RESOLUTION NO. 9-88
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ATASCADERO AUTHORIZING CLOSURE OF ENTRADA AVENUE
BETWEEN EL CAMINO REAL AND PALMA AVENUE ON WEDNESDAYS BETWEEN THE
HOURS OF 2 :30 P.M. AND 7 :30 P.M. FOR A PERIOD OF SIX MONTHS
WHEREAS, the North County Farmers ' Market Association, Inc.
is desiring to relocate the Farmers' Market to downtown Atasca-
dero; , and
WHEREAS, the Board of Director' s of the Downtown Business
Improvement Association are supportive of this relocation to
stimulate activity and interest in the downtown area; and
WHEREAS, the proposed application has been reviewed by the
Community Development Department, Public Works Department, Fire
Department and Police Department; and
WHEREAS, the Municipal Code, Article 15, Section 4-2,1501
gives authority for temporarily closing streets for local special
events; and
WHEREAS, the City Council has held a public hearing on
January 12, 1988, to consider said proposal and public comments,
and;
WHEREAS, the closing is necessary for the safety and
protection of persons who are to use that portion of the street.
NOW THEREFORE, be it resolved by the Council of the City of
Atascadero as follows:
Section 1 . The City Manager, or designee thereof, is authorized
to close Entrada from E1 Camino Real to Palma to through vehicle
traffic between 2 :30 p.m. and 7 :30 p.m. , every Wednesday from
January 20, 1988 through July 13, 1988 . Said closure shall be
effected in the manner agreeable to the Public Works Director,
Police Chief, and Fire Chief.
Section 2 . North County Farmers' Market Association, Inc. is
authorized to conduct operation of a Farmers ' Market subject to
the following conditions :
1 . Provide the City with a copy of the Famers' Market Certifi-
cate issued by the County Agricultural Commissioner.
2 . All sellers shall have Producer' s Certificates from the
County Agricultural Commissioner and/or be selling farm
products pursuant to other state regulations authorized by
rules of the association (i.e. seller must be the producer,
member of the producer' s family, or an employee of the
producer with no reselling allowed) .
3 . Sell of handy crafts is not permitted.
4 . Bar-B-Ques, in compliance with all Health Department rules,
are permitted.
5 . Appropriate barriers, to the approval of the Public Works
Department, shall be provided and positioned.
6 . The site shall be cleared of all rubbish and debris after
each sale.
7 . Hours of operation shall be limited to 2 :30 p.m. to 7 :30
p.m.
8. Temporary signage for the Farmers' Market shall be limited
to 32 square feet.
9 . The proposed Farmers' Market shall take up no more than 38
stalls (refer to attached Exhibit) . Proposed stall #15
shall be eliminated to provide alley access .
10. A Certificate of Insurance shall be provided, naming the
City of Atascadero as additional insured, with a minimum
liability coverage of $ 500,000.-
11 . The City Council may, on ten (10) days written notice,
rescind this authorization.
Section 3 . The Chief of Police shall report to the City Council
every sixty (60) days regarding the effects of the closure.
On motion by COUNCILWOMAN BORGESON and seconded by
COUNCILMAN HANDSITY , the resolution was approved by the
following roll call vote:
AYES: COUNCILMEMBERS BORGESON, HANDSITY, MACKEY AND MAYOR NORRIS
NOES: COUNCILMAN BOURBEAU
ABSENT: NONE
