R E S O L U T I O N N o . 65 — 89
A RESOLUTION PETITIONING THE LEAGUE OF CALIFORNIA CITIES
FOR THE INTRODUCTION OF STATE LEGISLATION
TO ALLOW STATUTE CITIES TO DETERMINE AND ESTABLISH
SPEED LIMITS ON ROADWAYS WITHIN THEIR CITY LIMITS
WHEREAS, speeding on City streets is a problem; and,
WHEREAS, a high majority of local traffic committee agendas deal with
speed on City streets; and,
WHEREAS, due to current legislation, a high majority of local speed
limits cannot be reduced below the 85%tile speed as determined by a
traffic and engineering survey; and,
WHEREAS, speed limits on City streets are controlled by State procedures
used to eliminate speed traps; and,
WHEREAS, speed traps are historically characterized by short segments of
State highways within City Limits that are not interrupted by traffic
control devices; and,
WHEREAS, City streets in general do not fulfill any definition of speed
traps; and,
WHEREAS, recent House and Senate Bills that have been introduced to
excempt Cities from the speed trap criteria have failed in committee;
and,
WHEREAS, the classification, condition and design of City streets should
play a role in determining the safe speed to travel on City streets;
and,
WHEREAS, the number of drive encroachments, bicyclists, pedestrians,
trees, and other conflicts on highways increase within the City Limits;
and,
WHEREAS, City streets become increasingly unsafe as speed increases;
and,
WHEREAS, City officials and City traffic engineers are best to judge the
safe speed to travel on City streets .
NOW, THEREFORE, LET IT BE RESOLVED THAT; Except on short segments of
State highways absent of traffic control devices, Cities shall determine
and establish the speed limit on streets within their City Limits .
On motion by Councilman Shiers seconded by Councilman
Borgeson ,the foregoing Resolution is hereby adopted in its
entirety on the following roll call vote:
AYES: Councilmembers Shiers, Borgeson, Mackey, Lilley and Mayor Dexter
NOES: None
ABSENT: None
