HomeMy WebLinkAboutResolution 13-89 RESOLUTION NO. 13-89 A RESOLUTION OF THE COUNCIL OF THE CITY OF ATASCADERO CONSIDERING INTENT TO VACATE A PORTION OF THE SAN ANDRES AVENUE RIGHT-OF-WAY PURSUANT TO STREETS AND HIGHWAYS CODE; PART 3, CHAPTER 3, SECTION 8320 WHEREAS, Streets and Highways Code Section 8320 requires that the Council shall, by resolution, advise of its intention to vacate a street described as follows : A portion of the San Andres Avenue right-of-way shown on the attached exhibit. WHEREAS, pursuant to Government Code Section 65402 , the City Planning Commission has recommended to the Council its finding that the vacation of this portion of the San Andres Avenue right- of-way is in conformance with the General Plan; and WHEREAS, pursuant to Streets and Highways Code Section 2381, the City Planning Commission has recommended to the Council its finding that this portion of the San Andres Avenue right-of-way is not suitable or useful as a non-motorized transportation facility; and WHEREAS, the vacation of this portion of the San Andres Avenue right-of-way will not affect any in-place, in-use public utility facilities or that adequate relocation of utilities is provided. NOW, THEREFORE, the Council of the City of Atascadero resolves as follows : 1 . The City Council shall hold a public hearing on March 14, 1989 to consider a Resolution of Vacation at which time all persons interested in the proposed vacation may be heard. 2 The City Clerk shall cause the notice of this public hearing to vacate this portion of the San Andres Avenue right-of-way to be published in the same manner as other resolutions of this Council . 3 . The Clerk shall execute and file an affidavit, as proof of publication of the notice of public hearing to vacate 4 . The Director of the Community Development Department shall forthwith cause to be posted, conspicuous notices of vacation in compliance with Streets and Highways Code Section 8323 . As proof of the posting of the notice, the Director of the Community Development shall execute and file an affidavit setting forth the facts of the posting in detail, as to time and manner.
