RESOLUTION OF THE COUNCIL OF THE CITY OF
ATASCADERO PLACING THE ANNUAL PAYMENT FOR
ASSESSMENT DISTRICT NO. 5 (CHANDLER RANCH)
ON THE PROPERTY TAXES FOR THE 1989-90 FISCAL YEAR
WHEREAS, Assessment District No . 5 was initiated by
the property owners for the purpose of improving their
roads to a standard acceptable to the City of Atascadero;
and
WHEREAS, the Council of the City of Atascadero
adopted Resolution 92-88 declaring its intention to
undertake proceedings pursuant to the Municipal Improvement
Act of 1913 and to issue bonds in said proceedings under
the provisions of the Improvement Bond Act of 1915 , for the
construction of improvements knows as " City of Atascadero
Assessment District No , 5 (Chandler Ranch) ;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Atascadero , as follows ;
Section 1 . The foregoing recitals are true an correct
and this Council so finds and determines .
Section 2 . Notices were mailed to each person owning
property in the City of Atascadero Assessment District #5
(Chandler Ranch) , at his/her last known address as it
appears on the tax rolls of the County of San Luis Obispo,
said statement containing a designation of the property
assessed, the amount of the assessment , the date of the
recordation of the assessment , the time and place of
payment of the assessment and the effect of failure to pay
within such time, and a statement that bonds would be
issued under the Improvement Bond Act of 1915 to represent
unpaid assessments .
Section 3 . Notices were mailed and published stating
that all sums assessed were due and payable immediately,
that the payment of sums is to be made to the Treasurer of
the City within 30 days after the date of recording the
assessment , and that if any assessments were not paid
within the 30 day period, bonds would be issued under the
Improvement Bond Act of 1915 to represent unpaid
assessments ,
Section 4 . Serial Bonds representing unpaid
assessments have been issued in the manner provided by
Division 10 of the Streets and Highways Code and the
Improvement Bond Act of 1915 .
Section 5 . The adoption of this resolution authorizes
collection of the assessment for the fiscal year commencing
on the lst day of July 1989 and ending on the 30th day of
June , 1990 , said assessments as listed on the attached
Exhibit A.
Section 6 . The City Clerk is hereby ordered and
directed to file a certified copy of the assessment roll
with the County Auditor, together with a certified copy of
this Resolution upon its adoption .
Section 7 . The City Clerk is hereby further ordered
and directed to file a certified copy of the assessment
roll with the County Tax Collector , together with a
certified copy of this Resolution upon its adoption .
On motion by Councilman Mackey and seconded by
Councilman Borgeson the foregoing resolution is hereby
adopted in its entirety on the following vote :
AYES : Councilmembers Mackey, Borgeson, Shiers, Lilley and Mayor Dexter
NOES : none
ABSENT : none
