily with complete coverage, preferably in the late morning and after work is finished for the day. B. All clearing, grading, earth moving, or excavation activities shall cease during periods of high winds (i.e. greater than 20 mph averaged over one hour) so as to prevent excessive amounts of dust. C. The area disturbed by clearing, grading, earth moving, or excavation operations shall be minimized so as to prevent excessive amounts of dust. E. Permanent dust control measured identified in the approved project revegetation and landscape plans shall be implemented as soon as possible following completion of any soil disturbing activities. F. Exposed ground areas that are planned to be reworked at dates greater than one month after initial grading shall be sown with fast-germinating native grass seed and watered until vegetation becomes established. G. All disturbed areas not subject to revegetation shall be stabilized using approved chemical soil binders,jute netting, or other methods in advance by the APCD. H. All roadways, driveways, sidewalks, etc. to be paved shall be completed as soon as possible. In addition, structural foundations shall be completed as soon as possible following building pad construction. I. On-site vehicle speed shall be limited to 15 mph for any unpaved surface. J. All unpaved areas with vehicle traffic shall be watered at least twice per day, using non-potable water. K. Streets adjacent to the project site shall be swept daily to remove silt which may have accumulated from construction activities so as to prevent excessive amounts of dust from leaving the site. City Engineer 8. All public improvements shall be constructed in conformance with the City of Atascadero Engineering Department Standard Specifications and Drawings or as directed by the City Engineer. 9. The applicant shall enter into an Plan Check/Inspection agreement with the City. All fees and invoices shall be paid in full prior to recordation of Final Map. 10. A six (6) foot Public Utility Easement(PUE) shall be provided contiguous to the Robles Avenue and Sombrilla Avenue property frontages. 11. Slope easements shall be provided on each side of the right-of-way as needed to accommodate cut or fill slopes. 12. The applicant shall be responsible for the relocation and/or alteration of existing utilities. 13. The applicant shall install all new utilities (water, gas, electric, cable TV and telephone) underground. Utilities shall be extended to the property line frontage of each lot or its Draft Resolution April 25,2000 Page 7 of 9 public utility easement. 14. The applicant shall monument all property corners for construction control and shall promptly replace them if disturbed. 15. All existing and proposed utility, pipeline, open space, or other easements are to be shown on the final map. If there are building or other restrictions related to the easements, they shall be noted on the final map. 16. A preliminary subdivision guarantee shall be submitted for review in conjunction with the processing of the final map. 17. The applicant shall provide notice either on the parcel map or by separate instrument recorded on, concurrently with, or prior to the recording of the parcel map that there are requirements for off-site and on-site improvements and that the construction of the improvements shall be required prior to the issuance of building permits or other grants of approval for development of the parcels. 18. Prior to recording the final map,the applicant shall acquire title or interest in any off-site land that may be required to allow for the construction of the improvements required by these conditions of approval. The applicant shall bear all costs associated with the necessary acquisitions. The applicant shall also gain concurrence from all adjacent property owners whose ingress or egress is affected by these improvements. 19. Prior to recording the final map, the applicant shall submit the drainage calculations necessary to demonstrate that existing downstream drainage facilities have adequate capacity to handle the total flow from the fully developed watershed without adverse affect on other properties. If downstream facilities do not have adequate capacity, the applicant shall design and construct improvements to the downstream facilities or the applicant shall detain storm water on-site in conformance with City Standards. 20. Prior to recording the final map, the applicant shall submit a map drawn in substantial conformance with the approved tentative map and in compliance with all conditions set forth herein shall be submitted for review and approval by the City in accordance with the Subdivision Map Act and the City's Subdivision Ordinance. 21. Prior to recording the final map,the applicant shall set monuments at all new property corners and a registered civil engineer or licensed land surveyor shall indicate, by certificate on the final map,that corners have been set or shall be set by a date specific and that they will be sufficient to enable the survey to be retraced. 22. Prior to recording the final map,the applicant shall pay all outstanding plan check/inspection fees. 23. Prior to recording the final map,the applicant shall submit a grading and drainage plan prepared by a registered civil engineer for review and approval by the City Engineer. Drainage from areas outside the subdivision boundary shall be conveyed across the Draft Resolution April 25,2000 Page 8 of 9 subdivision in private drainage easements. Drainage shall only cross lot lines where private drainage easements have be provided. 24. Prior to recording the parcel map, the applicant shall design the following street improvements. Plans for street improvements shall be submitted for review and approval by the City Engineer. Plans shall be prepared by a regiestered civil engineer and shall be prepared in conformance with City Standards. R-value testing shall be done, and pavement section designed by a registered civil engineer to the satisfaction of the City Engineer. a) The northerly half of Robles Avenue shall be improved in conformance with City Standard 405 (local) along the entire property frontage, or as approved by the City Engineer. b) The westerly half of Sombrilla Avenue shall be improved in conformance with City Standard 405 (local) along the entire property frontage, or as approved by the City Engineer. c) The existing streets adjacent to the property frontage shall be overlayed to remedy an inadequate structural section or to remedy deteriorated paving surface as directed by the City Engineer. Transitions shall be constructed between the proposed improvements and the existing improvements as directed by the City Engineer. d) The minimum property line radius at the intersection of Robles Avenue with Sombrilla Avenue shall be 20-feet. 25. Prior to recording the final map,the applicant shall have the map reviewed by all applicable public and private utility companies (cable,telephone, gas, electric, Atascadero Mutual Water Company). The applicant shall obtain a letter from each utility company which indicates their review of the map. The letter shall identify any new easements which may be required by the utility company. A copy of the letter shall be submitted to the City. New easements shall be shown on the parcel map. 26. Prior to the parcel map being placed on the agenda for City Council acceptance, the map shall be signed by the City Engineer. 27. Upon recording the final map,the applicant shall provide the City with a black line clear Mylar(0.4 mil) copy and a blue line of the recorded map, 28. Prior to issuance of building permit,the applicant shall submit a grading and drainage plan prepared by a registered civil engineer for review and approval by the City Engineer. 29. DISCUSSION: We have received correspondence from the Atascadero Chamber of Commerce requesting the City's participation in a joint effort to install brackets on 35 PG&E utility poles for promotional banners on El Camino Real (ECR). The Chamber of Commerce is coordinating the banner project, which would involve at least five organizations including the City and the Chamber. The City and the other groups would finance the purchase of the 35 brackets equally. The City and each of the other organizations would purchase their own banners. The City would have 35 banners to hang on every pole from Rosario to Curbaril Avenue. Most of the year, it's anticipated that community groups would install these banners on every other pole between the City's banners on a rotating basis. Whenever there were no events taking place, all 35 of the City's banners would be displayed. Eventually, the Chamber would like to see banners from the Factory Outlets (Del Rio Road) to the north and Santa Rosa Road to the south, with additional community groups participating as the project expands. Future participating groups would have to pay a bracket fee in addition to purchasing their own banners to expand the area. The City's sign ordinance does not specifically address banners of this type. The Administrative Use Permit process set forth in the sign ordinance would enable the City to permit and regulate such promotional banners for general public purposes. As PG&E own the poles proposed to be used, the Chamber has contacted the utility company for permission to use their poles. The Chamber is requesting that the City's Public Works Department be asked to install the brackets and change the banners on an as-needed basis. The City of Paso Robles uses the same banner system, and the banners can reportedly be changed with the use of a ladder. Atascadero's Public Works Department estimates that it will cost 007 ITEM NUMBER: C-1 DATE: 04/25/2000 $600.00 per day and two men to change the 35 banners on an on-going basis. This cost would increase incrementally as the project expands up and down El Camino Real. It is not recommended that the City provide the installation of the brackets or banners at this time due to the very limited resources in the Public Works Department. This project idea has been tossed around for years and finally I believe we have enough interested parties to help make Banners a reality. This is a proposed joint effort between the following groups to finance the purchase of 35 brackets to be mounted on 35 light posts. Wine Festival Committee Colony Days Chamber of Commerce Zoological Society City of Atascadero The purpose of these banners is to promote Atascadero and various local nonprofit groups functions and events. We think these banners will be a good addition to warm up and make our town a more friendly community by communicating these messages to City residents. The enclosed color photo is to show you the type of bracket we would like to install on the light posts. However,we are not placing them on the antique light posts as pictured in the one from Paso Robles. We want to mount them the larger PG&E light posts low enough so the banners can be changed by someone on a ladder,but high enough to keep vandals away. Our banners would be 24"x 48", bigger than the one in the photo. A letter to PG&E has been sent seeking permission to use their light posts. We are proposing to have City personnel install the brackets like Paso Robles did for their posts. The City of Paso Robles gave this type of bracket a very favorable mark compared to the band type they have used in the past. The brackets took 30 minutes to install and 6 minutes to change out a banner. Please contact,Gary Perrazzi from the Public Works Division in Paso Robles at 237-3864 to verify this information. The key to the success of this program would be for the City to finance the purchase of at least one set of 35 banners for the general promotion of Atascadero. DISCUSSION: On Thursday, March 16, 2000, the Parks and Recreation Commission voted unanimously to recommend that the City Council make changes to the Short-term Stadium Park Rules and Public Use Policies, originally adopted in Resolution No. 92-97. The intent of the recommended changes to Short-term Stadium Park Rules and Public Use Policies is to allow for public assembly events. In the past few months, three local community groups have recently expressed an interest in using Stadium Park in the near future for public performances. Current-City policies for the use of Stadium Park do not allow for publicly advertised special events. A copy of Resolution 92- 97, the Short-term Stadium Park Rules and Public Use Policies is attached. These policies were developed by the Parks and Recreation Commissions Stadium Park Sub-Committee and adopted by the City Council on October 28, 1997. Large public gatherings were prohibited by this policy due to the lack of restrooms, electricity, inadequate emergency access and other safety considerations. In light of the recent interest in conducting public assembly events in Stadium Park, the Parks and Recreation Commission reconvened the Stadium Park Focus Group to consider measures that may be taken to allow the facility to be used for public assembly events prior to making significant capital improvements. The reconvened Stadium Park Focus Group met on three occasions and drafted recommended revisions to item number three of the Stadium Park Short- Term Public Use Rules and Policies. In its place the Stadium Park Focus Group and the Parks and Recreation Commission are recommending the following policy be inserted, which would allow public assembly events under certain conditions: 103 ITEM NUMBER: C-2 DATE: 04/25/2000 3. Public Assembly Events are permitted on approval of the City Manager, provided that the following conditions are met: The Event Holder submits the following plans prior to approval: a. Security plans/APD notification plans The Following Rules will apply to all approved Public Assembly Events: a. All events restricted to daylight hours, including set-up and clean-up b. Picnic style seating on the ground with blankets and folding chairs only C. Trash disposal required by the event holder d. Vehicles allowed in Stadium Park for deliveries only e. Hazardous weather conditions may restrict use of Stadium Park for public assembly events. f. A $100.00 refundable Security Deposit must be paid twenty (20) working days in advance by the event holder g. Portable restrooms are required for all public assembly events and must be removed on the same day of the event. In addition to the above recommended revisions, the Parks and Recreation Commission and the Stadium Park Focus Group advise that certain physical improvements be made to Stadium Park prior to the approval of any public assembly event. The recommended improvements are: 1. Re-grade the existing access road based on approved grading plan, following required tree protection measures. 2. Address drainage in the bowl and on the road, based on an approved drainage plan. 3. Fill trip hazards in the "bowl area," outside of the drip-line of the trees, based an approved grading plan. 4. An area within the "bowl area" will be cleared for the placement of portable restrooms. 5. Appropriate Environmental Review to be completed prior to any work. The Parks and Recreation Commission recommends approval of the revisions that would allow public assembly events to return to Stadium Park and suggests that a "test" event with the Atascadero Community Band be conducted as soon as the recommended improvements are completed. FISCAL IMPACT: The cost for the recommended improvements are undetermined and not budgeted. RECOMMENDATION: Staff recommends Council authorize the Mayor to send correspondence to the Atascadero State Hospital, formally requesting consideration of a lease agreement for approximately six acres of State property for use as a public park. DISCUSSION: For many years, the City of Atascadero and the Atascadero Unified School District have been at or near maximum capacity on our athletic fields available in the community. Athletic fields for both youth and adult sports activities are virtually unavailable at certain times of the year. With youth and adult sports growing, the available field space is unable to accommodate current and future demands. With this in mind, staff has had some preliminary discussions regarding the potential for a lease agreement for state property on Halcon Road structured similar to our existing agreement for Paloma Creek Park. These discussions have been very positive and indicate that the State Hospital Administration would be willing to consider such a request by the City. Several youth sports organizations in the community are very supportive of an effort to create additional and much needed athletic fields in Atascadero. A conceptual -drawing has been developed with the help of Community Development Department staff, which is attached. This drawing is entirely conceptual and for discussion purposes only. It does however, give some indication of some of the possibilities for the property. FISCAL IMPACT: None at this time. Council's direction would only provide the impetus to open formal discussions with the State Hospital officials. Actual terms of a proposed lease agreement would be brought back to the City Council for review. Long term park development costs would be identified at a future date. Main Street The Main Street project is progressing. Four working groups dealing with the Main Street priorities, organization, marketing, economic restructuring and design are meeting. They are developing strategies for implementing the four areas once the Main Street program is in operation. The draft revitalization plan, which will include Main Street as a strategy, is targeted for completion in early June followed by Council hearings. C.
