RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATASCADERO
REGARDING PROFESSIONAL SERVICES PROVIDED BY JOHN WALLACE
AND ASSOCIATES IN REGARD TO THE SYCAMORE ROAD BRIDGE AND
THE LEWIS AVENUE BRIDGE
WHEREAS, John Wallace and Associates claim to have incurred
approximately $22,943 in additional costs for the Sycamore Road
Bridge project. Neither the City nor Caltrans executed a formal
contract amendment for a change order with John Wallace and
Associates. Discussions were initiated with staff in 1989 and were
expressed in a letter from John Wallace and Associates to Henry
Engen on March 20, 1990 for the City to pursue reimbursement of the
extra costs required for completion. John Wallace claims he was
verbally authorized to do the work, neither the City nor Caltrans
have agreed to his claim. The City agrees that it will, with John
Wallace and Associates, aggressively seek reimbursement from
Caltrans for the additional funds claimed to be owed. The City
further agrees to match all monies reimbursed from Caltrans for
payment on a one-to-one basis for a total combined payment not to
exceed $22,943.
WHEREAS, in the matter of the Lewis Avenue Bridge,the City
shall pay to John Wallace and Associates the total of an
outstanding invoice in the amount of $1,283.51 at which time the
contract for this project will be terminated.
NOW, THEREFORE, BE IT RESOLVED that the City of Atascadero
does agree to the above stipulations.
On motion by Councilmember Nimmo, and seconded by
Councilmember Shiers, the foregoing Resolution is hereby adopted in
its entirety on the following roll call vote:
AYES: Councilmembers Dexter, Nimmo, Shiers and Mayor Lilley
NOES: None
ABSENT: Councilwoman Borgeson
