RESOLUTION OF THE COUNCIL OF THE CITY OF
ATASCADERO ESTABLISHING A POLICY ADDRESSING
THE CONFLICT BETWEEN ROADWAY CONSTRUCTION WITHIN
ORIGINAL COLONY ROAD ALIGNMENTS AND TREE PRESERVATION
AND PROTECTION
WHEREAS , the original layout of the Atascadero Colony
included the recording of the Colony Road System; and
WHEREAS, the original Colony roadway system has
historic significance; and
WHEREAS , the Original Colony Roadways were laid out
to serve all of the original lots without causing excessive
grading of adjacent lots ; and
WHEREAS, the original colony Road layout is
considered a reasonable answer to serving rural lots within
a hilly terrain; and
WHEREAS , the oak trees and other trees within the City
aro considered an asset ; and,
WHEREAS , there has been established a designation of
"heritage trees" within the City; and,
WHEREAS, there exists physical conflicts between some
roadway construction and some trees ; and
WHEREAS, the City Council is attempting to resolve
such conflict while preserving both the original colony
road alignments and trees which are significant due to
quality or number ,
NOW, THEREFORE, BE IT RESOLVED THAT :
Whenever roadways are constructed within the Colony road
alignments , consideration shall be given to preserving and
protection of trees . Such consideration shall include , but
is not limited to, the following:
(a) The roadway alignment should vary within the
right-of-way to accommodate trees ; i . e . , the centerline of
the pavement may be different than the centerline of the
right-of-way ,
(b) Roadway alignments which vary from the original
Colony centerline shall provide safe curves and smooth
transitions , as approved by the City Engineer ; necessary
utilities shall be accommodated,

(c) The roaway alignment should be adjusted to vary
outside of the right-of-way to accommodate trees
significant in quality or number whenever adjacent property
can be easily obtained for encroachment ,
ment , or where large
tracts of land are under common ownership .
(d) Movement of the roadway outside of the right-of-
way shall be limited to easements or lot line adjustments ,
but in general shall not constitute a subdivision of land
or the taking of property .
(e) Movement of the roadway outside of the right-of-
way shall take into account other trees outside the right-
of-way as well as excessive cross section cuts and fills
and excessive profile grades .
(f) Tree protection plans shall be governed by those
guidelines established for private development , but may be
waived if special efforts included above are made to save
the tree (s) in question .
(g) All else being equal , the cost of roadway
construction may be reasonably impacted by the cost of
saving trees ; if the construction cost for the revised
alignment does not exceed 125% of the normal roadway cost
estimate, the trees shall be saved.
On motion by Councilman Lilley seconded
by Councilman Shiers the foregoing
resolution is passed on the following roll call vote :
AYES : Councilmembers Lilley, Sbiers, Mackey, Borgeson and Mayor Dexter
NOES : None
ABSENT : None
